The requiring Agency/Contracting Activity: Department of the Navy, Naval Facilities Engineering Command, Southeast. Description of Action: Follow-on effort to Task Order N6247013-D-

6019/N6247017F4053 & N6945017F0076. Description of Supplies or Services: The estimated value of the proposed action is Not-To-Exceed (NTE) $25,000,000.00.

The initial task order was procured competitively. The solicitation was issued to all four Global Contingency Construction Contract Multiple Award Contractor (GCCC) awardees of the Indefinite Delivery Indefinite Quantity (IDIQ) instrument, and CH2M Hill Constructors, Inc. (CH2M) 9189 S.

Jamaica St, Englewood, CO 80112 was selected as the successful offeror - Contract/Task Order

– N62470-13-D-6019/N6247017F4053 dated 25 August 2017. The request for proposal contained specific language notifying all offerors that following this task order, the contractor may be issued a modification or separate task order to mobilize the planning management team to the disaster site and begin recovery efforts. The initial task order required a three person planning management team, located at the contractor’s facility, to provide planning support to NAVFAC SE Operations and Contingency Engineering Staff to plan for recovery work associated with disaster recovery operations at Naval Air Station (NAS) Kingsville and NAS Corpus Christi due to Hurricane Harvey. The management team discussed the damage assessment conducted by NAVFAC SE and provided recommendations on the approach to repair effort, resource needed and likely restrictions to courses of actions identified. The immediate follow-on Cost Plus Award Fee Task Order - N62470-13-D-6019/N6945017F0076, dated 28 August 2017, was awarded to CH2M. This task order provides for the planning and repair of damaged facilities and equipment affected by Hurricane Harvey at NAS Kingsville, TX and NAS Corpus Christi, TX, and other outlying fields and support centers. The contractor deployed a planning management team to NAS Corpus Christi to work with NAVFAC SE Operations and Contingency Engineering staff to plan and execute the recovery work associated with disaster recovery operations. Immediately following this coordination, the Contractor began stabilization and repair efforts, as directed.

Repairs included, but are not limited to: Stabilization of damaged facilities, immediate repair of facilities, joint scoping (Government and Contractor) in a design/build environment to achieve normal mission operation. The number of individual facilities requiring repair and the extent of required repairs has just recently become known. The situation remains an unusual and compelling requirement but, the Government has a more thorough understanding of the damage through the process of joint planning, stabilization completion, and on-going repairs. The Government Damage Assessment Team and combined Government and Contractor Estimating/Planning Team identified 149 separate facilities needing repairs with an estimated value of $90,000,000.00. The $25,000,000.00 figure covered by this justification for authorization purposes is specifically aligned to the most mission critical, Priority 1 designated facilities. Priority 1 initial stabilization/repair involves eliminating moisture penetration to the interior of facilities from the exterior environment, removal and disposal of all damaged building material from the interiors (including but not limited to drywall, carpet, and ceiling tile), dry out all remaining building interior materials including, but not limited to, salvageable carpet, walls, and fixtures, dehumidify the interior atmosphere in order to prevent mold and bacterial growth and mold remediation in accordance with UFGS 02 85 00. Authority: The appropriate authority for this action is found in Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(A) - The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays, and FAR 16.505((b)(2)(i) (C) - The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. Rationale: The appropriate authority for this action is Federal Acquisition Regulations (FAR) Subsection 16.505(b)(2)(i)(A) and (C) allows for exception to fair opportunity in circumstances where (A) the agency needs are so urgent that providing a fair opportunity would result in unacceptable delays and (C) an order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. The GCC MAC is the precise NAVFAC acquisition vehicle designated for critical response during an emergency and primarily supports aid for natural disasters, military conflict or humanitarian relief. Early mobilization and start up construction is the utmost goal of the instrument. The contract allows for the potentially massive logistics of moving people, materials, and equipment for numerous and simultaneous projects and work sites requiring flexibility and extensive management and coordination. The contractors are required to work very closely and in detail with Navy procurement, planning and engineering program officials. The goals and planned actions may be developed through contractor and government iterative discussion and analysis. The contract is not meant to eliminate all other construction procurements surrounding a situation, but is to provide a critical action response and continued momentum in providing recovery or support. Pursuant to FAR Subsection 16.505(b)(2)(i)(C), recovery efforts will be directed on a sole-source basis as a combination of unusual and compelling urgency, logical follow-on and in the interest of economy and efficiency. The nature of the requirement is such that it is considered integral and supplemental to each phase of the disaster recovery (planning, stabilization, and repair). FAR 6.302-2 Unusual and Compelling Urgency is the overlying premise of the sole-source justification. The continuing work is a natural progression of the work now under contract – logical follow. The original task order was competed to provide for planning efforts for Hurricane Harvey recovery for NAS Kingsville and NAS Corpus Christi along with the outlying fields and support centers. Elements of FAR 6.302-2 Unusual and Compelling Urgency, 10 U.S.C. 2304 (c)(2) were considered in combination with FAR 16.505(b)(2)(i)(C), cited above. The agency’s need for the service is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits proposals. Delay in the award of other contracts would cause serious injury, financial or other to the Government. The facilities covered by this justification are in direct support of military readiness and mission capability.

Significant storm damage was realized as a result of hurricane Harvey. Facility deterioration is compounded for everyday stabilization and repairs are not done. Routine weather events exponentially further damages to the exposed facilities without a rapid response. Failure to immediately begin disaster recovery, via unusual and compelling urgency and a logical follow-on order, would have resulted in extended operational down time and additional cost to the activity.

The contracting officer will use a combination of cost and price techniques to determine that the anticipated price for this contract action will be fair and reasonable. Certified Cost and Pricing Data will be obtained as required. There have been no other logical follow-on orders associated with the Hurricane Harvey south Texas recovery effort. Further, the President of the United States declared the area of South Texas a national emergency. Naval Air Station Corpus Christi, TX supports the direct training of all Navy, USMC, USCG and allied aviators under the Chief of Naval Air Training (CNATRA) headquartered there. Additionally, P-3 Orion and Dauphine helicopters operate from NAS Corpus Christi flown by U.S. Customs and Border Protection Service and the U.S. Coast Guard. The largest tenant command at NAS Corpus Christi is the Corpus Christi Army Depot (CCAD). The CCAD is the Army’s largest industrial helicopter repair, overhaul and maintenance center. In all, there are more than 50 tenant commands and activities located on board the station. These activities are crucial to the nation’s defense. Small Business Coordination has been executed between SBA PCR and NAVFAC SE ACQ/Small Business Office. Actions to increase competition: As indicated above, the total damage estimate was approximately $90,000, 000.00, of which $25,000,000.00 is expected to be completed through this Task Order for stabilization and urgent, mission critical facility Priority 1 repairs. For Priority 1 repairs, the GCCC contractor is required to obtain competitive pricing from subcontractors. Many non-GCCC contracting instruments have been utilized to date to effect stabilization and repairs in addition to those completed using the GCCC. NAVFAC will take appropriate actions that promote competition and small business goals that are in the best interests of the agency, stakeholders, and expenditure of tax payer dollars.
