In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
A copy of the blank Past Performance Questionnaire to be used for requesting client references is included as Attachment JL-2.
Notes for Factor A:
(1) Past performance relates to how well a contractor has performed.
(2) Definition of “recent relevant project” is as follows:
In order to be considered recent, a project must have involved work performed within the five (5) years preceding the issuance date of this solicitation. In order to be considered relevant, a project must generally be sufficiently similar to the current acquisition to provide indicators of expected performance. For example, relevancy may be established by: similar product or service type, product or service complexity, contract type, contract dollar value, and contract location. Past performance, to be considered relevant, also needs to demonstrate a past performance effort in performance that lasted at least six (6) months.
(3) This source selection requires a greater level of discrimination within the past performance evaluation, therefore, the relevancy ratings in the following table shall be used:
Table 1. Past Performance Relevancy Rating Method Adjectival Rating Definition
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
Performance Confidence Assessment. In conducting a performance confidence assessment, each offeror shall be assigned one of the ratings in the table below.
Table 2. Performance Confidence Assessments
Rating Description
Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Unknown Confidence (Neutral) No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or for whom information on past performance is so sparse that no meaningful past performance rating can be reasonable assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
(4) Projects must be stand-alone contracts or task orders, performed within the past five (5) years preceding the issuance date of this solicitation, which demonstrate the Offeror’s ability to perform the proposed effort. The submission of information on a basic IDIQ contract will not be considered. The Offeror must demonstrate in its proposal how a project is relevant to this acquisition.
(5) The term “Offeror” typically refers to a single corporation submitting a proposal either as a prime contractor or a joint venture composed of multiple organizations submitting a proposal with joint-venture partners.
For this solicitation, Offeror also refers to members of its teaming entity. Thus, “Offeror” may refer to other legal entities -- joint ventures (JV), Limited Partnerships (LTD), and Limited Liability Companies (LLC). In its evaluation of past performance, the Government’s evaluation will primarily focus on the entities submitting the proposal (single corporation, individual joint venture partners, the LTD, or the LLC).
(6) Entities with a demonstrated history of working successfully together on prior projects may be considered more favorably than those without such history.
(7) If an Offeror is utilizing past performance information of affiliates/subsidiaries/parent/LLC/LTD member companies (name not exactly as stated on the SF33), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent/LLC/LTD member companies will have meaningful involvement in the performance of the contract in order for the past performance information of the affiliate/subsidiary/parent/LLC/LTD member companies to be considered. The proposal shall state the specific resources (e.g., workforce, management, facilities, or other resources) that the affiliate/subsidiary/parent/LLC/LTD member companies will commit towards the performance of this contract.
(8) While a subcontractor’s past performance may be considered, it will not be given the same level of consideration as either a prime Contractor or a joint venture partner because there is no direct legal relationship between the Government and the subcontractor. The Government will consider the past performance of a subcontractor where the prime Contractor provides, in its proposal, evidence of a binding teaming agreement or other contractual agreement which creates legal responsibility on the part of the subcontractor. However, the level of consideration will depend on the extent to which the proposal demonstrates the subcontractor’s commitment to the project and legal accountability.
(9) The Offeror will not be rated favorably or unfavorably for Factor A, Past Performance, if the Offeror does not have a record of relevant past performance or if a record of past performance is unavailable. In such a case, the Offeror will receive a “Unknown Confidence (Neutral)” rating. However, an Offeror with a favorable relevant past performance may be considered more favorably than an Offeror with no past performance information.
Factor B, Safety:
The Offeror shall submit the following information: (For a partnership or joint venture, the following submittal requirements are required for each contractor who is part of the partnership or joint venture; however, only one safety narrative is required. EMR, DART and TRC Rates shall not be submitted for subcontractors.)
