STATEMENT OF WORK (SOW)
STATEMENT OF WORK
1.0 BACKGROUND
The NUWCDIVNPT Office of Counsel, Patents, transforms the novel ideas of NUWCDIVNPT engineers and scientist into patents granted by the United States Patent and Trademark Office (USPTO). The process to try to obtain a patent starts with an inventor reporting an invention in a writing that generally includes illustrations and a detailed description of the inventive concept. Based on the written disclosure, a patent application, including formal drawings, is prepared by a patent attorney and filed with the USPTO. A patent application is initially checked for format which includes drawing requirements for patent application figures. An assigned patent examiner reviews the patent application for enablement and novelty. If a Patent Examiner at the USPTO determines the application to be allowable based on the USPTO Manual of Patent Examining Procedures, a fee is paid and a patent is issued.
2.0 SCOPE
The contractor shall perform patent application and prior art searches preparation and prior art searches , as specified by NUWCDIVNPT, from an invention disclosure provided by the NUWCDIVNPT attorneys or the NUWCDIVNPT patent paralegal. The patent application shall be prepared using WORD software in a Courier New format at a size 12 font.
The contractor shall perform drafting services for patent application figures as part of the patent application preparation. The figures shall be in draft form, revisions for corrected drafts or final formal patent drawings representing the patent application figures, as specified by NUWCDIVNPT.
Drawings shall be prepared using Computer Aided Design (CAD) software capable of storing drawing files in AutoCAD drawing format(.dwg)
3.0 REQUIREMENTS
The contractor shall have facsimile transmission, scanning or internet connected computer equipment for sending and receiving invention disclosures and supporting documentation as well as revisions between the contractor and NUWCDIVNPT for modifications prior to formal submission.
The contractor shall prepare patent applications that conform to the enablement and format requirements of the USPTO Manual of Patent Examining Procedures. The contractor shall prepare formal patent drawings that conform to the requirements of 37
CFR § 1.84.
The contractor shall review provided invention disclosure and notes. The contractor shall conduct a search of patents, published patent applications and other published material.
Patents prior to 1976 shall be included in this search if warranted by the technology. A search report shall be delivered, predicated on the most pertinent prior art. The report must include a listing of the most pertinent references found during the search. The report shall specify the classes, subclasses that were searched and keywords used in searching. A copy of each of the cited references shall be supplied along with the report. The report shall include a statement defining the pertinence of each listed reference and how the invention disclosure is distinguishable over the reference. The report shall include an opinion concerning the extent of patent protection available for the disclosed invention.
4.0 DELIVERABLE PRODUCT
The contractor shall deliver drafts, corrected drafts, and ultimately, a final text patent application as specified above.
The contractor shall deliver draft report, correct reports, and ultimately, final reports as specified above in accordance with
CDRL A0001.

For other than firm fixed price subcontracts, subcontractors are also required to provide labor categories, rates, and hours (both straight time and overtime) invoiced; as well as, a cost breakdown of ODCs, materials, and travel invoiced. Supporting documentation may be encrypted before submission to the prime contractor for WAWF invoice submittal.
