References must demonstrate experience working in active industrial or hazardous environments
(e.g., fuel depots, LP gas operations, gas vaporizers).
Experience with contaminated soil mitigation and safety execution under USACE EM 385-1-1 is highly preferred.
Each reference shall include the contract number, agency/customer, total contract value, period of performance, and a brief description of the work performed.
Corporate Safety History
Offerors shall provide comprehensive documentation of their corporate safety record, including:
1. Workers' Compensation Experience Modification Ratings (EMR): Documentation of the offeror's current intrastate and interstate EMR. If any EMR is 1.00 or higher, the offeror must provide a detailed narrative describing the circumstances behind the rating and the specific corrective actions implemented to improve jobsite safety.
2. OSHA Logs: Completed OSHA Form 300 ("Log of Work-Related Injuries and
Illnesses") and OSHA Form 300A ("Summary of Work-Related Injuries and
Illnesses") for each calendar year from 2021 through 2026.
3. Regulatory Violations: Documentation of any environmental, health, or safety citations or violations received since 1 January 2021 from any Federal, State, local, or other Government/quasi-Government authority, along with the offeror’s formal response and resolution of the incident(s). If no citations were received, the offeror must explicitly state so.
Volume III: Cost/Price Proposal Requirements
Offerors shall provide complete pricing for CLIN 0001 and CLIN 0002. Submissions must include detailed labor, materials, and subcontracting cost breakdowns to allow the Government to conduct a thorough price analysis.
Design vs. Construction Breakdown: Offerors must distinctly separate the proposed price for
Design Services (CLIN 0001) from the Construction Build (CLIN 0002).
Statutory Design Fee Limitation: In accordance with 10 U.S.C. 2306 and FAR 15.404-
4(c)(4)(i)(B), the contract price for the production and delivery of designs, plans, drawings, and specifications (CLIN 0001) shall not exceed six percent (6%) of the estimated cost of the physical construction (CLIN 0002).
Schedule of Values (SOV): The Offeror shall provide a detailed SOV breaking down the labor, materials, overhead, and profit for both CLIN 0001 and CLIN 0002 to demonstrate compliance with this statutory limitation and to ensure pricing is not unbalanced.
Basis for Contract Award
This is a competitive, best-value tradeoff source selection conducted in accordance with FAR
Part 15. The Government intends to award a single contract resulting from this solicitation to the responsible Offeror whose proposal represents the best overall value, price and non-price factors considered.
The Government reserves the right to accept other than the lowest priced proposal where the technical and/or past performance superiority of a higher-priced proposal warrants the additional cost. Conversely, the Government will not pay a significantly higher price for marginal technical superiority.
Relative Importance of Evaluation Factors
All evaluation factors are listed below in descending order of importance:
1. Factor 1: Technical Capability (More important than Past Performance)
2. Factor 2: Past Performance & Corporate Safety
3. Factor 3: Price
Within Factor 1 (Technical Capability), the sub-factors are of equal importance:
Sub-factor 1: Design & Construction Approach
Sub-factor 2: Key Personnel Qualifications
Sub-factor 3: Environmental Management Plan
When combined, Factor 1 (Technical Capability) and Factor 2 (Past Performance) are significantly more important than Factor 3 (Price). However, as proposals become more equal in technical merit and past performance, the relative importance of Price will increase.
Evaluation Methodology
Factor 1: Technical Capability Evaluation
The Government will evaluate the Technical Volume to assess the feasibility, completeness, safety compliance, and overall risk of the offeror's proposed approach. Adherence to all specified
NFPA/ASME standards and the integrated execution of the Soil Management Plan (SMP) will be key evaluation metrics. Technical proposals will be assigned an Adjectival Rating based on the following scale:
Technical
Rating Description
Outstanding
Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths. Risk of unsuccessful performance is extremely low.
Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength. Risk of unsuccessful performance is low.
Acceptable
Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Risk of unsuccessful performance is no worse than moderate.
Marginal
Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or contains one or more weaknesses. Risk of unsuccessful performance is high.
Unacceptable Proposal does not meet requirements and contains one or more deficiencies.
Proposal is unawardable.
Factor 2: Past Performance & Corporate Safety Evaluation
The Government will evaluate the relevance, currency, and quality of the offeror's past performance to assign a Performance Confidence Assessment rating.
Relevance: Focuses on the similarity of scope, size, and complexity (specifically design-build contracts in active hazardous environments and contaminated soil remediation).
Safety & Health Record Assessment: The Government will evaluate the offeror’s Safety
History (EMR, OSHA Forms 300/300A, and citation history) to determine the contractor's commitment to workplace safety and risk mitigation.
An EMR greater than 1.00, a high trend of recordable injuries on OSHA logs, or unresolved safety/environmental violations within the last five (5) years may be assessed as a performance risk, which could negatively impact the overall Performance Confidence Assessment rating.
Offerors who demonstrate a proactive safety culture, low incident rates, and an EMR below 1.00 will be evaluated favorably.
Confidence Rating Scale:
Substantial Confidence: High level of confidence that the offeror will successfully perform the required effort.
Satisfactory Confidence: Reasonable expectation of successful performance.
Neutral Confidence: No recent/relevant performance record. Evaluated neither favorably nor unfavorably.
Limited Confidence: Low expectation of successful performance.
No Confidence: Extremely low expectation of successful performance.
Factor 3: Price Evaluation
Proposed prices will be evaluated for completeness and reasonableness in accordance with FAR
15.404-1.
Reasonableness and Balance: The Government will evaluate the proposed prices for CLIN
0001 and CLIN 0002 to determine fair and reasonable pricing. The Government will also analyze the pricing for unbalanced line items; a proposal may be rejected if CLIN 0001 (Design) is determined to be front-loaded or materially unbalanced relative to CLIN 0002 (Construction).
Statutory Compliance: The Government will evaluate CLIN 0001 to ensure the proposed fee for Architect-Engineer design services does not exceed the 6% statutory limitation based on the estimated construction cost. Proposals failing to comply with this statutory ceiling are un awardable.
PHASED NOTICE TO PROCEED (NTP) FOR DESIGN-BUILD
1. Design NTP: Upon award, the Contracting Officer will issue the Notice to Proceed for
CLIN 0001 (Design Services) only.
2. Construction NTP Hold: The Contractor shall NOT commence any physical construction, site preparation, or material procurement under CLIN 0002 (Construction Build) until the
Government has formally reviewed, accepted, and approved the 100% final design documents submitted under CLIN 0001.
3. Construction NTP Issuance: Following final design approval, the Contracting Officer will issue a separate, written Notice to Proceed for CLIN 0002. Any construction work performed prior to the issuance of the CLIN 0002 NTP is at the Contractor's own risk and expense.
