Section M - Evaluation Factors for Award
Addendum to 52.212-2 Evaluation--Commercial Products and Commercial Services
(a) General Instructions: The Government intends to award a single firm-fixed-price contract to the responsible quoter whose quote represents the best value after evaluation in accordance with the factors in the solicitation by utilizing the tradeoff source selection process.
The Government intends to award a contract without discussions with quoters. Accordingly, each quoter should submit its most favorable terms from a price and non-price standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.
(b) Evaluation Factors: The evaluation factors are (1) Technical Capability and (2) Price
Factor 1: Technical Capability
Technical will be based on how well the proposed products or services meet the Government's requirement.
The Government will evaluate each offeror's technical proposal on an "acceptable" or "unacceptable" basis. To be rated "acceptable," the proposal must demonstrate a clear ability to meet all requirements specified in the Performance Work Statement. An offer will be rated "unacceptable" if it fails to meet any of the PWS requirements.
Factor 2: Price
The Government will evaluate the proposed total price for fairness and reasonableness. The price evaluation will not be assigned an adjectival rating.
Reasonableness may be determined by comparing the proposed prices received in response to the solicitation and other methods. A price analysis will be performed, but proposals will not be ranked based on price.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Technical Capability
Price
(b) . The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the Options (if applicable) basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) . A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in Notice of award the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
