DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEEERING COMMAND SOUTHEAST
JACKSONVILLE, FL 32212-0030
J&A No. N69450-19-0286
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The Agency is the Department of the Navy. The contracting activity is Naval Facilities Engineering Command Southeast (NAVFAC SE), Jacksonville, FL.
2. Description of Action Being Approved.
This justification requests approval to extend the contract completion date of the Texas, Louisiana, and Mississippi Medium Multiple Award Construction Contract (MACC) an additional 6 months, from March 11, 2019 to September 10, 2019. Military construction project P5000, Consolidated Communications Facility at Barksdale AFB, was programmed for this MACC and solicited on January 2017 under solicitation N69450-17-R-1601. It was anticipated that this project would be awarded in September 2017. However, bids exceeded budgetary resources, thus delaying the contract award date. Reprogramming of the project is currently underway but is not anticipated to be approved by the expiration date of this MACC, on March 11, 2019.
3. Description of Supplies/Services.
NAVFAC SE procured a Design-Build (DB), Indefinite Delivery Indefinite Quantity (IDIQ), Firm-Fixed Price MACC for the TX, LA, and MS area providing design and construction services to include labor, supervision, tools, materials and equipment, new construction, renovation, alteration and repair of facilities and infrastructure, roofing, demolition and routine renovations within the specified area.
Master MACC N69450-12-D-1759 was solicited as a Small Business Set-Aside. It was awarded September 12, 2013 comprising the following seven IDIQ contracts:
Komada, LLC (N69450-13-D-1767) Kisaq, LLC (N69450-13-D-1768) K-W Construction (N69450-13-D-1769) Ikhana, LLC (N69450-13-D-1770) Bristol General Contractors, LLC (N69450-13-D-1771) LNV, Inc. (N69450-13-D-1774) Engineering Design Technologies (N69450-13-D-1764)
The MACC has a base year period and four one-year option periods, with an overall contract completion date of September 11, 2018. Justification and Approval number N69450-18-0264 was approved September 4, 2018 for the purpose of extending the period of performance by six additional months, from September 11, 2018 to March 11, 2019, in order to accommodate the award of P5000 which was procured under this MACC, but required reprogramming.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(2), as implemented by FAR 6.302-2 – Unusual and Compelling Urgency.
5. Rationale Justifying use of Cited Statutory Authority.
No other courses of action will satisfy the requirement or be in the best interest of the Government in accordance with FAR 6.302-2 (b)(2), where delay in award of this project would result in serious injury, financial or other, to the Government.
The required services are for Military Construction project P5000, Consolidated Communications Facility at Barksdale AFB, with an estimated value of $26,000,000. This project is to construct an adequately sized and properly configured facility to house all the functions of the 2nd Communications Squadron. As part of the consolidation effort, the Command Post and Crisis Action Team will also be located in this facility. This consolidation will provide the security of these two offices, as well as supporting their large communications requirements. The existing facilities currently provide telephone and computer network service to over 7000 users. These users include the new Air Force Global Strike Command (AFGSC) Headquarters. AFGSC is responsible for our nation’s intercontinental missile wings and the entire Air Force’s bomber force. If this project is not awarded, mission critical command and control (C2) communications which include Defense Red Switch Network (DRSN), Joint Worldwide Intelligence Communications system (JWICS), Worldwide Secret Internet Protocol Router Network and Local Secret Internet Protocol Router Networks, will continue to be subjected to an unacceptable risk for mission degradation due to substandard force protection and limited flexibility for future growth and expansion. This translates into a limited information assurance posture and the inability to operate and maintain critical C2 assets. These units provide direct support to the Nuclear Deterrence mission of the United States and the Air Force.
The award of this Military Construction project is critical, and it has already been delayed six months for reprogramming. Reprogramming funds have now been identified to award this task order under this MACC. Contractor bids will be extended to allow sufficient time for the additional required funds to be reprogrammed. Cancelling the current solicitation and re-competing under a different contract vehicle would cause unnecessary delays, and have severe mission impacts, as the Air Force Global Strike Command (AFGSC) would continue to operate with an unacceptable risk for communications interruptions due to partially substandard force protection.
6. Description of Efforts Made to Solicit Offers from as many Offerors as Practicable.
The project will continue to be competed among the seven TX, MS, and LA MACC contractors.
In accordance with FAR 6.305, the approved J&A will be posted on FEDBIZOPS within 30 days after award of the contract modification extending the period of performance.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
A new medium MACC (IDIQ) with a not-to-exceed amount of $99,000,000 was awarded September 26, 2018. New projects that meet the requirements based on scope, location, and dollar value will be competed among the new MACC contractors.
