UNDER FAR 13.5, SIMPLIFIED PROCEDURES FOR

CERTAIN COMMERCIAL ITEMS

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Undersea Warfare Center

Division, Code 02, Newport, RI.

2. Description of the Action Being Approved

Award of a sole source Firm Fixed Price contract to

Newton Research Labs, Inc. for an Underwater Encapsulated

Scanning

Laser Velocimeter, Model ULV750UW.

3. Description of Supplies/Services

The Naval Undersea Warfare Center, Division Newport

(NUWCDIVNPT),

Currently, hydrophones are used to record reflected and/or transmitted acoustic energy, and structural performance is then inferred from the acoustic data. The procurement of a pressure-rated underwater scanning laser velocimeter will allow for accurate measurement of the material properties of elastic solids subjected to high ambient pressure (up to

265psi/600ft depth equivalent) in the 1 to 10 kHz frequency range. These measurements will then be used to design and analyze acoustic coating and flank array materials that are in use in existing and are proposed for future systems. The underwater scanning laser velocimeter is part of the Capital Investment Program for scientific equipment.

4. Statutory Authority Permitting Other Than Full and Open

10 U.S.C. 2304(c)(1), as implemented in Federal Acquisition

Regulation (FAR) 6.302-1: Only one responsible source and no other type of supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

Newton Laboratories is the only company that is able to manufacture and produce a modified underwater laser for use under high pressure. These unique specifications and modifications of the scanning laser velocimeter must perform non-contact, Newton

Laboratories recently developed and manufactured a unique pressure-rated underwater shaker system under Contract for NUWCDIVNPT. This underwater encapsulated scanning laser velocimeter will be used in tandem with this underwater shaker system and must be compatible to be used in existing submarine systems and for proposed future systems.

It is vital that the underwater scanning laser velocimeter is compatible with the underwater shaker system already in place to ensure compatibility and a seamless integration and interoperability between all components within the existing environment. Failure to award a sole source contract to Newtown Laboratories for this underwater scanning laser velocimeter will result in significant schedule delays and additional costs to this capital investment program.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

A combined synopsis and solicitation will be posted on the

Government Point of Entry (beta.sam) notifying industry of the intent to solicit as a sole source acquisition. Any challenges to this sole source action will be brought to

Competition the attention of the Contracting Officer prior to contract award.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will conduct a price analysis in accordance with FAR Part 15.404(1)(b) to ensure the supplies covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

There are no actions to remove barriers to competition, as this is a one-time purchase.
