About this file
This is a Justification & Authorization (J&A) document for a sole source facilities support contract at Naval Support Activity (NSA) Orlando, Florida. The document justifies awarding contract N6945025D0002 to T&H Solutions LLC, an 8(a), HUBZone, and Small Disadvantaged Business, for Multi-Function Support Services (MFSS) for a 365-day period from December 1, 2024, through November 30, 2025.
The J&A cites urgent and compelling circumstances to prevent a lapse in critical facility maintenance services at NSA Orlando. T&H Solutions was selected based on their current performance of multiple MFSS contracts with NAVFAC Southeast and Mid-Atlantic, their presence in Florida and Southern Georgia, demonstrated ability to handle expedited phase-in periods, and familiarity with NAVFAC Maximo. The Navy plans to conduct market research immediately for a competitive follow-on procurement with anticipated award in Q1 FY2026. Key services include preventive maintenance on facility assets, integrated solid waste management, and other mission-essential support services. The contract will be awarded without public synopsis due to urgency, and pricing will be determined fair and reasonable based on independent government estimates and historical data.

A stand-alone MFSS contract is required to prevent a lapse in services.
It is critical to the overall Navy’s mission that these MFSS be maintained until a competitive follow-on contract can be awarded. All required MFSS to be performed under the authority requested by this J&A are critical requirements which the Navy needs in order to continue its mission. A lapse in service would result in serious injury to the Government as it will not fulfill the mission requirements of and severely limit the operational capability of NSA Orlando and its tenant commands. Lack of preventive maintenance on facility assets risks sensitive equipment not being cooled properly, for example; or potentially risks catastrophic failure of those critical facility assets or systems. In addition, without integrated solid waste management services, there is a potential risk to human health resulting from overflow of waste. Based upon market research, T&H Solutions LLC, a certified 8(a), HUBZone, and Small Disadvantaged Business, was determined to be the firm in the best position to immediately mobilize and perform the requirement without a gap in essential contract services. It is anticipated that award to any other source would result in additional costs and/or unacceptable delays in fulfilling the agency’s critical requirements.
The estimated length of the requirement is approximately 365 days. This allows time for the agency to execute a longer term, competitive contract action. The Plan of Action & Milestones (PO&AM) will include, but is not limited to: finalizing the requirements/performance work statement, performing acquisition planning, developing evaluation criteria, posting a synopsis, issuing a request for proposal, receiving proposals, entering into discussions as necessary, making a best value decision, finalizing all pre-award documentation, requesting and receive funding documents, issuing any required pre-award notices, and providing for the required 30-day mobilization and phase-in period. This 365 days also allows for the possibility of any additional unforeseen circumstances that may arise during pre-award, award and phase-in process. The delay is unacceptable because it represents a gap in contractual coverage and mission essential services.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. Market research for this one-year contract commenced in August 2024 to identify a firm who possesses the relevant qualifications, experience, personnel, security approvals, equipment, and capability to perform the subject requirement. Items such as the firm’s ability to hire a workforce and key personnel with an expedited solicitation period/phase-in; current proximity to NSA Orlando;
familiarity with NAVFAC Maximo, and ability to keep costs fair and reasonable considering the urgency of the requirement and contract term were taken into consideration. The Contracting Officer reviewed contractors performing the existing agency facility support services contracts in the vicinity of NSA Orlando; as well as contracts issued by other agencies with similar scope and location.
Contractors performing other agency facility support services contracts similar in size, scope and complexity were also reviewed; and the contractors who indicated interest in the competitively awarded contract N69450-24-D-0002 were considered. Following capabilities briefs presented by those firms identified and interested via market research, T&H Solutions LLC, a certified 8(a), HUBZone, and Small Disadvantaged Business, was determined to be the firm in the best position to immediately mobilize and perform the requirement without a gap in essential contract services. T&H Solutions, LLC and/or its affiliates are currently performing multiple MFSS contracts with NAVFAC Southeast as well as relevant MFSS contracts with NAVFAC Mid-Atlantic that aggregately include all of the Orlando MFSS services and demonstrate a depth of past performance at the very good to exceptional level. T&H Solutions, LLC and/or its affiliates are currently performing at nine locations in the state of Florida and Southern Georgia; which allows for faster access to personnel and/or material resources, if necessary; demonstrates an understanding of the local labor market; and demonstrates established subcontractor relationships in the local area, which has historically be a challenge at NSA Orlando. In addition, they demonstrated experience with numerous contracts that required an expedited phase-in period with success and have resources available in their Corporate Office to assist with reach-back support in these scenarios. T&H Solutions, LLC also presented reasonable solutions to proposing fair and reasonable costs considering the urgency of the requirement and contract term. Based upon market research, it is anticipated that award to any other source would result in additional costs and/or unacceptable delays in fulfilling the agency’s critical requirements. Per FAR 5.202(a)(2), due to the urgency of this requirement, the proposed action will not be synopsized on the Government wide Point of Entry (GPE) as a stand-alone contract on a sole source basis to T&H Solutions LLC. Market research was conducted as stated herein which determined award to any other company other than T&H Solutions, LLC is not practicable based on the unusual and compelling urgency of the subject requirement. Delay in contract award to conduct a competitive follow-on procurement would be unacceptable in fulfilling the agency’s critical requirements.
7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government for services covered by this J&A will be fair and reasonable. The Government will use the independent Government estimate, historical data, and/or market data as appropriate to negotiate a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition. Market research for a competitive follow-on procurement will commence immediately with anticipated award in the first quarter of fiscal year 2026. The command will take all reasonable measures to proceed as expeditiously as possible with the competitive follow-on procurement to prevent any additional sole source contract actions. There are currently no further actions required to remove barriers to future competition.
