JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. CONTRACTING ACTIVITY:
Resident Officer In-Charge of Construction (ROICC) Finegayan, Naval Facilities Engineering Command, Marianas, Guam.
2. DESCRIPTION OF THE ACTION BEING APPROVED:
Contract N62742-10-D-1308-0002, WON 852467, FY14 P-109 Aircraft Maintenance Hangar North Ramp, Andersen AFB, Guam, will specify by brand name Planit Safe A3F1HEC Surrogate Test Liquid, which will not provide for full and open competition. This justification covers the portion of this acquisition which specifies Planit Safe brand name A3F1HEC Surrogate Test Liquid which is the only known source at this time.
3. DESCRIPTION OF SUPPLIES/SERVICES:
The project will construct an aviation maintenance hangar with high bay spaces, crew and equipment spaces, and administrative spaces, utilizing building component features appropriate to Guam’s extremely demanding environment. Building mechanical systems include fire suppression, plumbing, HVAC (heating, ventilation and air conditioning) and compressed air systems. Building electrical systems include power, emergency power, lighting, telecommunications, intercommunications/ public address, grounding, lightning protection and electronic security systems. Built-in equipment shall include an elevator, overhead bridge crane and hoist, emergency generator, and aqueous film-forming foam (AFFF) system
The Government needs aqueous film forming foam (AFFF) fire suppression systems because it is required by UFC 4-211-01 and NFPA 409 to protect aircraft hangars from fuel fires. Further, per Deputy Assistant Secretary of the Navy memorandum dated 17 June 2016, release of AFFF at shoreside installations is not allowed, with the exception of emergency responses. Therefore, the NAVFAC criteria relating to the testing of AFFF fire suppression systems was revised to require the surrogate test liquid, Planit Safe A3F1HEC Surrogate Test Liquid. Consequently, Project P-109 requirement for AFFF testing will be modified to comply with this criteria change.
The estimated cost for the Planit Safe Surrogate Test Liquid is . Fiscal year 2014 military construction funds will be used to award the as part of the FY14 P-109 Aircraft Maintenance Hangar project.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION:
The statutory authority 10 U.S.C. 2304 (c)(1) – Only one responsible source and no other supplies or services will satisfy agency requirements.
5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY:
The brand name description is essential to meet the NAVFAC criteria requirements since AFFF cannot be released into the environment during testing of the AFFF system. Testing of the AFFF system is required to measure the concentration, system flow rate, and pressures at various points on the fire suppression system. The environmentally friendly alternative liquid to be used during the testing must be specifically formulated to mimic the physical properties of MIL-SPEC AFFF concentrate while having characteristics that enable its injection rate to be monitored by refractive index or conductivity measurement. The data for the concentration, system flow rate, and the various pressure points will be recorded via laptop computer in real time and displayed as, percent concentration, gallons per minute, and pounds per square inch as the test is being conducted.
Currently there is only one known manufacturer of AFFF surrogate test liquid. In the future, should another manufacturer’s product meet or exceed the NAVFAC criteria requirements, that manufacturer’s product will be given full consideration and the need for proprietary specifications will cease to exist.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS
PRACTICABLE:
In accordance with FAR 6.302-1, an announcement was published on April 11, 2017 in the Navy Electronic Commerce Online (NECO) and Federal Business Opportunities (FBO) websites seeking any and all sources that could provide a AFFF-like fire suppression liquid that can be used in the fire suppression testing for the aircraft maintenance hangar and is a non-foaming environmentally friendly test liquid for a similar project P-601, Solicitation WON 1379061, FY18 P601 AIRCRAFT MAINTENANCE HANGAR #2, JOINT REGION MARIANAS, GUAM. No responses were received for this announcement.
7. DETERMINATION OF FAIR AND REASONABLE COST:
The Government’s estimate cost of was obtained from a published price list. An independent Government Estimate will be prepared for the project, which will include the estimated value for the Planit Safe Surrogate Test Liquid. The cost of has been determined to be fair and reasonable.
8. ACTIONS TO REMOVE BARRIERS TO FUTURE COMPETITION:
Although the utilization of a brand name in this project is indicated by this J&A, each future project that includes Planit Safe Surrogate Test Liquid, outside of the one year of the approval of this J&A, will conduct the same market survey to ascertain the availability of new technology that may provide for other sources to meet the Government’s needs. Should any other offers for compatible liquids be submitted during the source selection process, the Government will consider each as applicable.
