I. INTRODUCTION

A. (intentionally left blank)

B. DESCRIPTION OF ACQUISTION

1. This acquisition will result in the award of a Firm-Fixed Price (FFP) Design-Bid-Build (DBB) contract for construction.

2. This project is for the repairs and improvements to the Poseidon Wharf Naval Ordnance Test Unit (NOTU) at Cape Canaveral Air Force Station (CCAFS), Florida (FL) as follows;

demolition of the wharf deck down to the piles caps; installation of new precast concrete piles and new wharf deck consisting of concrete deck panels and concrete toping; repair to structural components including deteriorated concrete pile caps, piling, superstructure, and appurtenances; placement of concrete filled fiberglass reinforced plastic (FRP) jackets with passive cathodic protection (CP); and repairs to existing mechanical and electrical systems.

a. Additional considerations: The project will be phased construction with no more than one half of the wharf available for construction activities. Waterways and adjacent facilities will remain operational during construction. The project requires coordination, and detailed scheduling. Material laydown areas are limited and a detailed logistics plan will be required.

3. In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 236.204, the Government’s cost estimate for this work is between $10,000,000 and $25,000,000 for CLIN 0001 and CLIN 0002, combined.

4. The Government intends to award a contract resulting from this solicitation to the responsible offeror with the lowest price technically acceptable proposal based on the evaluation factors in the solicitation, as outlined in Section III.

5. This acquisition will be solicited on an unrestricted basis with full and open competition.

II. (intentionally left blank)

III. Evaluation

A. Basis for Award

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest priced, technically acceptable offer.

2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.”

3. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated.

4. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

B. (intentionally left blank)

C. (intentionally left blank)

4. Demolition of concrete pile caps, bents, and/or deck of an overwater pier or wharf. (Construction Value of $2M or greater if presented as a standalone project)

Proposed relevant projects must have been performed under a single task order or standalone contract by the prime contractor. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole should not be submitted as a project; rather Offerors should submit the work performed under a single task order.

The attached Construction & Design Experience Project Data Sheet (Attachment D) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).

For all submitted projects, the description of the project shall clearly describe the scope of work performed and how it meets the definition of a relevant project, or the critical elements indicated above.

(b) Basis of Evaluation:

The basis of evaluation will include the Offeror’s demonstrated experience in performing relevant construction projects as defined above. The assessment of the Offeror’s relevant construction experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of this RFP. The Government will only review five (5) projects to evaluate construction experience. Any projects submitted in excess of the five (5) will not be considered.

2) Factor 2 - TECHNICAL SOLUTION:

i. Provide a narrative describing the technical solution to safely and successfully completing the project within the requirements of the RFP.

This schedule shall include key milestones and activities, including submittals, procurement, major construction items, quality control and testing and work requirements as specified in specification section 01 14

00.00 25. The schedule shall consider potential work stoppage and possible delays as described in specification section 01 14 00.00 25 along with work requirements contained on sheets G-003, and G-101. The awardees proposed schedule will become the basis for initial schedule submission as outlined in specification section 01 32 17.00 25.

The Government will evaluate the narrative(s), drawings (if included), and schedule to determine the extent to which the Offeror demonstrates a clear understanding of the requirements of the project. The Government will evaluate the effectiveness of the technical solution to determine the likelihood that the work will be performed in accordance with the requirements of the RFP.

(3) Factor 3 – SAFETY:

The Offeror shall submit the following information: (For a partnership or joint venture, the following submittal requirements are required for each contractor who is part of the partnership or joint venture; however, only one safety narrative is required. EMR, DART and TRC Rates shall not be submitted for subcontractors.)

(1) Experience Modification Rate (EMR):

Include three previous complete calendar years’ worth of data. This rate compares company’s annual losses in insurance claims against its policy premiums. The offeror may submit an insurance company-provided equivalent rate if no EMR exists. If the offeror has no EMR or premium, for any year, affirmatively state so and explain why.

