About this file
This is a Justification and Approval (J&A) document for use of other than full and open competition issued by Naval Facilities Engineering Systems Command (NAVFAC) Pacific.
NAVFAC Pacific seeks to award a sole source modification under the Navy Expeditionary Forces Regional Services Contract II (NEFRSC II), contract number N62742-25-C-3570, to provide support services in Sasebo, Japan for the 30th Naval Construction Regiment (30NCR). The services support three Seabee troop labor construction projects: P-357U Operational Storage Pads, P-358U Battery Container Pad, and P-359U Weapons Assembly Pad. Required services include IT support and management (Annex 0304010), supply and material management services (Annex 1000000), and transportation (Annex 1700000). Specific services encompass IT services, construction material procurement, storage and laydown requirements, porta-john and dumpster services, material logistics management, and construction equipment rentals. The period of performance spans approximately nine months across Option Period 01 (January–December 2026) with FY26 UMMC funding and Option Period 02 (January–December 2027) with FY27 UMMC funding, with services anticipated to start 30 days from Notice to Proceed and complete in March 2027.
The justification for sole source procurement authority derives from Title 10 U.S.C. 3204(a)(2) citing unusual and compelling urgency. Seabee construction must commence by July 31, 2026, and achieve full operational capability by March 2027 to support critical naval assets and maintain regional and national security, particularly within INDOPACOM's area of responsibility. The condensed timeline precludes full and open competition; the primary alternative source, Defense Logistics Agency (DLA), ceased accepting material orders on May 8, 2026, due to Prime Vendor changes with no operational timeline for the new contractor. The NEFRSC II contractor has demonstrated satisfactory performance on similar services in comparable geographic regions, though the proposed modification extends geographic scope beyond the contract's original South Asia, Southeast Asia, and Oceania limitation to include East Asia. Cost analysis will employ FAR 15.404-1(c)(2) techniques including cost data review, comparison to historical estimates, and validation against the independent government cost estimate. The approved J&A was signed by the Chief of Contracting on June 18, 2026.

JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity. The contracting activity is Naval Facilities Engineering Systems Command (NAVFAC), Pacific.
2. Description of the Action Being Approved. This replaces the justification approved on 21 May 2026 based on the revised scope of work registered to NAVFAC Pacific from the 30th
Naval Construction Regiment (30NCR). This justification is for the award of a sole source modification to provide services in Sasebo, Japan under contract number N62742-25-C-3570 Navy Expeditionary Forces Regional Services Contract II (NEFRSC II) in accordance with the following Performance Work Statement Annexes.
Annex 0304010 IT Support and Management Annex 1000000 Supply and Material Management Services Annex 1700000 Transportation
3. Description of Supplies/Services. The proposed acquisition is to provide services for 30NCR in support of three Seabee troop labor projects in Sasebo, Japan: P-357U Operational Storage Pads, P-358U Battery Container Pad, P-359U Weapons Assembly Pad. The estimated value of this requirement is based on the independent government estimate developed by 30NCR. A total of in UMMC funds is available for this requirement; funds are split as follows: FY26 UMMC funds in the amount of for services in Option Period 01 and FY27 UMMC funds in the amount of for services in Option Period 02. Required services include IT services, construction material procurement, storage/laydown requirements, porta-john and dumpster services, material logistics management, and construction equipment rentals. The period of performance is approximately 9 months and spans between Option Period 01 (January 2026 through December 2026) and Option Period 02 (January 2027 through December 2027). Services are anticipated to start 30 days from Notice to Proceed and complete in March 2027.
4. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is Title 10 U.S.C. 3204(a)(2), Unusual and compelling urgency.
5. Rationale Justifying Use of Cited Statutory Authority. Seabee troop labor construction of projects P-357U, P-358U & P-359U must start by 31 July 2026 and reach full operational capability by the mission need date of March 2027. These projects are to support critical naval assets. Mission operations are contingent on these assets being in-place. Failure to achieve this mission need date will compromise both regional and national security in this contentious area, jeopardize the safety and security of U.S. assets including U.S. military and civilian personnel, as well as established partnering agreements with the Host Nation with potential

for negative impacts to critical posture requirements within INDOPACOM’s area of responsibility.
Services provided on the NEFRSC II are urgently needed to ensure Seabee execution remains on schedule. The NEFRSC II provides an established contract vehicle with a prime contractor that has been consistently providing similar services at a satisfactory level or better to the Seabees in similar geographical locations. The proposed modification is within the scope of the NEFRSC II in all regards (e.g. performance work statement, supported command, period of performance, estimated contract value, etc.) except that it is outside the geographical area of performance. The NEFRSC II geographical area is limited to South Asia, Southeast Asia, and Oceania; however, it is reasonably anticipated that the Seabees would require the same or similar services in East Asia.
The condensed timeline derived from the extreme urgency of this requirement does not allow NAVFAC Pacific sufficient time to utilize full and open competition. The Defense Logistics Agency (DLA) was the primary option to fulfill this requirement however they stopped accepting material orders on 08 May 2026 due to a change in their Prime Vendor, and they could not provide a timeline for when the new contractor would be operational. DLA’s late notification of its inability to meet this requirement was unanticipated and beyond NAVFAC Pacific control.
The urgency was not due to the lack of advanced planning. Standard competitive acquisition timelines would result in severe, unacceptable delays, causing serious injury to posture initiative and strategic interests of the United States.
The contracting officer will use cost analysis techniques and procedures in accordance with FAR 15.404-1(c)(2) to ensure a fair and reasonable price is established for the services covered by this J&A. Techniques will include a review and verification of cost data and evaluation of cost elements, comparison to actual costs incurred and historical cost estimates by the same contractor for same or similar services, and comparison to the independent Government cost estimate.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
For the reasons set forth in Paragraph 5, NAVFAC Pacific did not post a synopsis of the proposed procurement in accordance with FAR 5.202 Exceptions(a)(2) as the Government would be seriously injured if required to follow the time periods specified in FAR 5.203. The approved J&A will be released in accordance with FAR 6.305(b).
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVFAC Pacific has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Pacific will assess whether competition for future requirements is feasible.
