PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT (PWS)

FY 2019 Professional Development Training Course (PDTC)

Naval Chaplaincy School & Center (NCSC)

1.0 INTRODUCTION

1.1 Purpose. The purpose of this Performance Work Statement (PWS) is to provide Contractor support to develop and deliver a Professional Development Training Course (PDTC) for Navy Chaplains and Religious Program

Specialists (RPs).

1.2 Background. The Chief of Chaplains, Office of the Chief of Naval Operations (N097) is responsible for sponsoring, developing, and presenting PDTC’s for Navy chaplains. The Naval Chaplaincy School & Center

(NCSC) is tasked by the Chief of Chaplains to develop the annual course in compliance with Naval Education and

Training Command (NETC) curriculum development standards (See Section 2.0). The PDTC is an annual event conducted 12 times at sites in the Continental United States (CONUS), Western Pacific (WESTPAC), and Naples, Italy. The purpose of the PDTC is to prepare chaplains and RPs personally and professionally to provide, facilitate, and support religious ministry for Naval Service personnel and other authorized users. To ensure that chaplains and

RPs are prepared to effectively deliver religious ministry, the Chief of Chaplains has selected the following theme for delivery in Fiscal Year 2019:

“Religious Ministry in Combat at and from the Sea”

This PWS is written in relation to three (3) modules for this PDTC:

Day 1 - Religious Ministry (RM) in Combat at and from the Sea;

Day 2 - Religious Ministry and a Faith Response to Moral Injury; and

Day 3 - Religious Ministry Response to Combat at and from the Sea.

Training shall consist of 3-days of instructional classroom training totaling approximately 22.5 hours, that shall be developed and delivered by contracted instructors.

Navy chaplains are religious ministry professionals who possess, at a minimum, a post-baccalaureate graduate degree in the field of theology or related studies from an accredited college, university, or school of theology of no fewer than 72 semester hours (108 quarter hours) of graduate-level work. Additionally, all Navy chaplains are endorsed by a religious organization in accordance with the Department of Defense (DoD) policy. They come from a diverse group of religious organizations and have varying levels of experience in military chaplaincy.

Religious Program Specialists (RPs) provide support to Navy chaplains in developing programs to meet the needs of

Navy, Marine Corps, and Coast Guard personnel and their families. While RPs assist Navy chaplains in the delivery of religious ministry, they are not religious ministry professionals and do not perform ministerial functions within the Department of the Navy.

1.3 Scope. The Contractor shall develop and deliver three (3) days of training (7.5 hrs. per day) on “Religious

Ministry in Combat at and from the Sea”. This project shall require curriculum development, relevant training support materials, curriculum validation, and curriculum implementation. A select representative group determined by N097 and NCSC shall validate the curriculum, as specified in Section 3.0 Technical Requirements.

1.4 Security Classification. This PWS and the initial training materials under procurement are unclassified. The

Contractor shall adhere to all local security procedures required. Regardless of Performance Work Statement classifications, all NETC projects require individuals to possess Common Access Cards (CAC). CACs shall be obtained through the Trusted Associated Sponsorship System (TASS) in conjunction with your sponsor and a Trusted

Agent. Additional information regarding TASS and the investigative process may be obtained by accessing http://www.cac.mil/common-access-card/getting-your-cac/for-Contractors/. Early termination or resignation of a contract employee shall be reported to the Contracting Officer Representative (COR) and the Contracting Officer

(KO) immediately via email by the Contractor Program Manager or their direct representative. Due to the geographic disparity between the COR and the contract work site, the CAC shall be collected by the contract employee’s supervisor and surrendered to the contract Program Manager or Security Officer. The contract Program Manager shall ensure the CAC is rendered to the nearest Real-Time Automated Personnel Identification System (RAPIDS) site for disposal. Violation of Section 1.4 shall result in a breach of contract by the Contractor and may result in termination of contact by the Government.

1.4.1 Defense Biometric Identification System (DBIDS)

The Defense Biometric Identification System (DBIDS) is a DoD-owned and operated system developed by Defense

Manpower Data Center as a force protection program to manage personnel identity and access at DoD installations.

DBIDS is a network database system designed to easily verify access authorization of personnel entering military installations by using barcodes and fingerprint biometric identifications.

To improve management and force protection at Navy installations, the Navy is transitioning from using the Navy

Commercial Access Control System (NCACS) to the Defense Biometric Identification System (DBIDS) for

Contractors and vendors requiring access to an installation at no cost to them.

In order to obtain base access, an individual needs to acquire DoD sponsorship, have a thorough identity check, be properly vetted, and have a legitimate reason for base access. Identity checks require a passport or a Real ID Act-compliant state driver's license. Vetting occurs when the individual's background and ID are compared against authoritative criminal justice data bases, and the individual has a letter or official document from the sponsoring http://www.cac.mil/common-access-card/getting-your-cac/for-contractors/ organization which articulates the reason for access. When the above criteria are satisfactorily met, DBIDs credentials are issued.

For more information https://www.cnic.navy.mil/om/dbids.html

1.4.2 Personnel Removal: Government rules, regulations, laws, directives, and requirements that are issued during the term of the performance period relating to law and order, installation administration, and security shall be applicable to all Contractor employees and representatives who enter the installation. Violation of such rules, regulations, laws, directives, or requirements shall be grounds for removal (permanently or temporarily as the

Government determines) from the work site or installation. Removal of employees does not relieve the Contractor from the responsibility for the work defined in this contract.

Removal by Installation Commander: The Installation Commander may, at his discretion, bar an individual from the installation under the authority of 18 USC 1382 (1972), for conduct that is determined to be contrary to good order, discipline, or installation security and safety.

Removal Requested by Designated Government Representative (DGR): The DGR may require the

Contractor to remove an employee working under this contract for reasons of misconduct or security violations. Contractor employees shall be subject to dismissal from the premises upon determination by the

DGR that such action is necessary in the interest of the Government.

Removal by Military Police: Contractor employees may be denied entry to or may be removed from the installation by Military Police if it is determined that the employee’s presence on the installation may be contrary to good order, discipline, or installation security and safety.

Removal for Unsatisfactory Performance: The Government reserves the right to require the Contractor to remove and replace any employees who provided unsatisfactory performance, demonstrate insufficient knowledge, or possess inadequate skill levels necessary to complete assigned tasks. The skill level of the staff provided shall be current and consistent with new technologies.

CLAUSES INCORPORATED BY FULL TEXT

52.203-18 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL

CONFIDENTIALITY AGREEMENTS OR STATEMENTS--REPRESENTATION (JAN 2017)

(a) Definition. As used in this provision--

Internal confidentiality agreement or statement, subcontract, and subcontractor, are defined in the clause at 52.203-

19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements.

(b) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing

Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

(c) The prohibition in paragraph (b) of this provision does not contravene requirements applicable to Standard Form

312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information

Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(d) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

(End of provision)

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (OCT 2015)

(a)(1) The Offeror certifies, to the best of its knowledge and belief, that-

(i) The Offeror and/or any of its Principals-

(A) Are ( ) are not ( ) presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have ( ) have not ( ), within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or

State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and

(C) Are ( ) are not ( ) presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision.;

and

(D) Have , have not , within a three-year period preceding this offer, been notified of any delinquent

Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has ( ) has not ( ), within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;

head of a division or business segment; and similar positions).

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations

Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that--

(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and

(2) It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months.
