The work to be performed under this contract consists of the application of herbicides for vegetation control Sea Ray Target Range shall comprise of 420 acres for application of herbicides for vegetation control. This location work shall be accomplished between the months of March - May 2020.

The herbicide vegetation mix shall be in compliant with Federal and state guidelines for aquatic and wooded areas. All application mixes and application shall be in accordance with manufacture instructions.

Section C - Descriptions and Specifications

STATEMENT OF WORK

PROJECT TITLE: Aerial Spraying

1. GENERAL DESCRIPTION

Aerial spraying for vegetation control at Sea Ray Target Range at Shugualak, MS (420 acres).

2. LOCATION

The work shall be located at Sea Ray Target Range at Shugualak, MS. The Contracting Officer will indicate the exact location.

3. MINOR MATERIALS AND WORK

Minor materials and work not specifically mentioned herein but necessary for the proper completion of the specified work shall be furnished without additional cost to the Government.

4. EXISTING WORK

The altering in any way of existing work shall be carried on in such a manner as to prevent injury or damage to any portion of the existing work that remains. Existing work to remain, if damaged during construction operations, is the responsibility of the Contractor and shall be repaired or replaced in kind and in a manner to match existing or adjoining work, as approved by the Contracting Officer.

If unforeseen deteriorated material of a major nature is uncovered in the course of the work, do not disturb, immediately notify the Contracting Officer.

5. WORK SCHEDULE

Work on the airfield shall be conducted when the airfield is closed generally Friday 2300 – Sunday 1400.

Coordinate hours of operation with Contracting Officer for all airfield work a minimum of 15 days ahead of work timeframe.

Work outside regular working hours requires Contracting Officer approval. Approval will be granted if working outside regular working hours is determined to be in the best interest of the government. Make application 3 days prior to such work to allow arrangement to be made by the Government for inspecting the work in progress.

6. FAR 5252.236-14: AVAILABILITY OF UTILITIES

(a) The Government shall make all reasonably required amounts of utilities available to the Contractor from existing outlets and supplies, as specified in the contract. Unless otherwise provided in the contract, the amount of each utility service consumed shall be charged to or paid for by the Contractor at prevailing rates charged to the Government or, where the utility is produced by the Government, at reasonable rates determined by the Contracting Officer. The Contractor shall carefully conserve any utilities furnished without charge.

(b) The Contractor, at its expense and in a workmanlike manner satisfactory to the Contracting Officer, shall install and maintain all necessary temporary connections and distribution lines, and all meters required to measure the amount of each utility used for the purpose of determining charges. Before final acceptance of the work by the Government, the Contractor shall remove all the temporary connections, distribution lines, meters, and associated paraphernalia.

7. CONSTRUCTION SCHEDULE

Within 15 days after receipt of the Notice of Award, prepare and submit to the Contracting Officer for approval a construction schedule in the form of a progress chart.

8. SUBMITTAL PROCEDURES

Submit 4 copies of shop drawings, product data, samples, and administrative submittals presented for review and approval. One copy will be returned to the contractor, three will be retained for government use. Contract Clauses "FAR 52.236-5, Material and Workmanship," paragraph (b) and "FAR 52.236-21, Specifications and Drawings for Construction," paragraphs (d), (e), and (f) apply to all "submittals."

Except as specified otherwise, allow a review period, beginning with receipt by the approving authority, that includes at least 20 working days for Contracting Officer approval. The period of review for submittals with Contracting Officer approval begins when the Government receives the submittal from the Contractor. The period of review for each re-submittal is the same as for the initial submittal.

