About this file

This document is an amendment to a solicitation for multi-brand name audio visual and video teleconference equipment. The amendment extends the required delivery schedule from 45 days after receipt of order to 90 days after receipt of order for ordering years one and two. It also provides responses to questions received, including confirming there is no incumbent contractor, no adjustments will be made for inflation, and replacements for end-of-life items must be negotiated. The amendment further extends the proposal receipt date to March 28, 2022 at 4:00 PM EST and incorporates revisions to an equipment list attachment. The related federal contract opportunity indicates the solicitation is for commercial items under FAR Part 12 for the Department of the Navy Naval Air Systems Command Naval Air Warfare Center.

The following have been added by full text:

AMENDMENT 0001

The purpose of this Amendment is to address the following questions received by our agency and to notify all potentially interested parties of part number updates contained in Attachment #001, Revision 1 dated 1 Mar 2022. A copy of Attachment #001, Revision 1 is incorporated herein as Attachment 2 in the Table of Contents, Standard Form 1449 continuation sheet.

1. Question: Is there an incumbent contractor performing these services, or is this a brand new contract? If there is an incumbent, could the Government provide the current / previous contract number?

Question 1 Answer: This is a brand new contract.

2. Question: The solicitation requirements specify a required 45 day lead time after receipt of each delivery order. Is there a plan to manage those expectations pending the growing lead times?

Question 2 Answer: The required delivery schedule has been extended from 45 days after receipt of order (ARO) to 90 days ARO for Ordering Years 1 and 2. Refer to Federal Acquisition Regulation (FAR) clause 52.211-8, Time and Delivery and Attachment #001, Revision 1 as amended for delivery schedule updates.

3. Question: Can you please provide guidance as to how to respond to the Request for Proposal with the knowledge that most equipment cannot be received in the timeframe requested?

Question 3 Answer: As stated in our response to Quesiton 2, the required delivery schedule has been extended from 45 days ARO to 90 days ARO for Ordering Years 1 and 2. Refer to FAR clause 52.211-8, Time and Delivery and Attachment #001, Revision 1 as amended, for proposal preparation purposes.

4. Question: Are there opportunities to allow for fair and reasonable adjustments to costs relative to inflation?

Question 4 Answer: No adjustments to costs relative to inflation will be made. By submitting a proposal in response to this solicitation, the offeror is willing to accept a fixed price representing assumption of the risks involved.

5. Question: How will item pricing be established if items become end-of-life during the 3 year ordering period?

Question 5 Answer: In the event an item becomes end-of-life any time during contract performance, the Government and contractor may negotiate and execute a modification for a form, fit, function replacement part.

6. Question: Are variable lead times acceptable based on manufacturer and distribution availability at time of orders?

Question 6 Answer: The required lead times specified in FAR clause 52.211-8, Time and Delivery and Attachment #001, Revision 1 are not to be exceeded. In accordance with the terms and conditions on page 4 of the SF 1449, early shipments are acceptable and accelerated delivery in advance of the specified delivery schedule is desired. Early shipments shall be at no additional cost to the Government and shall not result in any payment to the contractor.

All other terms and conditions remain unchanged and in full force and effect. As a result of this amendment, receipt of proposal packages has been extended an additional (22) calendar days to 28 Mar 2022 at 4:00 PM EST.

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor’s date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term “working day” excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