(1) Experience Modification Rate (EMR): Include three previous complete calendar years’ (2015, 2016, 2017) worth of data. This rate compares company’s annual losses in insurance claims against its policy premiums. The offeror may submit an insurance company-provided equivalent rate if no EMR exists. If the offeror has no EMR or premium, for any year, affirmatively state so and explain why. Any extenuating circumstances that affect the EMR and negative trends should be addressed as part of the factor submission.
(2) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate and Total Recordable Case (TRC) Rate: Submit three previous complete calendar years’ (2015, 2016, 2017) worth of data. If an offeror cannot submit an OSHA DART and TRC rates, for any year, affirmatively state so and an explanation must be provided.
Any extenuating circumstances that affected the OSHA, DART, and TRC rate data negatively must be addressed as part of this factor submission.
(3) Technical Approach for Safety: Describe the plan for safety that will be implemented to evaluate safety performance of potential subcontractors as part of the selection process for all levels of subcontractors. The offeror shall submit a narrative that fully describes the safety management system that they will use to oversee the safety compliance and performance of self-performed and subcontractor performed work. The offeror will describe any innovative methods that will be employed to ensure and monitor safe work practices at self-performed and/or all subcontractor levels. Additionally, the contactor will describe their methodology to execute an effective program that facilitates sound mishap prevention techniques and processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps. The technical approach for safety shall be limited to two pages.
Factor C, Management Plan / Quality Control
The Offeror shall submit a detailed management plan with emphasis on an effective organizational structure for performance of the work required. The narrative shall not exceed five (5) pages. If the Offeror submits more than five (5) pages for evaluation, the Government will evaluate the first five (5) pages and will not read and evaluate any other information that follows the first five (5) pages.
A description of the Management Plan shall include a list of Key Personnel for the following positions: Project Manager, Quality Control Manager, and Site Safety and Health Officer. Key Personnel should also be identified by name, educational level, qualifications, years of service with the company, and skills offered. See PWS Annex 0200000 for required minimum qualifications. Provide resumes and letters of intent for proposed Key Personnel.
The Offeror shall demonstrate a planned approach to effectively recruit and retain qualified Key Personnel/Managers. Provide examples of where these methods and procedures have been implemented on similar projects. Projects must follow all guidelines in Notes for Factor A in order to be considered. Offerors must notify the contracting officer in writing of any change in the availability of proposed key personnel when the change in availability occurs at any point in the procurement process. Demonstrate how the Offeror will ensure that Key Personnel will meet or exceed required qualifications at the start of contract performance.
The Management Plan shall also include: a description of the Offeror’s overall concept of operations; an explanation of any resource management strategies; a key control plan (for monitoring the location of all keys in their possession); any quality control procedures to adequately monitor and measure contract performance; include a summary organization chart showing proposed management structure with lines of management authority, supervision, span of control, and accountability, including the relationships between prime and subcontractors and Quality Control/Assurance interface. If applicable, a description of the Offeror’s plan to monitor subcontracted efforts should also be provided.
Factor D, Technical Approach:
The Offeror shall submit a narrative describing its technical approach which clearly demonstrates its understanding of and approach to accomplishing the complexity and magnitude of service requirements set forth in the performance objectives and standards of the Performance Work Statement. The narrative shall not exceed fifteen
(15) pages. If the Offeror submits more than fifteen (15) pages for evaluation, the Government will evaluate the first fifteen (15) pages and not read and evaluate any other information that follows the first fifteen (15) pages.
Offerors shall describe the staff, skills, techniques, equipment, supplies and other resources proposed to accomplish the objectives and standards detailed in the Performance Work Statement, (see Section C). The proposal will be divided/tabbed by Annex/Sub-Annex. Within each Annex/Sub-Annex, offerors shall address the required staffing, the technical approach and resources the offeror intends to utilize for executing and completing the contract technical requirements.
Offerors shall identify any risk(s) they expect to encounter under the performance objectives and standards of this solicitation and how their technical approach and contingency plans will mitigate those risk(s).
