Section L - Instructions, Conditions and Notices to Bidders

SUBMISSION OF PROPOSALS

I. GENERAL

Initial proposals and any modifications thereto are to be submitted to the Contract Specialist on or before the closing date and time cited elsewhere in this Request for Proposal (RFP). All proposals shall be submitted to the Contract Specialist, John Lavelle, at john.r.lavelle@navy.mil. No proposals shall be submitted by mail or by any other means except in the form explicitly stated herein.

Offerors shall only submit a price proposal in response to this solicitation. The price proposal shall include solicitation pricing pages completed by the offeror in Microsoft Word, Excel, or PDF format. Offerors shall acknowledge any RFP amendments (if any) by email to John Lavelle at john.r.lavelle@navy.mil at the time final proposal is submitted.

The completion and submission of the above items will constitute a proposal and will be considered the offeror’s unconditional assent to the terms and conditions of this solicitation and any attachments and/or exhibits hereto. Offerors shall respond to all requirements of the solicitation document. Offerors are cautioned not to alter the solicitation. Any affirmative exception to the material terms and conditions of the solicitation will render the offeror ineligible for award.

Potential offerors are encouraged to carefully review all solicitation requirements and, if they have questions concerning the solicitation, should submit one consolidated list of questions concerning the solicitation via email to the solicitation point of contact, John Lavelle at john.r.lavelle@navy.mil, NO LATER THAN 3:30 pm EST on 15 January 2020 . Questions should be submitted as early as feasible prior to the above date and time; questions received after the date and time specified above may be answered at the discretion of the Navy.

In the event any person who is not a bona fide employee of the offeror participated in the creation, formulation, or writing of any portion of the proposal, a statement to this effect shall be included in the proposal. Such statement shall identify the name of the person who is not a bona fide employee, that person’s employment capacity, the name of the person’s firm, the relationship of that firm to the offeror and the portion of the proposal in which the person participated.

II. REQUIREMENTS FOR PROPOSAL CONTENT

(1) Do not include CLASSIFIED data in your proposal.

(2) Introduction and Purpose - This section specifies the format that offerors should use in proposals submitted in response to this solicitation. The intent is not to restrict the offerors in the manner in which they will perform their work but rather to ensure a certain degree of uniformity in the format of the proposal for evaluation purposes.

(3) The price proposal should contain the following items in addition to the other information required by this solicitation:

Cover: The cover should indicate the following: Title of the proposal RFP number Name and address of offeror

The price proposal is not page limited but the offeror should limit its response to only that price information that is necessary to respond to the requirements of the solicitation.

Volume I – Price Proposal

The Price Proposal shall include the solicitation pricing pages completed by the offeror. The offeror shall include prices for each of the CLINs on the solicitation pricing pages and shall provide a total firm-fixed-price consisting of the total of all firm-fixed price CLINs. That total proposed price shall represent the offeror’s firm-fixed-price for performance of all of the solicitation’s requirements. A firm-fixed-price is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract.

Section M - Evaluation Factors for Award

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

The Government will award on the basis of price unless the contracting officer is aware of past performance information related to the low price quote/offer which indicates that quote/offer may not represent best value. In that case, the Government reserves the right to consider the past performance of other quotes/offers, conduct a price, past performance tradeoff, and award to other than the lowest price quote/offer.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