Any extenuating circumstances that affect the EMR and negative trends should be addressed as part of the factor submission.

(2) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate and Total Recordable Case (TRC) Rate:

Submit three previous complete calendar years’ worth of data. If an offeror cannot submit an OSHA DART and TRC rates, for any year, affirmatively state so and an explanation must be provided. Any extenuating circumstances that affected the OSHA, DART, and TRC rate data negatively must be addressed as part of this factor submission.

(3) Technical Approach for Safety:

Describe the plan for safety that will be implemented to evaluate safety performance of potential subcontractors as part of the selection process for all levels of subcontractors. The offeror shall submit a narrative that fully describes the following:

i. The safety management system that they will use to oversee the safety compliance and performance of self-performed and subcontractor performed work;

ii. Any innovative methods that will be employed to ensure and monitor safe work practices at self-performed and/or all subcontractor levels;

iii. Methodology to execute an effective program that facilitates sound mishap prevention techniques and processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps.

The technical approach to safety narrative shall be limited to two pages.

The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for its self-performed work and the work of its sub-contractors. The Government will evaluate the Offeror’s overall safety management system, safety performance record, and the Offeror’s methodology of qualifying, evaluating, selecting and overseeing its subcontractors. The Government’s sources of information for evaluating safety will include, but are not limited to:

OSHA, NAVFAC’s Enterprise Safety Applications Management System (ESAMS) database, NAVFAC’s Contractor Incident Reporting System (CIRS), Contractor Performance Assessment Reporting System (CPARS), and other related databases. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the Offeror. The Government will evaluate the narrative to determine the degree to which subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project and the specific management practices that will be in place for providing deliberate safety program management and mishap prevention support.

Offeror’s Experience Modification Rates (EMR) will be evaluated against the following Navy standards:

Risk EMR Very Low Risk Less than 0.6 Low Risk From 0.6 to less than 0.8 Moderate Risk From 0.8 to 1.0 High Risk Greater than 1.0 to 1.1 Extremely High Risk Greater than 1.1

Offeror’s DART and TRC rates will be evaluated against the following Navy standards:

(4) Factor 4 – PAST PERFORMANCE:

If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 1 - Experience. If there is not a completed CPARS evaluation, then submit Past Performance Questionnaires (Attachment F) for each project included in Factor 1. The Offeror should provide completed Past Performance Questionnaires (PPQ) in the proposal. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Ms. LaCorsha Noel at Lacorsha.Noel@navy.mil.

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 – Experience. Offerors may also address any adverse past performance issues.

Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.

The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.

Performance award or additional information submitted will not be considered.

A copy of the blank Past Performance Questionnaire to be used for requesting client references is included as Attachment D.

This evaluation focuses on how well the Offeror performed on projects under Factor 1 – Experience and other past performance on other projects currently document in known sources. More emphasis will be placed on projects and task orders that are more similar to the RFP. In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror.

The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s past performance will be used as a means of evaluating the Offeror’s ability to successfully meet the requirements of the RFP.

In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

(ii) Otherwise successful offers from small business concerns.

(2) The factor of 10 percent shall be applied on a line item basis or to any group of items on which award may be made. Other evaluation factors described in the solicitation shall be applied before application of the factor.

(3) When the two highest rated offerors are a HUBZone small business concern and a large business, and the evaluated offer of the HUBZone small business concern is equal to the evaluated offer of the large business after considering the price evaluation preference, award will be made to the HUBZone small business concern.

(c) Waiver of evaluation preference. A HUBZone small business concern may elect to waive the evaluation preference, in which case the factor will be added to its offer for evaluation purposes. The agreements in paragraphs

(d) and (e) of this clause do not apply if the offeror has waived the evaluation preference.

___ Offeror elects to waive the evaluation preference.

(d) Agreement. A HUBZone small business concern agrees that in the performance of the contract, in the case of a contract for

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of FAR clause 52.225-11 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic or designated country construction material, and the offeror shall be required to furnish such domestic or designated country construction material.
