MEMORANDUM TO THE FILE

Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION BRAND NAME

JUSTIFICATION

I. BACKGROUND:

KABA Enterprise Hospitality Application System is the only electronic hospitality locking system accredited by U.S. Fleet Cyber Command for this application. EMASS # 12354 applies. No other brands may be procured. EHAS-KABA is the CNIC enterprise solution for all Unaccompanied Housing locking systems. The CNIC FY21 Operations Plan (dated October 2020) designated KABA ILCO (Atlas or FDU) as the enterprise solution for Unaccompanied Housing (UH) e-Lock Systems because it has an Authority to Operate for Electronic Locking Systems.

The UH Facilities Criteria mandates that "new and replacement electronic lock systems shall be stand-alone, not connected to any information network" and that "procurement of networked electronic lock systems is prohibited." There are no other known RFID locking systems available in the marketplace today that allow for the programming of keycards without access to a computer. KABA does not require network access and is a true stand-alone system. Pursuant to CNIC Installation Standards, Installations using other locking systems are required to transition to the approved systems. Based on the cited references herein along with the rigid Navy UH locks specifications in place, no other locking system can satisfy this government need and no substitutes are acceptable. A new system would result .in a substantial duplication of cost to the Government that is not expected to be recovered through competition.

II. DESCRIPTION OF ITEM OR SERVICE:

Item/Service Required: Radio Frequency Identification KABA ILSO e-Lock System to be used on Buildings 3907 and 3908 (all rooms, closets, janitor closets, offices, lounges, laundry rooms, entryways, and storage rooms). Brand name required is Dormakaba which is required under Facilities Criteria for Navy and Marine Corps Unaccompanied Housing (UH) FC 4-721-10N (dated 1 November 2012, change 6, 20 March 2015). Delivery Date required is June 2024 but the POC stated in email that it is not a mission critical drop dead date as the requirement is allowed 120 by contracting. Vendor shall provide all labor, materials/locks and equipment necessary to remove and replace existing locks with new CNIC designated electronic locks that meet the brand name salient characteristics contained herein.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS

BASED ON THE FOLLOWING:

A. X ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

BRAND NAME SOLE SOURCE, is applicable, and Part A, ONLY ONE RESPONSIBLE SOURCE, should be left blank).

B. 3. _X__ OTHER REASONS. The CNIC FY21 Operations Plan (dated October 2020) designated KABA ILCO (Atlas or FDU) as the enterprise solution for Unaccompanied Housing (UH) e-Lock Systems because it has an Authority to Operate for Electronic Locking Systems.

C. X BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer. KABA Enterprise Hospitality Application System is the only electronic hospitality locking system accredited by U.S. Fleet Cyber Command for this application. EMASS # 12354 applies. No other brands may be procured. EHAS-KABA is the CNIC enterprise solution for all Unaccompanied Housing locking systems. The CNIC FY21 Operations Plan (dated October 2020) designated KABA ILCO (Atlas or FDU) as the enterprise solution for Unaccompanied Housing (UH) e-Lock Systems because it has an Authority to Operate for Electronic Locking Systems.

D. _______UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.

Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified: 27 Mar 24 Package Received

2. Required delivery date/period of performance: IGE says 1 Jun 24. Spoke with the POC who understands our 120 day PALT and said there were no issues with this.
