(B) Shall require the size of the sample to be that required by sampling procedures specified in the contract for the quantity of supplies on which warranty action is proposed;

(C) May project warranty sampling results over supplies in the same shipment or other supplies contained in other shipments even though all of such supplies are not present at the point of reinspection; provided, that the supplies remaining are reasonably representative of the quantity on which warranty action is proposed; and

(D) Need not use the same lot size as on original inspection or reconstitute the original inspection lots.

(ii) Within a reasonable time after notice of any breach of the warranties specified in paragraph (b)(1) of this clause, the Contracting Officer may exercise one or more of the following options:

(A) Fails to make redelivery of the corrected or replaced supplies within the time established for their return; or

(B) Fails either to accept return of the nonconforming supplies or fails to make progress after their return to correct or replace them so as to endanger performance of the delivery schedule, and in either of these circumstances does not cure such failure within a period of 10 days (or such longer period as the Contracting Officer may authorize in writing) after receipt of notice from the Contracting Officer specifying such failure.

6. The following changes apply to PD-L01:

PD-L01 PROPOSAL PREPARATION REQUIREMENT (JUL 2007)

It is requested that offerors prepare their proposals in accordance with the following organization, content and format requirements to assist the government in making a complete and thorough evaluation of all proposals. Proposals shall be submitted as two separate documents, as follows:

DocumentsOriginal Copies
Solicitation, Offer and Award Document (SF-33) 11
Technical and Price Proposal12

The “originals” shall be clearly identified as the “ORIGINAL”, and bear the original signature(s) of the offeror. The “copies” shall be complete and clearly identified as “COPY” or “DUPLICATE”. The proposal documents SHALL NOT be embellished with any cover or binding. The three copies of the technical proposal shall be printed double-sided.

In order to facilitate the evaluation process, it is requested that offerors also submit their price proposal spreadsheets on a CD-ROM (in addition to the hard copy requirements stated above). It is requested that spreadsheet files be compatible with Microsoft Windows 7, Microsoft Office Excel 2003, and Microsoft Office 2007. The submission of spreadsheet files on compact disk in no way relinquishes the offeror's responsibility to provide hard copies of the technical and cost proposals.

(1) SOLICITATION, OFFER AND AWARD DOCUMENTS (SF-33 RFP)

This document, which may be used as part of the contract award document, shall be fully executed and returned as a separate document from the technical and cost proposals. Special attention should be taken to accurately enter the costs required in Section B, complete all Representations and Certifications as instructed in Section K and ensure that an authorized person signs the offer in Block 17 of Page 1.

If the offeror makes any exceptions to any provisions in the RFP, all such qualifications shall be listed in a cover letter to the proposal. Exceptions may also be annotated on the Solicitation, Offer and Award document, if such annotation is necessary to clarify the exceptions.

(2) TECHNICAL PROPOSAL

The technical proposal should be written so that management and engineering oriented personnel can make a thorough evaluation and arrive at a sound determination as to whether the proposal meets the requirements of this solicitation. To this end, the technical proposal shall be specific, detailed, and complete as to clearly and fully demonstrate that the prospective contractor has a thorough understanding of the technical requirements contained in Section C, Specifications of this Solicitation.

Statements such as "the offeror understands," "will comply with the statement of work," "standard procedures will be employed," "well known techniques will be used" and general paraphrasing of the statement of work are considered inadequate. The technical proposal must provide details concerning what the contractor will do and how it will be done. This includes a full explanation of the techniques, disciplines, and procedures proposed to be followed.

The technical proposal shall not contain any reference to price; however, information concerning labor allocations and categories, travel, materials, equipment and any information of interest to technical reviewers, as applicable, shall be contained in the technical proposal in sufficient detail so that the offeror's understanding of the scope of the work and ability to meet requirements may be adequately evaluated. The technical proposal shall be page numbered, contain a table of contents, be organized in the order specified for technical factors below, and shall address in detail the information identified below.

It is noted that the entire technical proposal shall not exceed FORTY PAGES (40) in length.

SECTION 1 - INTRODUCTION (Maximum length: 5 pages)

This section shall provide any necessary background information and an overview of the proposal which the offeror believes will assist in the understanding and accurate evaluation of the proposal.

SECTION 2 – TECHNICAL PROPOSAL (Maximum length: 30 pages)

The offeror’s proposal shall contain a Technical Proposal along with their Price Proposal. The technical proposal shall not contain any pricing information. The offeror shall submit (2) copies of the technical proposal. The Technical Proposal shall contain sufficient information to enable Government personnel to make a thorough evaluation and arrive at a sound determination as to whether or not the technical proposal demonstrates the offeror’s ability to understand and comply with the solicitation’s requirements. Statements which paraphrase the specifications or attest that “standard procedures will be employed” will be considered inadequate in demonstrating the offeror’s actual capability of meeting the specification requirements. At a minimum, the offeror’s Technical Proposal must clearly address, with narratives, drawings, charts, schematics, etc., the following technical subfactors:

1. Design and Performance Characteristics: Offerors shall provide documentation which clearly demonstrates that their proposed design and performance characteristics are in accordance with the Government’s specifications cited in Section C. This may include a narrative description, drawings, schematics, etc. Proposals will be evaluated on how well the design and performance characteristics of the proposed solution meet each of the characteristics required by each system. Also, any proposed designs that offer commonality of parts among the sections will be rated higher than those designs that offer to simply meet the standards set in the specification. In addition, the proposal’s perceived level of risk, and strategies to manage the risk will be assessed, affecting the proposal’s evaluation.