Variations from contract requirements and will be considered where advantageous to the Government when proposing a variation:

a. Always submit the required submittal for the item specified in the contract.

b. Submit a written request to the Contracting Officer identifying the proposed variation separately. Include documentation of why the variation is desirable and beneficial to the Government. If lower cost is a benefit, also include an estimate of the cost saving.

c. When submitting a variation for approval, the Contractor warrants the Contract has been reviewed to establish that the variation, if incorporated, will be compatible with other elements of the work. In addition to the normal submittal review period, a period of 10 working days will be allowed for consideration by the Government of submittals with variations

d. Determine and verify field measurements, materials, field construction criteria; review each submittal;

and check and coordinate each submittal with requirements of the work and Contract documents.

e. Ensure no work has begun until submittals for that work have been returned as "approved," or "approved as noted”.

9. SUBMISSION OF OPERATION AND MAINTENANCE DATA

None Required.

10. QUALITY CONTROL

a. The contractor is responsible for the quality of the work performed. A quality control report is required for each day that work is performed and for every seven consecutive calendar days of no-work and on the last day of a no-work period. Account for each calendar day throughout the life of the Contract. The reporting of work shall be identified by terminology consistent with the construction schedule. Contractor Quality Control Reports are to be prepared, signed and dated by the QC Manager appointed by the contractor.

b. Provide level 3 Safety and Health Officer (SSHO) at the work site at all times to perform safety and occupational health management, surveillance, inspections, and safety enforcement for the Contractor. The utilization of the Contractor Quality Control (QC) Person as the SSHO for this shall be coordinated.

* Requirements Level 1 SSHO:

(1). Worked on similar Projects.

(2). 10- hours OSHA construction safety class or equivalent within last 3 years.

(3). Competent person training as needed.

11. FAR 5252.236-14: ACCIDENT PREVENTION

a. The Contractor shall provide and maintain work environments and procedures which will—

(1) Safeguard the public and Government personnel, property, materials, supplies, and equipment exposed to Contractor operations and activities;

(2) Avoid interruptions of Government operations and delays in project completion dates; and

(3) Control costs in the performance of this contract.

b. For these purposes on contracts for construction or dismantling, demolition, or removal of improvements, the Contractor shall—

(1) Provide appropriate safety barricades, signs, and signal lights;

(2) Comply with the standards issued by the Secretary of Labor at 29 CFR Part 1926 and 29 CFR Part 1910; and

(3) Ensure that any additional measures the Contracting Officer determines to be reasonably necessary for the purposes are taken.

c. If this contract is for construction or dismantling, demolition or removal of improvements with any Department of Defense agency or component, the Contractor shall comply with all pertinent provisions of the latest version of U.S.

Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, in effect on the date of the solicitation.

d. Whenever the Contracting Officer becomes aware of any noncompliance with these requirements or any condition which poses a serious or imminent danger to the health or safety of the public or Government personnel, the Contracting Officer shall notify the Contractor orally, with written confirmation, and request immediate initiation of corrective action. This notice, when delivered to the Contractor or the Contractor’s representative at the work site, shall be deemed sufficient notice of the noncompliance and that corrective action is required. After receiving the notice, the Contractor shall immediately take corrective action. If the Contractor fails or refuses to promptly take corrective action, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. The Contractor shall not be entitled to any equitable adjustment of the contract price or extension of the performance schedule on any stop work order issued under this clause.

e. The Contractor shall insert this clause, including this paragraph (e), with appropriate changes in the designation of the parties, in subcontracts.

The clause, FAC 5252.236-13, ACCIDENT PREVENTION, is hereby amended as follows:

a. Prior to commencement of work the Contractor shall be required to submit in writing a plan consisting of:

1). An index of hazardous materials to be introduced to the site.

2). A plan for protecting personnel and property during the transport, storage and use of the materials.

3). A list of hazardous waste which may be generated and waste management procedures coinciding with the below listed clause, “Waste Management”.

4). Procedures for spill response and disposal.

5). A copy of all MSDS, Material Safety Data Sheets for hazardous materials listed in the index of the plan along with anticipated quantities by container size. Post a copy of all Material Safety Data Sheets at the work site where the products will be used.

6). Approved labeling system to identify contents on all containers on site.

7). Personnel training plan.

8). Monthly, the Contractor shall provide the Contracting Officer with the maximum quantity of each material that was present and the amount of each material that was used during the project

9). ALL hazardous material must receive approval prior to bringing onto the job site.

