Synopsis for: Contract Number N66001-26-D-0020

Title: Department of Defense Enterprise Software Initiative (DoD ESI) for Oracle

Description: N66001-26-D-0020 - Notice of Intent to award a sole source contract to Oracle America, Inc., for Oracle commercial products and services. This synopsis is issued in accordance with FAR subpart 5.201.

The Department of the Navy, Naval Information Warfare Center, Pacific (NIWC Pacific), intends to award a contract on a sole-source basis to Oracle America, Inc. Authority for other than full and open competition is 10 U.S.C. § 3204(c)(1) Only One Responsible Source and no other supplies or services will satisfy agency requirements, as implemented by FAR 6.302-1. FAR Part 15, Contracting by Negotiation, and FAR part 12, Acquisition of Commercial items, apply.

A sole source contract will be issued using other than full and open competition procedures. This requirement is for the procurement of Oracle software licenses (perpetual and subscription), software maintenance and support renewals, Software as a Service, hardware, hardware support, engineered systems, engineered systems support, Oracle Advanced Customer Services (ACS), and Oracle Consulting Services (OCS) to support IT operations across the DoD enterprise.

The proposed procurement action is anticipated to result in an indefinite delivery/indefinite quantity (IDIQ) contract with a five (5) year base ordering period and a five (5) year option ordering period.

Pricing will be firm-fixed-price. Task & Delivery Orders may be placed by the Department of Defense, Intelligence Community, and Coast Guard. The total estimated value is $7.13B including the option ordering period. The NAICS Code is 513210 (Software Publishers) with a Size Standard of $47 million. The estimated award date for the contract is January 2025. Responses to this sole source synopsis shall be submitted via the System for Award Management (SAM) website at https://sam.gov/ under “Contract Opportunities” by 25 December 2025 at 1500 PST. Questions concerning this notice should be directed to Susan Chamberlin at susan.a.chamberlin.civ@us.navy.mil.

While increased competition generally reduces prices, market research has revealed that a direct award to Oracle can achieve higher minimum discounts and a more efficient single-award construct for this requirement. Specifically, market research demonstrates higher discounts on net new licenses for the majority of the product families ordered by the DoD. The discount percentages significantly exceed the typical discount achieved under a reseller model. Furthermore, a direct award unlocks a more aggressive volume-tiered discount structure. The direct model also includes a volume-based tiered discounts for support fees, which has not been generally available under the reseller model. Lastly, a direct award to Oracle would include a lower cap on the annual inflation of software maintenance and support fees as opposed to what the DoD generally receives today (outside of specific Enterprise Licensing Agreements) using the reseller model.

This Notice of Intent is not an Request for Proposal (RFP). All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. All responses received before this date shall be considered by the Government for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government.
