52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) technical capability of the item offered to meet the Government requirement;
(ii) price;
(iii) past performance
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
ADDENDUM 52.212-3 EVALUATION FACTORS FOR AWARD
The Government intends to award one contract as a result of this solicitation. As set forth in FAR 13.106- 2, the Government intends to evaluate quotes in an efficient and minimally burdensome fashion. The offeror’s initial quote should contain the offeror’s best terms from a price and technical standpoint. Formal evaluation plans and establishing a competitive range, conducting discussions, and scoring quotations or offers are not required.
Evaluation criteria will consist of two (2) factors and the quotes will be evaluated for Technical Capability (Factor I) and Past Performance (Factor II).
Factor 1 - Technical Factor: The Technical Factor evaluation provides an assessment of the offeror’s capability to satisfy the Government’s minimum requirements. Contractors shall submit evidence of development of curriculum IAW NETC, instructional presentation technologies, and knowledge of current research as required by the PWS. Evidence shall consist of the last contracts awarded for course development and instructional learning within the last three (3) years and resumes of potential instructors
The Technical Capability Factor will receive one of the adjectival ratings defined below.
Table 1.
Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Sufficient evidence of development of curriculum
IAW NETC, instructional presentation technologies, and knowledge of current research as required by the PWS is provided.
Unacceptable Sufficient evidence of development of curriculum IAW NETC, instructional presentation technologies, and knowledge of current research as required by the PWS is not provided.
Factor 2 - Past Performance: The Past Performance evaluation will assess the offeror’s probability of meeting the solicitation’s requirements as indicated by that offeror’s record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the offeror’s recent past performance and focusing on performance that is relevant to the services being procured under this solicitation. Offerors are cautioned that in conducting the performance risk assessment, the Government may use data provided in the offeror’s quote and data obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems.
The Government will review past performance information submitted and may also utilize other information such as the Contracting Officer’s knowledge of and previous experience with the supply and/or service being acquired or any other reasonable basis. Past performance information considered by the Government for the offeror’s performance as a prime Contractor and/or subcontractor and the performance of its key management personnel may include the following areas: Quality of products or services, Timeliness, Business Relationships and Customer Satisfaction.
All offers will be evaluated under Factor 2 Past Performance. This non-cost factor will be evaluated as acceptable or unacceptable IAW the below ratings. Past performance will be evaluated based on the offeror's applicable performance under existing and prior contracts for services consistent with the scope and complexity of the functions in the solicitation as well as technical experience in the performance of services similar in size, type and complexity required by the solicitation. Performance information will be used for both responsibility determinations and as an evaluation factor. The Government will focus on information that demonstrates quality of performance relative to the size and complexity of the procurement under consideration.
The Past Performance Factor will be assigned one of the ratings defined below.
Table 2.
Past Performance Evaluation Ratings Rating Description Acceptable The offeror’s current and past performance is acceptable. There are no known performance issues of concern known to the Contracting Officer. PPIRS does not contain negative past performance ratings. In the event that there is no past performance information available, the Contractor shall be rated as acceptable.
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort. The offeror’s past performance or other information available to the Government indicates unacceptable performance.
Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 13.106-3 to determine prices are fair and reasonable, and balanced.