12. WASTE MANAGEMENT

Comply with all Federal, State, and Local regulations to include but not limited to the following:

a. Hazardous Solid Waste. All waste generated that meets the definition of hazardous waste, must be handled, accumulated, stored, moved and disposed of in accordance with RCRA regulations for Large Quantity Generators (LQG). In accordance with the NAS Meridian Hazardous Waste Management Plan all hazardous waste shall be accumulated, in contractor supplied containers at approved accumulation sites. When containers are full or when work is complete the contractor will transfer accumulated waste, fill records, and Material Safety Data Sheets (MSDS) to the NAS Meridian’s less than 90 day storage area for disposal.

b. Non-Hazardous Solid Waste. All non-hazardous waste must be disposed of in regulated landfills in accordance with RCRA regulations. Copies of tipping documents shall be provided to the contract manager/ROICC for accountability and reporting purposes.

c. Training. Personnel handling hazardous waste must have all requisite training required by RCRA, OSHA, and DOT regulations. Training Records must be available for review.

d. Hazardous Material Control. The contractor shall include hazardous material control procedures in the Safety Plan. The procedures shall address and ensure the proper handling of hazardous materials, including the appropriate transportation requirements. The Contractor shall submit a MSDS and estimated quantities to be used for each hazardous material to the Contracting Officer prior to bringing the material on base. Typical materials requiring MSDS and quantity reporting include, but not limited to, oil and latex based painting and caulking products, solvents, adhesives, aerosol, and petroleum products. At the end of the project and monthly, the Contractor shall provide the Contracting Officer with the maximum quantity of each material that was present at the site at any time, the dates the material was present, the amount of each material that was used during the project and how the material was used.

The Contractor shall also ensure that hazardous materials are utilized in a manner that will minimize the amount of hazardous waste that is generated. The Contractor shall ensure that all containers of hazardous material have NFPA labels or their equivalent. Copies of the MSDS for hazardous materials shall be kept on site at all times and provided to the Contracting Officer at the end of the project. The Contractor shall certify that all hazardous materials removed from the site are hazardous materials and do not meet the definition of hazardous waste per 40 CFR 261.

13. WARRANTY

See paragraph 23a for details.

14. DISPOSITION OF REMOVED MATERIALS

Except where specifically specified otherwise herein, all salvable materials disconnected or removed during the course of the work and not specified for reuse in the new work shall become the property of the Contractor and shall be removed from Government property.

All trash, debris and unusable materials shall be cleaned up at the end of each workday and disposed of by removing completely from government property.

15. REGULATIONS

Contractor personnel employed on the Station shall become familiar with and obey Station regulations, shall keep within the limits of the work (and avenues of ingress and egress), and shall not enter any restricted areas unless required to do so and are cleared for such entry. Contractor equipment shall be conspicuously marked for identification.

All application mixes and application shall be in accordance with manufacture instructions.

Also, any adjuvant and surfactant needed to increase effectiveness shall be added to the herbicide. Contractor shall furnish all labor, supervision, tools, materials, equipment, and transportation necessary to perform the site preparation work as identified.

When it is determined by the Contracting Officer that the original areas, or portions thereof, are unsuitable or unavailable for performance of the specified work, the Contracting Officer reserves the right to delete areas or to substitute, at the contract price, the same type and amount of work (+/- 10%) in other areas similar in topography and conditions within NAS Meridian.

a. Aerial Site Preparation . Contractor shall have a result of at least 85% kill rate on all vegetation no matter what herbicide combination is used. Contractor shall conduct any necessary kill rate until accepted by government (PWD). The aerial spraying will be with a helicopter and all flight requirements will be coordinated with Naval Air Stations Meridian’s Air Operations. Application operations shall not be started or continued if wind is in excess of 5 MPH, or if rain is expected within 2 hours.

b. Quality Assurance Evaluator (QAE). The Government employees designated to monitor contractor performance for this job is PWD FEAD.

