About this file

This notice provides answers to questions from potential offerors on solicitation number N62742-21-R-1319 from the Naval Facilities Engineering Command Pacific for the design-build renovation and modernization of Berth 2 at Naval Base Guam. Key details include that the scope of work involves constructing a new sheet pile and king pile bulkhead system, mooring dolphin, cleats and bollards, and filling the area behind the new bulkhead with a cement and soil mix. The project will also perform construction dredging to the required depth at Berth 2. The notice confirms that a cement deep soil mixing project and a 2020 VETS-4212 report can meet experience requirements, and clarifies that pricing should not be included with the initial phase one proposal which covers non-price evaluation factors only. The Defense Base Act applies to certain worker classes per Waiver 2020-01. The final proposal submission deadline is August 5, 2021.

PRE-PROPOSAL QUESTIONS & ANSWERS

FY22 MCON P-519, X-RAY WHARF IMPROVEMENTS (BERTH 2), NAVAL BASE

GUAM, GUAM

NOTE: The following questions and answers are provided for INFORMATION ONLY. The RFP remains unchanged unless it is amended in writing on a Standard Form 30.

1. Document 00202, Relevant Construction Project item (3). Will the Government also consider installation of stone columns as a relevant construction project under soil/ground improvement? Please advise.

ANSWER: No.

2. Document 00100 Instruction to Proposers Item 1.2.b. Document 00100 Instruction to Proposers item 1.2.b. states, “…An electronic copy of the price and non-price proposal shall be submitted in .pdf format on a CD-ROM with the paper copy of the subcontracting plan.” Please confirm if a compiled PDF Format of the Phase-One Proposal will also be submitted with the Phase-One Proposal original paper copy

ANSWER: An amendment will be issued to indicate submission with the phase-one proposal.

3. Document 00202, Relevant Construction Project item (3). Will the Government consider a project of which only the Cement Deep Soil Mixing (CDSM) portion of the work is 100% complete, accompanied with a signed Past Performance Questionnaire from the Owner? Please advise if this will be considered relevant under the Soil/Ground Improvement Project.

ANSWER: Yes.

4. If an Offeror typically submits the annual VETS-4212 Report in early August, it may not receive the email confirmation of receipt notification of successful submission of the VETS-4212 for its 2021 report prior to the RFP proposal submission date of August 5, 2021.

Please confirm if the Offeror can submit the email confirmation of receipt notification of successful submission of the VETS-4212 for its 2020 report if it does not receive the confirmation of receipt notification of successful submission of the VETS-4212 for 2021 by the RFP proposal submission date.

ANSWER: Confirmed.

5. 1.77 FAR 52.228-3, WORKERS’ COMPENSATION INSURANCE (DEFENSE BASE

ACT) (JUL 2014). Please confirm that Guam is exempted for the Worker’s Compensation Insurance (Defense Base Act) (Jul 2014) since Guam is a territory of the United States.

ANSWER: The Defense Base Act applies to certain classes of workers. See Waiver 2020-01 dated 6 May 2020.

6. Section 00100, paragraph 1.5 a. states: “The offeror shall submit a document that appoints, in writing, one or more individuals, by name, each of whom will have full and independent authority to bind the offeror with respect to any act connected with this solicitation, including but not limited to: the submission and revisions of a proposal or proposals by the company, the conduct of discussion or negotiations, the submission of a Final Proposal Revision (FPR), and the execution of a contract and associated documents including bonds. Documents of appointment by a supporting resolution of the board of directors in the case of a corporation and by an instrument of similarly binding character in the case of an unincorporated entity.”

Section 00100, paragraph 1.6 b. states: “The proposal and each bond or other document submitted by or on behalf of the joint venture shall be executed by each joint venture partner and shall be accompanied by evidence of the authority of the signer. That authority shall be evidenced by a document satisfactory to the Contracting Officer, which would ordinarily be, in the case of a corporate joint venture partner, a certified copy of a resolution of the board of directors, and in the case of an unincorporated joint venture partner, an instrument of similarly binding character duly executed by that entity.”

Please confirm that per Section 00100, paragraph 1.5 a., it is acceptable for a joint venture offeror that has a Limited Power of Attorney document executed by all joint venture partners that designates one or more individuals with full and independent authority to bind the joint venture, to only have one of the designated individuals sign the joint venture’s proposal and each bond or other document submitted on behalf of the joint venture. This has been the acceptable practice for all previous RFP proposal submissions.

Paragraph 1.6 b. seems to indicate that each joint venture partner shall execute the proposal and each bond or other document submitted by or on behalf of the joint venture. We just want to confirm that the instructions of paragraph 1.5 a. allow for a single signature of individual duly authorized by the joint venture to execute the proposal and each bond or other document submitted by the joint venture versus having multiple individuals each representing one of the joint venture partners sign the documents.

ANSWER: If authorized, a single person may sign for each joint venture partner, e.g., John Doe, ABC Company and John Doe, XYZ Company.

7. Document 00100, paragraph 1.2 a. states: “An original paper and three (3) paper copy of the price proposal shall be submitted on 5 August 2021, 2:00 p.m., H.S.T. in a sealed envelope and marked in the bottom right corner "PHASE-ONE PROPOSAL

SUBMITTED UNDER RFP N62742-21-R-1319 - DO NOT OPEN IN MAILROOM”.

Please confirm that the “price proposal” is not included with the PHASE-ONE PROPOSAL. Per the RFP documents, the PHASE-ONE PROPOSAL includes Non-Price Evaluation Factors 1, 2 and 3 only.

ANSWER: Confirmed. An amendment will be issued for clarification.

8. In Document 00202, Factor 2 – Experience, under “Relevant Construction Project”, it lists the following approximate dollar values for the four (4) types of projects:

(1) $25M

(2) $10M

(3) $7M

(4) $5M

Please confirm the dollar values shown represent the Construction Project Final Price approximate dollar value.

9. In Document 00202, Factor 2 – Experience, under “Relevant Design Project”, it lists the following approximate dollar values for the three (3) types of projects:

(1) $20M

(2) $10M

(3) $10M

Please confirm the dollar values shown represent the Construction Project Final Price approximate dollar value.
