BASIS FOR AWARD: Reference 52.212-2, Evaluation -- Commercial Items (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor I: Price Factor II: Technical Acceptability Factor III: Past Performance

Price - Received quotes will first be ranked and arranged by price (lowest first) before the Government assesses technical capability. Offers will be evaluated based on total price. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise option(s). Price quotes will be evaluated in accordance with FAR 13.106-3(a). The Government may evaluate any and all information submitted by the vendor to support the reasonableness of prices proposed. The method of evaluation used by the Contracting Officer is solely within the discretion of the Contracting Officer.

Technical - All offerors must provide specific evidence that they are capable of fulfilling the requirement. Specific evidence must reflect a thorough understanding of the PWS and describe how the offeror will fulfill requirements of the PWS. Technical submissions will be evaluated by a technical evaluation team and receive a rating IAW Table A-1 (as provided below). Documents submitted in response to this solicitation must be fully responsive to and consistent with the following (if applicable): (1) Requirements of the solicitation; (2) Performance Work Statement (PWS); and (3) government standards and regulations pertaining to this requirement.

Table A-1. Technical Acceptable/Unacceptable Ratings

Rating
Description
Acceptable
Quote clearly meets the minimum requirements of the solicitation.
Unacceptable
Quote does not clearly meet the minimum requirements of the solicitation.

Past Performance – Past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in table A-2.

Table A-2. Past Performance Evaluation Ratings

Rating
Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.

The government will evaluate the quality and extent of offeror’s performance deemed relevant to the requirements of this solicitation. The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition. The government will use information submitted by the offeror and other sources such as other Federal Government offices and commercial sources, to assess performance. Offerors must provide a list of no less than three (3), of the most relevant contracts performed for Federal agencies and commercial customers within the last five (5) years. Relevant contracts include present/past performance efforts which involved much of the magnitude of effort and complexities this solicitation requires.

Evaluation Summary - If the lowest priced offer is determined to be acceptable for both technical and past performance that offer represents the best value for the Government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers. If the lowest priced offeror is not judged technically acceptable or has unacceptable past performance the next lowest priced offeror will be evaluated and the process will continue (in order by price) until an offeror is determined to be acceptable for both technical and past performance, or until all offerors are evaluated.

Technical and past performances, when combined, are EQUAL when compared to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Table A-3. Past Performance Evaluation Ratings

Relevancy
The agency will evaluate offerors’ past performance to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired. In establishing what is relevant for this acquisition, consideration has been given to those aspects of an offerors’ contract history that give the greatest ability to measure whether the offeror will satisfy the current procurement. Evaluation aspects of relevancy will include similarity of scope and magnitude.
Scope
Experience in the areas defined in the SOW
Magnitude
The measure of the similarity of the dollar value of actually performed work that exists between the PWS and the offerors’ references. Magnitude will be evaluated on the dollar amount of work actually performed under the contract(s) during the relevant three-year period established by the solicitation.

Note: Offerors lacking relevant past performance history or for whom information on past performance is not available will not be evaluated favorable or unfavorable on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” If the Contracting Officer determines that a vendor’s Past Performance is “unacceptable,” that vendor’s entire submittal will no longer be considered for further competition or award. Evaluation will focus only on work experience already performed. Work yet-to-be performed, and work prior to the last 3 years, will not be considered. In addition, performance data will only be assessed for those references demonstrating at least 1 year of completed performance prior to the closing date of the solicitation. Based on the information provided as well as any other information obtained as previously explained in this section, the Government will evaluate each offeror’s Past Performance submission as acceptable or unacceptable.
