The deadline date/time for all questions and clarifications is no later than September 3, 2024 at 11:00 AM Eastern Time. This procurement is being solicited in accordance with Federal Acquisition Regulation (FAR) Subpart 19.5 - Small Business programs. See block 10 of the SF1449 for the type of Small Business Set Aside, the North American Industry Classification Code System (NAICS), and the Small Business Size Standard.

(b) Submission of offers. Quoters shall submit the following:

AWARD NOTICE:

A written notice of award or acceptance of a Quote, mailed or otherwise, furnished to the successful Quoter within the time for acceptance specified in the Quote, shall result in a binding contract without further action by either party. Before the Quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

BASIS OF EVALUATION

The Government will award a single contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. Each quote shall be in the form prescribed by, and shall contain a response to, each of the areas identified in the solicitation provision entitled “FAR provision 52.212-1 Addendum, Instructions to Offeror’s—Commercial Products and Commercial Services.” The Government reserves the right to make award solely on initial quotes received.

The Government considers it to be in its best interest to allow consideration of award to the lowest priced technically acceptable Quoter. For evaluation purposes Quoters shall be listed in order of price from lowest to highest. Quoters will be deemed technically acceptable based on the following:

TECHNICAL ACCEPTABILITY:

To be determined technically acceptable, an offeror must submit a proposal that provides delivery and pricing for all items listed in the solicitation. Only quotes that provide for delivery of all items (or acceptable substitutions as noted below) listed in the solicitation will be determined to be technically acceptable.

If any item(s) is/are determined by the vendor to be unavailable for delivery, an acceptable substitute* shall be quoted. A quote that does not provide for delivery of ALL line items, or acceptable substitutes, will be determined to be technically unacceptable and ineligible for award.

* Acceptability of substituted items is at the discretion of the customer.

The Contracting Officer will use the following rating table:

Rating Description

Acceptable Proposal provides pricing and delivery for all items listed in the solicitation, or acceptable substitutes if necessary, and therefore clearly meets the requirements of the solicitation.

Unacceptable Proposal does not provide pricing and delivery for all items listed in the solicitation, or acceptable substitutes, and therefore does not meet the requirements of the solicitation.

PRICE:

Price will be evaluated by totaling the prices for all line items listed in the solicitation.

If any line item(s) is/are removed due to unavailability and unacceptability of substitutes, the Government will confirm the newly calculated price with the lowest priced offeror. Note: if the lowest priced vendor chooses to increase/alter any other pricing contained in their quote, they assume the risk of no longer being the lowest priced offeror, in which case the Government will proceed to award with the new lowest price quote.

CONTRACTOR RESPONSIBILITY:

To be eligible for award, a quoter must be determined by the Contracting Officer to be a responsible prospective contractor under FAR 9.104. To be determined responsible, a quoter must:

(a) Have adequate financial resources to perform the contract, or the ability to obtain them;

(b) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and Governmental business commitments;

(c) Have a satisfactory performance record;

(d) Have a satisfactory record of integrity and business ethics;

(e) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor an subcontractors);

(f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and

(g) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