22b. Water is limited at Sea Ray Target Range. A residential type (garden hose) from a well water source is available. Contractor shall provide all necessary supplemental equipment, material and labor for water for this location.

22c. All equipment to be used in performance of the vegetation control preparation shall be approved by the Contracting Officer prior to the commencement of work.

b) Radio Communications. Communications will be required at all sites being worked (such as CB or cellular phone).

22d. The contractor shall submit a list of the types, application rate, and total quantities of herbicides and surfactant to be used in the tank mix as part of the bid. Labels and Material Safety Data Sheets for the herbicide and surfactant shall be submitted within 15 days after bid acceptance. A minimum of 85% control of all brush and other woody vegetation is required and retreatment may be necessary to achieve this requirement. The contractor shall also complete the attached report covering the types, application rate, and total quantities of herbicides used and submit it as part of the invoice.

In addition where uniform cleaning and maintenance is made the responsibility of the employee all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount or the furnishing of contrary affirmative proof as to the actual cost) reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However in those instances where the uniforms furnished are made of ""wash and wear"" materials may be routinely washed and dried with other personal garments and do not require any special treatment such as dry cleaning daily washing or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract by the contractor by law or by the nature of the work there is no requirement that employees be reimbursed for uniform maintenance costs.

** SERVICE CONTRACT ACT DIRECTORY OF OCCUPATIONS **

The duties of employees under job titles listed are those described in the ""Service Contract Act Directory of Occupations"" Fifth Edition (Revision 1) dated September 2015 unless otherwise indicated.

REQUEST FOR AUTHORIZATION OF ADDITIONAL CLASSIFICATION AND WAGE RATE

Standard Form 1444 (SF‐1444)

Conformance Process:

The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e. the work to be performed is not performed by any classification listed in the wage determination) be classified by the contractor so as to provide a reasonable relationship (i.e. appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined (See 29 CFR 4.6(b)(2)(i)). Such conforming procedures shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees (See 29 CFR 4.6(b)(2)(ii)). The Wage and Hour Division shall make a final determination of conformed classification wage rate and/or fringe benefits which shall be retroactive to the commencement date of the contract (See 29 CFR 4.6(b)(2)(iv)(C)(vi)). When multiple wage determinations are included in a contract a separate SF‐1444 should be prepared for each wage determination to which a class(es) is to be conformed.

The process for preparing a conformance request is as follows:

1) When preparing the bid the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).

2) After contract award the contractor prepares a written report listing in order the proposed classification title(s) a Federal grade equivalency (FGE) for each proposed classification(s) job description(s) and rationale for proposed wage rate(s) including information regarding the agreement or disagreement of the authorized representative of the employees involved or where there is no authorized representative the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.

3) The contracting officer reviews the proposed action and promptly submits a report of the action together with the agency's recommendations and pertinent information including the position of the contractor and the employees to the Wage and Hour Division U.S. Department of Labor for review (See 29 CFR 4.6(b)(2)(ii)).

4) Within 30 days of receipt the Wage and Hour Division approves modifies or disapproves the action via transmittal to the agency contracting officer or notifies the contracting officer that additional time will be required to process the request.

5) The contracting officer transmits the Wage and Hour decision to the contractor.

6) The contractor informs the affected employees.

Information required by the Regulations must be submitted on SF‐1444 or bond paper.

When preparing a conformance request the ""Service Contract Act Directory of Occupations"" (the Directory) should be used to compare job definitions to ensure that duties requested are not performed by a classification already listed in the wage determination. Remember it is not the job title but the required tasks that determine whether a class is included in an established wage determination.

Conformances may not be used to artificially split combine or subdivide classifications listed in the wage determination.

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (DEC 2018)

(a) Definitions. As used in this clause—

“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.

“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.

“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall—

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor must use the following information when submitting payment requests and receiving reports in WAWF for this contract/order: TBD

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights--

(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

(f) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience.
