INSTRUCTION TO QUOTERS
Addendum 52.212-1 Instructions to Quoters
Quoter shall submit the information below in order to be considered for award.
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
1) Factor 1 - The solicitation shall be filled out, signed and returned as part of your quote.
2) Factor 2 – Technical Factors:
a) The Contractor shall submit documentation including, but not limited to, technical statements and/or other supporting documentation to demonstrate the contractor’s capability to meet or exceed the required services as stated in the performance work statement.
b) Past Performance: The Contractor shall submit a resume and supporting documentations of up to three (3) past performance that are recent and relevant to the requirement. Include at a minimum - summary of work performed, the contract number and dollar value of the services provided, the name, title, phone number, and email address of the organization for which you performed the work.
For purposes of past performance, “Recent” is defined as a contract that is currently being performed or completed performance within a five year period ending on the date of issuance of this solicitation;
“Relevant” is defined as being similar in size, scope, and complexity to the current requirement.
3) In addition to being registered in SAM, small business joint ventures must submit the joint venture representations at paragraph (c) of Federal Acquisition Regulation (FAR) solicitation provision 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services, and paragraph (c) of FAR solicitation provision 52.219-1, Small Business Program Representations, with each quote in order to be considered for award.
Note: Item (4) above is only applicable only to small business joint ventures.

Hand delivery, postal mail, express mail, or fax submissions will not be accepted. The Contract Specialist will confirm receipt of all quotations within two business days. If the Contract Specialist does not confirm receipt, the quotation has not been received.
If a confirmation of receipt has not been received or the quotation is submitted less than two business days prior to the due date and time for receipt of quotations, it is incumbent upon the quoter to follow up with the Contract Specialist via email and telephone to confirm receipt.
EVALUATION
1. The tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced bidder.
2. All technical factors are of equal importance to each other; and all technical factors, when combined are more important than price.
The provision at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items is included in this solicitation, and the offeror must include a completed copy of this provision with their quote or be currently registered in the SAM website with their Representations and Certifications completed.

PERFORMANCE WORK STATEMENT
DIRECTOR OF MUSIC FOR NAVAL BASE GUAM CHAPEL
1. BACKGROUND
1.1 Naval Base Guam Chapel provides religious support for all Navy personnel and family members attending services and programs. The organization provides NBG, as well as all tenant commands around the Island of Guam, guidance in matters concerning the free exercise of religious beliefs and religious services relating to the spiritual needs of service members and family while stationed at NBG. Additionally, the Chapel provides programs to strengthen and support the moral, spiritual and interpersonal relationships of the patrons it serves.
1.2 The Music Director at Naval Base Guam Chapel (hereafter referred to as “Contractor”) will oversee coordination and execution of the musical elements of divine services, as provided by the Naval Base Guam (NBG) Command Religious Program (CRP); maintain and coordinate necessary volunteers for musical activities; coordinate and supervise all music-related activities/events; develop and execute the music program; coordinate with chaplains or other divine service clergy and officiants as may be required during divine services; maintain proficiency through attendance at workshops, conferences, and other training opportunities; advise the Command Chaplain; provide the base chapel an invoice for services rendered.
1.3 The Contractor will have a particular focus on developing and executing a robust music program for service members and families who attend NBG Chapel, in order to win support of Sunday religious services.
2. QUALIFICATIONS
2.1 The Contractor shall possess two years demonstrated experience in leading service music within the church community.
2.2 The Contractor shall have a degree, or comparable formal music training, in music performance and choral arts.
2.3 The Contractor shall be a person of Christian faith, active in personal devotion and prayer in accordance with their specific tradition, and a regular participant in corporate worship services.
2.4 The Contractor shall have experience in recruiting/training/leading a musical team consisting of vocalists and instrumentalists, including the recruitment and training of singers. Instrumentalist will include keyboard(s) and may include electric/acoustic guitars, bass guitar, and percussion.
2.5 The contractor must be at least 18 years of age.
2.6 The contractor must be able to provide music from the established and approved hymnals and other resources as needed.
2.7 The Contractor shall be fluent in English; oral and written, grammar, punctuation and spelling.
2.8 The Contractor shall possess appropriate interpersonal skills to assist all levels of military active duty, retired, dependents of various military service branches, chapel staff, various Protestant committee members, and all who participate in chapel services or programs.
2.9 The Contractor shall conduct all business in a professional, punctual, and sensitive and discrete manner with respect to all faiths, while working in a pluralistic environment, in accordance with Navy instruction.
2.10 The Contractor shall be proficient in using computers and programs, to include Microsoft Office programs (Word, Excel, and PowerPoint), social media channels (Facebook, Instagram, and Twitter) along with types of documents such as bulletins, chapel flyers and reports.
2.11 The Contractor shall possess the basic knowledge of supply inventory, accounting and coordination of equipment sufficient to adequately manage chapel supplies and the Religious Offering Funds.
2.12 The Contractor performing services under this contract must have access to Naval Base Guam (NBG) and may be required to provide necessary materials to obtain access to NBG such as favorable background check and proof of U.S. citizenship, or valid work permit in compliance with all applicable base access policies.
3. WORKLOAD, HOURS OF SERVICE
3.1 The contract encompasses a total service workload not to exceed 300 UNITS per contractual year. The execution of service units (typically to include: divine services, meetings, rehearsals, and music delivery coordination) will be coordinated with the supervising chaplain.

