JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ
2. Description of the Action Being Approved.
This justification and approval authorizes and approves on a sole source basis a Firm Fixed Price contract with American Valley Aviation (AVA) for the procurement of a Digital Stores Management System (DSMS)
Tester, P/N 0601206-101. This contract will be in support of Foreign Military Sales (FMS) programs for the
Pakistan Navy and Taiwan Air Force's P-3 Aircraft.
3. Description of Supplies/Services.
This effort is for the procurement of the DSMS Testers for the FMS Taiwan and Pakistan P-3 programs.
This effort requires AVA to provide the following deliverables: four (4) each DSMS Testers, four (4) each
Test Set-Self Test Adapters and four (4) each Aircraft to Test Set Power Cables. AVA will also provide technical data to include; NAVAIR-style publications that will have step by step written test set and troubleshooting procedures, wiring diagrams/schematics and illustrated parts breakdown (IPB) lists. The quantities are two (2) each for FMS Pakistan and two (2) each for FMS Taiwan. The DSMS is a standard-based weapons control system that provides selection, arming, release and post launch control of modern precision guided weapons. The DSMS replaces the legacy analog stores management system with a modern digital solution. The DSMS Tester checks and troubleshoots the modified or refurbished DSMS pylons.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
American Valley American Valley Aviation, Inc. (Quincy, CA) is the designer, developer and manufacturer of the DSMS Tester (P/N 0601206-101) and is the only known source to possess the technical capability, specialized experience, and technical data necessary to manufacture this tester and applicable adapters.
The U.S Government does not own the rights to the drawings or specifications of this tester in order to competitively procure the item. Previously, AVA was awarded two contracts to upgrade DSMS pylons for both FMS Taiwan and Pakistan. A tester was needed to check/troubleshoot DSMS modified or refurbished
J&A_15_24452 pylons and bomb racks. AVA developed and manufactured this tester, at their own expense, to verify all components and streamline the quality assurance process during government (DCMA) inspections. The use of AVA's tester saves time by not requiring that the pylon be removed from the aircraft and sent to the
Aircraft Intermediate Maintenance Department for maintenance. When pylons are removed or reinstalled fuel leaks tend to occur which then makes the aircraft Non-Mission Capable (NMC).This tester can be used with either a built-in battery or a cable can be utilized for aircraft power. AVA also designed and developed, at their own expense, a test set - self test adapter as well as "test set to wing pylon" adapters. This is a small quantity purchase with little or no expectations to buy quantities in addition to those listed above. To try and compete and subsequently procure comparable components from a potentially different vendor would require rewriting training and technical manuals, developing a drawing package for the purpose of provisioning, testing, and developing a maintenance plan. These additional tasks would require additional non-recurring engineering costs that the FMS program doesn't have and that would not be expected to be recouped through competition of this requirement.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
PMA 260 is currently working on the Common Aircraft Armament Test Set (CAATS) which will replace the current Common Rack and Launcher Test Set (CRALTS) and both are similar type of testers when compared to the AVA tester. CAATS is projected to be delivered to the US Navy Fleet in 2016, however;
its capabilities will not be tested on the one (1) US Navy P-3 aircraft with DSMS due to aircraft sundown.
CRALTS and CAATS are similar to the AVA tester however they do not test the entire system, only the shop replaceable subsystems of the Digital Stores Management System. Also, the AVA tester can be used while the pylon is still on the aircraft unlike the current CRALTS tester. On-going research through various on-line search engines concluded that no other source can perform the required tasks because American
Valley Aviation owns the proprietary data rights for the DSMS Tester and applicable adapters. They are the only company who can develop the tester as well as the applicable adapter cables that interface between the tester and the P-3 Aircraft pylons. A Sources Sought Notice/Request for Information was posted to Federal Business Opportunities in accordance with DFARs 206.302-1 on 16 June 2015, and a synopsis was posted on the Federal Business Opportunities on 01 July 2015. Both notices were posted for fifteen (15) days each, and no inquiries were received.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. American Valley Aviation’s
(AVA’s) proposal will be reviewed by experienced technical analysts, cost analysts and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize price and cost analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in paragraph 5, the U.S. Government has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, the U.S. Government will assess whether competition for future requirements is feasible.
