SECTION A - SOLICITATION/CONTRACT FORM
The following have been modified:
GENERAL INFORMATION
This acquisition is for the dry-docking and overhaul of the USNS SHIP (EPF-X). All repair work is to be accomplished at the successful contractor’s facility. In order to support the current U.S. Navy mission under this solicitation, the place of performance shall be located in the Mediterranean west of 20 degrees east longitude, including the Adriatic Sea and locations outside the Mediterranean (Cadiz, Portugal, Northern Spain). The prospective contractor must also be located in a country that mantains an International Agreement that addresses primary jurisdiction procedures for US Military personnel.
PRICING
Prices shall be submitted in the format specified in Section B “Supplies/Services and Price” of this solicitation. Prices must be stated in euros.
A) WORK ITEMS CATEGORIES
The work items are grouped into three distinct categories: Category A, B and Not Separately Priced (NSP).
Category A includes definitized work items for which a firm fixed price has been established and will be executed during the period of performance and included in the base contract.
Category B includes definitized, “optional” work items earmarked for potential additional repairs, labor, materials or services, whereby a unitized price or total price has been established and may be invoked during the period of performance. They are identified under “Optional CLIN/SubCLIN” and can be invoked exercising the option.
Category NSP identifies work items without an associated fixed price that provide a detailed description for work items as part of their technical proposal. Procedure/regulations are also included that must be followed by the contractors and subcontractors in the accomplishment of all work requirements.
B) PRICING INFORMATION
Additional pricing information for the following work items:
· Work Item #011 GENERAL SERVICES FOR THE SHIP – CATEGORY A (SubClin 0001AB) The services included in Work Item #011 must be priced based on an estimated number indicated in the work item for each service.
J-1 (Tab 2) SubCLIN (0001AB) – Work Item #011 must be filled with the unit price for each service.
The unit price will be used for adjustments to the award price for lesser or greater total consumption. Any required adjustments shall be made via a contract modification.
· Work Item # 023 HAZARDOUS WASTE DISPOSAL – CATEGORY A (SubClin 0001AO) The total price for this work item shall include management and handling fees and an estimated cost of hazardous waste disposal (including any other costs associated, such as laboratory tests) of 70,000 euros to be reimbursed to the contractor. The contractor will be reimbursed for the actual cost of hazardous waste disposal based on the disposal/subcontractors invoices. If the actual cost of hazardous waste disposal is higher than 70,000 euros, a change order will be issued for the additional costs and for a pro-rata management and handling fee. If the actual cost of hazardous waste disposal is lower than Euro 70,000, a change order will be issued for definitizing the estimated value below Euro 70,000.
· Work Item # 030 CONTINUATION OF SERVICES – CATEGORY B ( SubClin 0003AA, 003AB, 0003AC AND 0003AD)
Work Item #030 includes optional work items that allows the government to extend the period of performance and maintain the services described in the parent work items.
One of the work item is #011. For WI #011, the Attachment J-1 (Tab 3) CLIN 0003AB- WI011 shall be filled with the unit price for each service. The unit price will be used for final adjustments based on the actual consumption.
Attachment J-1 (Tab 1) Contractor’s Price Breakdown shall be completed by providing the number of labor hours, labor rate, total labor cost, and subcontractor/material and any other costs for the items that are priced in Section B based on quantity “1” and Unit “Lot”. For all other work items that have been grayed out, the offerors shall insert the total price only. The labor rate indicated will be applied for any subsequent repairs identified as growth work of the parent work item.
SUBSEQUENT REPAIRS – SCOPE OF THE CONTRACT
If additional work is discovered during performance, the Contracting Officer will determine if it can be considered growth or new work, after following required contracting procedure.
GROWTH WORK
Growth work is defined as additional work discovered during performance that is associated with an existing work item and determined necessary to accomplish the original scope of that work item successfully. All growth work must be associated with an existing work item. The Contractor shall not perform any growth work without the Contracting Officer's pre-authorization. Growth work is work determined by the Government to be within the scope of the original contract. The contractor labor rate proposed for that work item shall be utilized in the pricing of any growth work associated with that work item (subject to approval by the Government prior to commencement of the growth work). Nonetheless, the Contracting Officer reserves the right to contract for growth work on the basis of a negotiated, firm-fixed price, when it is in the best interest of the Government to do so.
The Contractor shall furnish a price breakdown in preparation for each contract modification, as required. All price breakdowns should be furnished directly to the Contracting Officer, and any proposed subcontracting shall be supported by a separate price breakdown. If the proposal includes a request for a time extension, justification shall be furnished with the proposal. However, the labor rate for the growth work is the same proposed for the parent work item and indicated in Attachment J-1 (Tab 1) Contractor’s Price Breakdown.
The Contracting Officer may require the contractor to proceed to accomplish growth work before a firm-fixed price can be mutually agreed upon. In these cases, the work will be directed under the authority of contract clause 252.217-7003 CHANGES and a final price will be mutually agreed upon at a later date in accordance with the timetable described in that clause. However, even in these cases, performance of authorized growth work shall not commence until after the contractor receives a unilateral contract modification from the Contracting Officer.
The Government considers 5000 man hours of Anticipated Growth Requirement (AGR) to be able to accomplish this available. The contractor must be able to absorb this amount of growth within the performance period of 01 Nov 2018 – 29 January 2019.
NEW WORK
New work is defined as additional work cannot be reasonably tied to an existing work item in the specification package, but is still essential for the satisfactory completion of the vessel overhaul effort. New work will comply with the procedures covered in DFARS 252.217-7028 OVER AND ABOVE WORK. (DEC 1991)..