4. BACKGROUND CHECK
4.1 This contract will be awarded on a provisional basis until a thorough Criminal History Background Check is performed per Public Law 101-647, Section 231, Crime Control Act of 1990, DODI 1402.5, Criminal History Background Checks on Individuals in Child Care Services, AFI 31-501 Background checks/Investigations and Naval Base Guam, CID, Background Investigations. The background check will be coordinated by the Command Chaplain and includes an Installations Records Check and a Child Care National Agency Check and Inquiries. Unfavorable response on either check will result in immediate termination of position.
5. PERFORMANCE REQUIREMENTS
5.1 SPECIFIC RESPONSIBILITIES
5.2 The Contractor must provide leadership for the musical portions of the worship services.
5.3 The Contractor will be provided with appropriate music supplies and equipment.
5.4 The Contractor will direct volunteers: vocalists, musicians, accompanists, and/or the congregation in musical selections during worship service.
5.5 The Contractor shall work in conjunction with the Command Chaplain, divine service officiant, or contract clergy in the preparation and performance of music, which relates to the theme established by Scripture reading, chaplain’s topic/theme, and/or liturgical season.
5.6 The Contractor shall comply with copyright license reporting and copyright license identification procedures.
5.7 The Contractor will comply with the Child Safety standards required by the Archdiocese of Military Services, if applicable.
5.8 The Contractor shall communicate with the Religious Ministry Team about the need for additional inventory, purchase requirements, or other music needs related to divine services. Such requests imply no obligation of the government, and fulfillment of requests will be based on funds available to the RMT for such expenditures.
6.0 SUBSTITUTION
6.1 The Contractor shall provide a substitute when not personally performing contracted services.
6.2 The Contractor must provide a suitable substitute who meets all the qualifications set forth in paragraph two:

6.3 The Contractor shall notify the Command Chaplain when a substitute will be used and provide the Chaplain the substitute’s name and phone number no less than 24 hours in advance of the use of a substitute.
6.4 Payment of the substitute as a subcontractor is the responsibility of the Contractor.
6.5 The Contractor shall notify the Contracting Officer prior to performance in the event that services are to be performed by a bona fide employee of the Contractor, in order to prepare a contract modification incorporating the Service Contract Act into this contract.
7.0 INSPECTION AND ACCEPTANCE OF SERVICE
7.1 The Contractor will be working in coordination with the Command Chaplain or other divine service officiant.
7.2 Service units to be paid under the contract will be based upon actual work performed by the Contractor and accepted by the government.
7.3 The Contractor may be terminated for non-performance or convenience of the government, in accordance with current requirements. The Contractor may be removed for any performance or behavior which is not consistent with the principles and/or the policies promulgated by the Navy Chaplain Corps. The Contractor may request termination of the contractor with 30 days written advanced notice.
8.0 INVOICING
8.1 The Contractor shall register in WAWF and invoice based upon actual work performed and accepted by the government. Invoice(s) shall be submitted electronically via the government Wide Area Workflow System (WAWF) or comparable designated system.
8.2 Payments to the Contractor shall be made by electronic fund transfer (EFT).
9.0 PLACE OF PERFORMANCE
9.1 The Contractor shall perform services at Naval Base Guam Chapel Bldg. 1984, but may involve travel to other locations on and off base given the needs of the CRP.

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision --
"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
"Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
"Highest-level owner" means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
"Immediate owner" means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
"Inverted domestic corporation" means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
"Manufactured end product" means any end product in product and service codes (PSCs) 1000-9999, except--
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
"Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
"Predecessor" means an entity that is replaced by a successor and includes any predecessors of the predecessor.
"Reasonable inquiry" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
"Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
"Sensitive technology"--
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
"Service-disabled veteran-owned small business (SDVOSB) concern" means a small business concern—
(1)(i) Not less than 51 percent of which is owned and controlled by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran; or
(2) A small business concern eligible under the SDVOSB Program in accordance with 13 CFR part 128 (see subpart 19.14).
(3) Service-disabled veteran, as used in this definition, means a veteran as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16), and who is registered in the Beneficiary Identification and Records Locator Subsystem, or successor system that is maintained by the Department of Veterans Affairs' Veterans Benefits Administration, as a service-disabled veteran.
"Service-disabled veteran-owned small business (SDVOSB) concern eligible under the SDVOSB Program" means an SDVOSB concern that--
(1) Effective January 1, 2024, is designated in the System for Award Management (SAM) as certified by the Small Business Administration (SBA) in accordance with 13 CFR 128.300; or
(2) Has represented that it is an SDVOSB concern in SAM and submitted a complete application for certification to SBA on or before December 31, 2023.
"Service-disabled veteran-owned small business (SDVOSB) Program" means a program that authorizes contracting officers to limit competition, including award on a sole-source basis, to SDVOSB concerns eligible under the SDVOSB Program.
"Small business concern"--
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in its field of operation, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
"Small disadvantaged business concern, consistent with 13 CFR 124.1001", means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding the threshold at 13 CFR 124.104(c)(2) after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13 CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
"Subsidiary" means an entity in which more than 50 percent of the entity is owned--
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
"Successor" means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
"Veteran-owned small business concern" means a small business concern--
(1) Not less than 51 percent of which is owned and controlled by one or more veterans (as defined at 38 U.S.C.
101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
"Women-owned small business concern" means a small business concern--
(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and
(2) Whose management and daily business operations are controlled by one or more women.
"Women-owned small business (WOSB) concern eligible under the WOSB Program" (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300.
