3.9.6 Only when needed and directed by NSWCPD, NAVFAC MIDLANT Real Property Accountability Officer (RPAO): The RPAO is the government representative responsible for providing the Draft DD Form 1354, Transfer and Acceptance of Military Real Property.
3.9.7 Only when needed and directed by NSWCPD, Activity Representative: The Activity Representative serves as the POC to provide site access and site information, and may be located at the site location’s Public Works Department or may be a representative of a NSWCPD. The Activity Representative does NOT have any authority to modify the terms and/or conditions of a T.O.
3.9.8 Design Office Liaison (DOL): When the construction contract will be executed using the Early Contractor Involvement (ECI) approach, the DOL is the Construction Contractor’s representative who is assigned to work with the A-E throughout the design process.
3.10 PROJECT FUNDING: Specific project funding criteria will be identified for each T.O. Definitions of the funding terminology are noted below:
3.10.1 Project Cost: When the tasking is preparation of a solicitation package for design-bid-build (DBB), full design, or a design-build (DB) request for proposal (RFP), the Project Cost is the Total Authorized Funding for each project as shown on the DD Form 1391 for a Military Construction (MILCON or MCON) project or Navy Special Project. If the project is not a MILCON or Navy Special Project, the Project Cost is the total amount on the project programming document, or the total amount shown on the T.O. if the tasking is other than DBB, full design, or DB RFP.
3.10.2 “Design to” Construction Cost Limitation (CCL): The estimated maximum value of the Construction Contract at award (i.e., Project Cost less SIOH (Supervision, Inspection and Overhead), less Contingency, less A-E Post-Award Construction Services (PCAS), and less any other fees and/or costs that the PM identifies that are part of the total project cost but occur outside the construction contract). Cost limitations and contract bid items must be established in accordance with Reference 2.1.8 (FC) 1-300-09N. Each design project accomplished under this contract will be assigned funds for construction which will be designated in the design criteria documents.
NOTE: The A-E firm’s responsibility to design within the funding limitation for each project accomplished under this contract is established by the applicable Federal Acquisition Regulation (FAR) clause(s) that are included in the respective project T.O.
a. Notify the NSWCPD KO and DM/PM in writing when it becomes evident that the CCL will be exceeded. AUTHORITY TO PROCEED WITH A DESIGN/RFP AT A COST IN EXCESS OF THE “DESIGN-TO” CCL REQUIRES A CONTRACT MODIFICATION.
b. Analyze “excessively high” and/or “excessively low” bids received during the construction-contract-award phase of projects covered under this contract. If errors are found, submit a revised government cost estimate with an explanation for any changes.
3.10.3 Ceiling Price: For contracts that are executed using Early Contractor Involvement (ECI), this is the maximum award price stated in the construction solicitation documents, essentially the same as CCL.
3.10.4 Base Bid Goal: During the conceptual development with NSWCPD discuss design alternatives and identify potential bid items that would establish a base bid for a functionally complete and usable facility. This may be accomplished via a Base Bid at less than 100% of “Design to” CCL plus Additive or Option items. If this format is used, the target percentage will be identified for the respective T.O. Another approach is to identify 100% of requirements and additive/optional items in the Base Bid, and list Deductive Bid Items through which a reduction in scope is accomplished. As part of the Preliminary Design Development Submittal, identify proposed bid items and any design alternatives to reduce costs (indicate which ones have NSWCPD concurrence).
3.11 A-E SERVICES (GENERAL): Perform all A-E Services that are required under this contract in accordance with Reference 2.1.8 (FC) 1-300-09N. In addition, References 2.1.9 through 2.1.13 provide additional guidance and information related to the Design and Engineering Services required by this contract. References and/or attachments that are specific to a project will be provided with the respective T.O. NOTE: The guidance provided by the Draft UFCs listed in Reference 2.1.8 (FC) 1-300-09N and Reference 2.1.10 All Applicable UFCs applies to all projects under the cognizance of NSWCPD and are applicable for all T.O.s issued under this contract.
3.11.1 Responsibility of the A-E Firm:
a. The A-E firm is responsible for all designs/DB RFPs, drawings, specifications, and other services to be provided under this contract in accordance with the applicable FAR clause(s).
b. Members of the design team assigned to any T.O. must meet the professional requirements identified by discipline in the Whole Building Design Guide. In general, this document and subsequent T.O.s will directly refer to individual discipline qualifications when a project requires explicit and particular emphasis.
c. A corporate member of the principal A-E firm must sign every drawing in the space marked "Submitted by" located in the title block. This is required in addition to professional registration stamps.
d. Immediately upon award, apply for all the necessary passes and identification badges for A-E personnel and vehicles to enter military areas in accordance with the latest applicable requirements.
3.11.2 Design-Bid-Build or Design-Build Request for Proposal Contract Documents:
a. Design-Bid-Build (DBB): For DBB projects, prepare a completely designed construction package consisting of full plans, specifications, detailed cost estimate, and other services as requested by the respective T.O. SAES.
b. Design-Build (DB): For DB projects, prepare a DB Request for Proposal (RFP) requirements package consisting of preliminary design information and project requirements that the Construction Contractor will use as the basis for final design development and construction. A detailed cost estimate and other services as requested by the respective T.O. SAES must also be provided.
c. Early Contractor Involvement (ECI): ECI on a project involves the selection and participation of a Construction Contractor during the early stages of the design process. The selection of the Construction Contractor is made using Best Value processes. A preliminary award is made to provide preconstruction services as part of the Design Team, and the construction effort will be an option which may be exercised at the completion of the design effort.
1) Design Office Liaison (DOL): The Construction Contractor must appoint a liaison, referred to as the DOL, who will interact with the Design Team throughout design development. The A-E must provide work space for the DOL. Each T.O. issued for ECI execution will identify whether the DOL will be co-located with the A-E, or temporary space must be provided for a stipulated minimum number of hours per week during the life of the design. Specifics must be jointly determined between the A-E and the DOL regarding amenities.
2) Design Consultation: Collaborate with the DOL to make a recommendation to the Government regarding the appropriate level of design for exercising the construction option, including definition of the level of design required for each discipline, before the construction option can be exercised.
