Collateral Security

1. This is a service contract. Biennial review will not be conducted.

2. The contractor shall implement procedures whereby any loss, compromise, or suspected loss or compromise of classified information or material and loss of unclassified material issued under this contract, shall be promptly reported to both the Cognizant Security Office and the SPAWAR Systems Center Atlantic Security Manager.

3. Information on this contract is not releasable to personnel possessing reciprocal clearance without the written approval of COMSPAWARSYSCOM (SPAWAR 8335) via SPAWAR Systems Center Atlantic Security Manager and Special Security Officer.

4. Only persons actually performing classified tasks on this contract shall be cleared to the appropriate level in accordance with the National Industrial Security Program Operating Manual (NISPOM).

5. Upon termination of this contract, all documentation shall be returned to SPAWAR Systems Center Atlantic along with the appropriate accountability and control records.

6. Block 10.a – Contractor is authorized access to Government furnished cryptographic equipment and information. Access to COMSEC information, per NSA CSSM 3-16 Manual, requires a final U.S. Government clearance and special briefings at the appropriate level.

7. Block 10.e (1) & (2) – Intelligence information will be handled and controlled as indicated in the NISPOM. Access to Intelligence information requires a final U.S. Government clearance at the appropriate level. DSS is relieved of security inspection responsibility for all such material but retains responsibility for all non-SCI material released to or developed under this contract.

8. Block 10.g – This contract requires access to classified NATO information. The requirements of the NISPOM shall be complied with in the handling of such information. Access requires a final U.S. Government clearance and special briefings at the appropriate level.

9. Block 10.h – Access to Foreign Government Information requires a final U.S. Government clearance at the appropriate level. Full compliance with NISPOM Chapter 10 is warranted during this contract. This information will not be release to any activity or person not directly engaged in this contract or to another contractor (including subcontractors), government agency, private individual, or organization without prior approval of the GCA

10. Block 10.j - The following procedures will be used to protect FOR OFFICIAL USE ONLY (FOUO) material:

Reference: DoD 5400.7-R, DoD Freedom of Information Act Program, September 1998.

a. HANDLING: Access to FOUO material shall be limited to those employees needing the material to do their jobs. The FOUO marking is assigned to material created by a DoD user agency. FOUO is not a classification, but requires extra precaution to insure it is not released to the public. FOUO is not authorized as a substitute for a security classification marking, but is used on official Government information that may be withheld from the public under exemptions 2 through 9 of the Freedom of Information Act (FOIA). Use of FOUO does not mean that the information cannot be released to the public; only that it must be reviewed by the Government prior to its release to determine whether a significant and legitimate Government purpose is served by withholding the information or portions of it.

b. MARKING: Mark unclassified documents containing FOUO "FOR OFFICIAL USE ONLY" at the bottom of each page and back cover (if any). In a classified document, mark:

(1) An individual paragraph that contains FOUO (but not classified material) by placing "FOUO" at the beginning of the paragraph.

(2) The top and bottom of each page that has both FOUO and classified material with the highest security classification of the material on that page.

(3) "FOUO" at the bottom of each page that has FOUO but not classified material.

TBD N65236-15-R-0005

Collateral Security (continued)

(4) If a classified document also contains FOUO material, or if the classified material becomes FOUO when declassified, place the following statement on the bottom of the cover or the first page under the classification marking: "NOTE: If declassified, review the document to make sure material is not FOUO before public release."

(5) Mark other records such as computer print outs, photographs, films, tapes, or slides "FOR OFFICIAL USE ONLY" so the receiver or viewer knows the record contains FOUO material.

(6) Mark each part of a message that contains FOUO material. Unclassified messages containing FOUO material must show the abbreviation "FOUO" before the text begins.

(7) Insure documents that transmit FOUO material call attention to any FOUO attachments.

(8) FOUO material released to a contractor by a DoD user agency must have the following statement on the front page or cover:

"THIS DOCUMENT CONTAINS MATERIAL EXEMPT FROM MANDATORY DISCLOSURE UNDER THE FREEDOM OF

INFORMATION ACT. EXEMPTIONS 2 THROUGH 9 APPLY."

c. STORAGE: During normal duty hours, place FOUO material in an out-of-sight location if your work area is accessible to persons who do not have a valid need for the material. After normal duty hours, store FOUO material to prevent unauthorized access.

File with other unclassified records in unlocked files or desks when internal building security is provided. When there is no internal security, locked buildings or rooms usually provide adequate after-hours protection. For additional protection, store FOUO material in locked container such as file cabinets, desks, or bookcases. Expenditure of funds for security container or close areas solely for the protection of FOUO material is prohibited.

d. TRANSMISSION: FOUO material shall be transmitted by the same methods as other unclassified material. Discussion of FOUO material on the telephone is authorized if necessary for the performance of the contract. FOUO material may be transmitted over telephone lines in digital form, by telecopies, or by other teletype lines without encryption.

e. RELEASE: FOUO material shall not be released outside the contractor's facility except to representatives of the DoD.

f. DESTRUCTION: When no longer needed, FOUO material shall be disposed of by a method that precludes its disclosure to unauthorized individuals.

11. Block 11.d – Classified shipments not to exceed two cubic feet. Larger size shipments require prior coordination with the Facility security Officer to confirm storage capacity.

12. Block 11.f – The contractor shall ensure that personnel have completed Anti-Terrorism/Personal Protection briefings prior to traveling to overseas sites.

13. Block 11.j – Contractor will understand and practice sound OPSEC principles in accordance with OPNAVINST 3432.1 and SPAWARSYSCENINST 3432.1 and will ensure that employees receive OPSEC training provided by the Government upon initial assignment and annually thereafter.

14. Block 11.k. – The contractor must request DCS services through the contracting officer to the Commander, Defense Courier Service, ATTN: Operations division, Fort George G. Mead, MD 20775-53770. Only certain classified information qualifies for shipment by DCS. It is the responsibility of SPAWARSYSCEN Atlantic to comply with DCS policy for qualified shipments when approving use of the services of DCS.
