4. QUOTATION SUBMISSION REQUIREMENTS

4.1 FORMAT: Each vendor shall provide a written Firm-Fixed Price (FFP) quote, as outlined below.

NOTE: When submitting a quote, or providing “No Bid” information, the subject line of the vendor’s email shall clearly state the VENDOR’S NAME and full RFQ number.

4.2 QUESTIONS/ QUOTATION SUBMISSIONS:

(a) Vendors shall submit questions electronically for this solicitation no later than THURSDAY, 22 AUGUST 2019, at 3:00 PM (Eastern Time).

(b) Vendors shall submit quotations (including “no bids”) electronically for this solicitation no later than MONDAY, 26 AUGUST 2019, at 3:00 PM (Eastern Time).

(c) Submittal shall be emailed to the addresses specified below:

(d) Quotes will be considered “late” unless the quote is electronically received by the specified closing date and time for this solicitation.

4.3 AMENDMENT 0001: The following Questions/Answers and associated change(s) are delineated for RFQ N652319Q0379:

THE QUOTES SUBMISSION DATE HAS CHANGED TO MONDAY, 26 AUGUST 2019, at 3:00 PM (EASTERN TIME)

THE TECHNICAL SPECS AND SALIENT CHARACTERISTICS IN ATTACHMENT 1 HAVE BEEN REVISED IN AMENDMENT 0001.

FAR PROVISION 52.204-24 HAS BEEN ADDED TO THIS RFQ. QUOTES SHALL INCLUDE A COMPANY’S REPRESENTATION IN THE FORMAT PRESCRIBED BY PARAGRAPH 4.1 OF THE RFQ.

QUESTION (1) CLIN 1 and CLIN 2:

CP Cases, Inc rarely install Gore membrane vents. They have a different PRV (pressure release valve) that is normally installed, both for commercial and defense applications. It is an automatic valve, installed on the face of the rack body. It has a manual release button that can be used, when desired. Is it safe to assume this PRV will be acceptable?

ANSWER (1) CLIN 1 and CLIN 2:

PRV is acceptable and has been added to the required technical specifications and salient characteristics in Attachment 1 to the RFQ.

QUESTION (2) CLIN 1 and CLIN 2:

More importantly, they generally state their racks can be “built to handle payloads to (and even above) 300 lbs.” but it is rare to have a customer who is actually installing gear that weighs 300 lbs. If 300 lbs. is correct, it means they change the internal chassis from aluminum to stainless steel (higher price), they add reinforcements to the chassis, they change the anti-vibration mounts from elastomeric (rubber) to wire rope style (expensive), there is a good bit more engineering involved (expensive) and the lead-time for the racks is extended. Is there a way for you to find out, for sure, the end customer actually intends to carry as much as 300 lbs. in each rack? This weight seems quite unusual (at least when compared with the majority of our customers). Please advise.

ANSWER (2) CLIN 1 and CLIN 2:

The gear will weigh approximately two (200) hundred pounds as reflected in the revised technical specifications and salient characteristics in Attachment 1 to the RFQ.

QUESTION (3) CLIN 1 and CLIN 2:

Does the rack need to have both heating and air conditioning capabilities or just air conditioning?

ANSWER (3) CLIN 1 and CLIN 2:

The HVAC portion of the salient characteristics was removed from Attachment 1.

4.4 AMENDMENT 0002: The following Questions/Answers and associated change(s) are delineated for RFQ N652319Q0379 Amendment 0001:

THE TECHNICAL SPECS AND SALIENT CHARACTERISTICS IN ATTACHMENT 1 HAVE BEEN REVISED IN AMENDMENT 0002.

QUESTION (4) CLIN 1 and CLIN 2:

With the payload change from three (300) pounds to two (200) hundred pounds, will the configuration of the Chassis remain 2 mm (0.080") Aluminum or will change to Stainless Steel?

ANSWER (4) CLIN 1 and CLIN 2:

The gear payload weigh is currently one (100) hundred pounds and the configuration of the Chassis remains 2 mm (0.080") aluminum as reflected in the revised technical specifications and salient characteristics in Attachment 1 to the RFQ.

5. EVALUATION CRITERIA

The Government will award a purchase order resulting from this solicitation to the responsible vendor whose quote, conforming to the solicitation, is the lowest price and technically acceptable.

Technically acceptable for this request is defined as a quote which:

(a) Provides Pricing for ALL Line items and includes brand name or equal product part numbers on pricing sheet.

(b) Provides Brand name or equal products in accordance with attached salient characteristics, Attachment 1, Quote Spreadsheet

(c) For equal products, provides descriptive literature such as illustrations, drawings, and clearly describes any modification that will be made to make the product quoted conform to the solicitation requirements. Mark any descriptive material to clearly show the modification

(d) Provide that delivery must be completed for all ordered items (90) Day(s) from receipt of Award.

PARTIAL SHIPMENTS ARE ALLOWED

6. EVALUATION PROCEDURES

(a) This procurement will use the evaluation procedures established in FAR 13.106-2. This is not a source selection utilizing FAR Part 15 or any source selection rules therein (FAR 15.1, 15.2, or 15.3).

(b) The Government intends to award based on the vendor’s initial quote, which shall contain the vendor’s best terms. The Government will evaluate the lowest priced quote for solicitation compliance and technical acceptability. At its sole discretion, the Government may evaluate other quotes as necessary.

(c) The Government may dialogue with all, some, or none of the vendors. Fluid interaction between the Contracting Officer and the Vendors may address any aspect of the quotations received.

(d) Depending on whether substantial activity has occurred and the potential for award delay, late quotes may or may not be considered.

7. AWARD

(a) NIWC Atlantic will award a FFP purchase order resulting from this solicitation to that vendor whose quote, conforming to the solicitation requirements, is determined to provide the lowest price and technically acceptable quote to the Government.

(b) Vendors may be required to sign the resulting order to show acceptance.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment.

(a) Definitions. As used in this provision-- Covered telecommunications equipment or services, Critical technology, and Substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing--

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Representation. The Offeror represents that-- It [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.

(d) Disclosures. If the Offeror has responded affirmatively to the representation in paragraph (c) of this provision, the Offeror shall provide the following information as part of the offer--

(1) All covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);

(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;

(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and

(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).
