About this file

This document is a Limited Source Justification (LSJ) for a federal supply schedule order issued by the Department of the Navy, Naval Facilities Engineering Systems Command (NAVFAC) Pacific.

The requirement is to acquire furniture reconfiguration and upgrade services for Building 57, including the installation of 9 additional cubicles, 1 small meeting area, and the upgrade of existing furniture in 24 cubicles, 8 offices, and 2 conference rooms. The estimated cost is and the period of performance is August 2024 to June 2025. The government is restricting consideration to a single source, Contract Furnishers of Hawaii Inc. GSA - LIMITED SOURCE JUSTIFICATION FOR FSS ORDER

LSJ# F24-

Rev 07/22/2022 SOURCE SELECTION INFORMATION – SEE FAR 2.101 and 3.104

Enclosures: (01) Market Research Sources dated 03 July 2024

(02) Contract Furnishers of Hawaii Inc. MAS 47QSMA24D08N9 dated 02 July

1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY:

This is a Limited Source Justification. The requiring activity is Department of the Navy, Naval Facilities Engineering Systems Command (NAVFAC) Pacific; the contracting activity is ACQ21 Services.

2. NATURE/DESCRIPTION OF CONTRACT ACTION:

This acquisition is conducted under the authority of the Multiple Award Schedule Program (Title 41 U.S.C. 152 (3) and Title 40 U.S.C. 501, Services for Executive Agencies). This is a limited source action to be awarded as a new Federal Supply Schedule order for supplies and services identified in paragraph 3 below. The placement of a firm, fixed price order is anticipated.

3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES:

It is intended to acquire the following in Building 57: reconfiguration of the layout to include nine (9) additional cubicles and one (1) small meeting area, with accompanying new furniture;

and the upgrade of existing furniture in twenty-four (24) cubicles, eight (8) offices, and two (2) conference rooms.

The Government estimated cost for this contract is and the period of performance for this contract is 01 August 2024 to 30 June 2025.

4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR

DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:

The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-1 or 8.405-2 is 41 U.S.C. 251, as implemented by FAR 8.405-6.

The justification for limiting sources is because the item is peculiar to one manufacturer and will be ordered under an existing order.

The proposed requirement is to acquire the following in Building 57: reconfiguration of the layout to include nine (9) additional cubicles and one (1) small meeting area, with accompanying new furniture; and the upgrade of existing furniture in twenty-four (24) cubicles, eight (8) offices, and two (2) conference rooms. The Contractor will inventory the existing furniture;

dismantle the existing furniture; store the furniture and dismantled parts to be reused; order new product to be installed; and discard any unused parts and trash. The existing Herman Miller furniture shall be dismantled by an authorized factory-trained technician or an authorized dealer

Rev 07/22/2022 SOURCE SELECTION INFORMATION – SEE FAR 2.101 and 3.104 installer to maintain warranty coverage for the products. The dismantling of the existing Herman Miller furniture must be performed by an authorized factory-trained technician or an authorized dealer installer to maintain warranty coverage for the products. Contract Furnishers of Hawaii Inc (dba Office Pavilion) is the only Herman Miller Certified Dealer in Hawaii.

Additionally, NAVFAC Pacific seeks to purchase Herman Miller components in order to standardize the existing workstations within the Building 57 workspaces. To keep in line with current budgetary constraints NAVFAC Pacific will benefit from the cost-savings of reusing existing furniture, augmenting any reconfiguration and repair work by going to the same source of the original acquisition.

5. DETERMINATION OF THE BEST VALUE:

GSA has determined the prices of Contract Furnishers of Hawaii Inc.’s (dba Office Pavilion) Herman Miller office furniture and its rates for incidental services offered at hourly rates to be fair and reasonable for the purpose of establishing the schedule contract under GSA Multiple Award Schedule (MAS) 47QSMA24D08N9. However, ordering activities are responsible to make a separate determination of fair and reasonable pricing for individual orders. Per FAR

8.404 (d) DEVIATION 2014-O0011, the NAVFAC Pacific ACQ21 Contracting Officer will determine, using the procedures in FAR 15.404-1, that the prices are fair and reasonable and will document such determination with a level of detail commensurate with the complexity and circumstances of each order.

6. DESCRIPTION OF MARKET RESEARCH:

The requiring activity and contracting activity have conducted market research among schedule holders. Searches were conducted on the websites of AbilityOne, UNICOR, GSA, Dynamic Small Business Search (DSBS), Google, and Herman Miller.

AbilityOne had no results for a search of products using keyword “furniture” or services under Furniture Design, Configuration, and Installation.

UNICOR’s catalog for office furniture did not include Herman Miller products.

GSA was searched using Herman Miller items for the requirement, all of which showed availability from only one (1) or two (2) sources including Millerknoll Inc. MAS GS-

03F-036DA.

o A contractor/manufacturer search was then conducted for Herman Miller, which resulted in two (2) MAS, one of which was Millerknoll Inc. MAS GS-03F-

036DA.

o As the only authorized dealer of Herman Miller furniture in Hawaii, Contract Furnishers of Hawaii Inc. was also searched and resulted in MAS

47QSMA24D08N9, see Enclosure (2). Within that MAS, Millerknoll Inc. MAS GS-03F-036DA was listed as a participating manufacturer.

DSBS was searched resulting in two (2) small businesses, of which Contract Furnishers of Hawaii Inc. (dba Office Pavilion) is the only authorized dealer of Herman Miller furniture in Hawaii.

Google was searched for Herman Miller Hawaii and also resulted in Office Pavilion Hawaii.

Herman Miller’s website listed Office Pavilion/Contract Furnishers of Hawaii as their only certified dealer in Hawaii.

The requiring activity certifies that the requirement can be met by a commercial item and provides supporting documentation which is attached, see Enclosures (1) and (2).