2. Corporate Experience/Resources: Offerors shall clearly demonstrate their corporate experience in providing equipment that is the same or similar to the requirement cited in Section C of the Solicitation. Offerors shall also describe their intended manufacturing and production processes, facilities, equipment, and other company resources that are applicable to the production of this requirement. The proposal will be evaluated on the merit of the offeror’s company profile and facilities. Manufacturing, production, technical equipment, and other company resources will be evaluated. The offeror shall also be evaluated on their previous experience with production of the Ruggedized Marine Hardware Systems.

3. Logistical Support: Offerors shall demonstrate their ability and support plan to provide post-award logistical support for the proposed equipment. The ability to sustain repair and provide replacement parts will be evaluated. Recommended spare parts must be provided. Average monetary value of parts stocked must be provided.

4. Total Ownership Cost: Offerors shall provide their estimate of the total ownership cost to the Navy, including mean time between failures, of the proposed systems. This basis of this estimate shall also be provided and this information will be considered and evaluated in the Navy’s assessment of the projected total cost of ownership for the lifecycle of the proposed systems. A higher rating will be given to proposals with the lower evaluated total ownership cost.

SECTION 3 – PAST PERFORMANCE (Maximum length: 5 pages)

Offerors shall submit Past Performance information that includes details about the offeror and proposed subcontractors, if applicable, past performance according to the following instructions:

Offerors shall submit Past Performance Evaluation Data forms for recent contracts and/or subcontracts, awarded for identical or similar supplies, completed within the last five (5) years, and identify in specific detail for each why or how you consider that effort relevant or similar to the effort required by this solicitation. Contracts listed may include those entered into with the Federal Government, agencies of state and local governments, and commercial customers. Offerors that are newly formed entities without prior contracts should list contracts and subcontracts as required above for all critical personnel. The offeror(s) shall use the remarks block to provide information on problems (show cause, cure notice, termination for delinquency, quality issues, defective pricing issues, etc.) encountered on these contracts and corrective actions taken to resolve those problems. The Government will collect information from references provided by the offeror(s) in regard to its past performance. The Government may contact references other than those identified by the offeror(s) and the information received will be used in the evaluation of the offeror’s past performance.

Offerors must provide the information requested for performance risk evaluation, or affirmatively state that it possesses no directly related or similar past performance. Firms lacking relevant past performance shall receive a neutral evaluation for performance risk. Evaluation of past performance will be as objective as possible based on consideration of all relevant facts and circumstances. The Government will focus on information that demonstrates quality or performance relative to the size and complexity of the procurement under consideration. The following elements should be addressed in narrative form:

Quality of Product and Processes - Offerors should describe past compliance with contract requirements, accuracy of reports, appropriateness of personnel, technical excellence.

Timeliness of Performance - Offerors should detail how it met interim milestones, provided reliable delivery, was responsive to technical direction, and completed work on time.

Customer Satisfaction - Offerors should describe satisfaction of customers with the contractor’s service and product.

Notices of Violations - The Offerors shall answer the following question in regards to their previous history: “Has your facility received any notices of violation or similar action, issued by a local, state or federal environmental or safety regulatory agency for violation of the Clean Air Act, Clean Water Act, Resource Conservation and Recovery Act (RCRA), Superfund Amendment Reauthorization Act (SARA), Safe Drinking Water Act, Toxic Substance Control Act (TSCA), Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) or Occupation Safety and Health Act (OSHA) during the previous 24 months?” If the answer to this question is yes, then describe any notices of violation including resolution of the violation.

SECTION 4 – PRICE

Offerors shall provide separate price information containing prices for each and every line item as designated in the solicitation and should ensure that all certifications and representations within Section K of the solicitation have been accurately completed. Unless exempt pursuant to FAR 19.702(b)(1), offerors shall submit a Small Business Subcontracting Plan conforming to the requirements of FAR subpart 19.7 and FAR 52.219-9. One original and two copies of the price proposal shall be submitted.

7. General Clarification:

a. The format of the warranty and spares spreadsheets is at the discretion of the individual offeror. There is no Government standard for these documents.

b. The pricing/cost data shall be included with the technical portion of your proposal, but if you would like to separate them into different volumes it will be accepted.

8. All other terms of the solicitation remain the same.
