GOVERNMENT PRE AWARD INQUIRY FORM

Page Section Para.

1 1/25/22 36 Sec C 3.2

Currently, there is only one disposal location for MSW and C&D in the area (with scales), which is owned by

Waste Management. They have a recent history of changing their contracts midterm and raising tipping fees over 50% with little to no notice. If this happens during the contract can the contractor request equitable adjustment to the contract to account for the raise in fees?

All associated cost and/or projected cost required for completion of the scope of work in the RFP should be included in the offeror's original bid proposal. Any adjustments to the contract price would be handled on a case-by-case basis after award.

2 1/25/22 37 Sec C 3.2.2

Many of the current FEL recycling containers are contaminated to the point where they cannot be recycled. Who pays the disposal fees if they are contaminated since the contractor has no control over what goes into the FEL containers?

The contractor is responsible for paying all fees associated with disposal. Spec Item 3.2.2 has been revised via Amendment 0001 to state that, "The contractor keeps proceeds from recycling and pays all disposal fees including those for contaminated loads."

3 1/25/22 37 Sec C 3.2.2

Who pays for the disposal if the recycling roll-offs are contaminated? Currently the contractor keeps the proceeds and the contamination potential/fees are offset by keeping the proceeds. Would the Government please consider letting the contractor keep the proceeds?

Otherwise how does the contractor recoup disposal from contamination on a FFP bid?

See Government Response to GPI #2.

4 1/25/22 37 Sec C 3.2.2

If the above is "no", How does the contractor return the money to the Government, i.e what is the process?

What recyclables generate money? Who is responsible for marketing, transferring money to the Government, educating the public etc.?

N/A, see Government Response to GPI #2.

Will the Government please specify what type of recycling material goes into each container?

In accordance with Spec Item 3.1.2.2, all containers are mixed recycling stream. Recycling stream consists of white/mixed paper, cardboard, aluminum and plastic.

Currently there are some containers that have concrete in them and are very heavy. Who pays for those disposal fees?

Construction training is part of the Installation mission and the resulting construction debris is part of the contract and the responsibility of the contractor to dispose. The contractor is responsible to dispose of all material placed in ‘on call’ roll offs, to include concrete and construction debris. The Government may also order additional containers via the non-recurring work

ELINS to dispose of concrete and construction debris for tenant commands and for quantities in excess of those specified in Section J Attachment J-1503030-05.

The Government lists 20, 30 and 40 CY annual hauls as

8, 250 and 100 respectively, and there are also more roll offs required from previous ISWM bids on this contract. This number doesn’t include recycling and needs to be increased. Can the Government please correct?
