RESPONSES TO QUESTIONS

List of Questions/Comments Received for Solicitation N6264521R0016

1. In section C.2.SCOPE the Request for Proposals (RFP) makes direct reference to compliance with tax and labor laws. Could the government cite the specific laws that would be applicable to this opportunity?

Response: As stated in the solicitation, “The contractor shall ensure compliance with all tax and labor laws, including multi-tier taxable income tax rates, Social Insurance Law (such as Social Security) covering Egyptian personnel (as well as foreign personnel whose countries have treaties with Egypt for reciprocal social insurance treatment), employer compliance obligations as defined under Egyptian law, work permit/visa requirements, indirect taxes, compliance with business registration laws, and local taxes including double taxation.”

2. In section C.2.SCOPE the RFP references the local compensation plan (LCP), could the government provide that plan that specifically highlights the applicable percentages or a reference to applicable plan documentation as it applies to the locations cited in the RFP?

Response: A LCP is neither mentioned in Section C.2. nor in any part of the solicitation. Similar words to a LCP also do not appear within this solicitation.

3. Can you provide a list of equipment including number of units and types and associated cost or alternatively would the government be willing to provide a plug number?

Response: Instead of allowing Offerors to propose Travel and ODC amounts that do not exceed the amounts specified in the solicitation, Offerors are now being instructed to use the amounts specified within the PWS. Section L has been revised to state this information, and these amounts have been entered into Attachment III – Pricing Sheet (now Attachment III – Pricing Sheet P00001) in Section J. For reference, the unburdened Travel and ODC plug numbers are:

CLIN 0009 - $70,000 for Travel; $30,000 for ODCs CLIN 0010 - $70,000 for Travel; $300,000 for ODCs CLIN 0011 - $62,000 for Travel; $200,815 for ODCs CLIN 0012 - $31,000 for Travel; $35,000 for ODCs CLIN 0013 - $500 for Travel

4. Can the Offeror please provide the name of the proposed Contracting Officer’s Representative (COR) for this award?

Response: This information is not necessary for Offerors throughout the Solicitation process. The COR will be specified within the contract award.

5. Can you provide the applicable withholding percentages for Egyptian Locals to ensure proper calculation of price?

Response: As stated in the solicitation, “The contractor shall ensure compliance with all tax and labor laws, including multi-tier taxable income tax rates, Social Insurance Law (such as Social Security) covering Egyptian personnel (as well as foreign personnel whose countries have treaties with Egypt for reciprocal social insurance treatment), employer compliance obligations as defined under Egyptian law, work permit/visa requirements, indirect taxes, compliance with business registration laws, and local taxes including double taxation.”

Please note that the United States Government does not regulate the rates issued by laws from foreign Governments. Because these rates are determined by a foreign Government, these rates may be subject to change during contract performance. Determining the tax rates to comply with foreign laws shall ultimately be up to each Offeror.

6. Please confirm that this RFP is a total Small Business Set-Aside and not Full and Open Competition.

Response: The Government confirms that this requirement is indeed a total Small Business Set-Aside requirement.

7. Given the complexity of acquiring signed letters of commitment (LOC) from personnel in these regions (i.e., the legal prohibition of signing an LOC without current employer approval), and in the interest of promoting competition, please confirm that the inclusion of Key Personnel Curriculum Vitae (CV) or resumes demonstrates a "firm commitment" as required in the RFP.

Response: The Government confirms that a CV or a resume does demonstrate a “firm commitment” as required in the Solicitation. With that said, please note the instructions already provided within Section H.2 of the Solicitation regarding substitution of key personnel. LOCs are not required for this requirement.

8. Please confirm that resumes are NOT required for the team providing services under Section C.2.2.3.P.

Response: As indicated within the Solicitation, Offerors are are to provide resumes for all indicated key personnel. This includes the team under Section C.2.2.3.P.

9. Please identify the Labor Categories for the team providing services under Section C.2.2.3.P.

Response: The Government does not have individual labor categories for this team. As with all performance-based requirements, it is ultimately up to each individual Offeror to identify how they want to provide these services. The tasks and description of services have been provided in Section C.2.2.3.P.

10. Please confirm that Offerors may make minor formatting changes to the PPIS as long as we abide by the font restrictions and page limitations specified in the RFP?

Response: The Government confirms that Offerors may make minor formatting changes to the PPIS as long as (1) the changes still abide by any font restrictions and page limitations specified in the Solicitation and

(2) all information (including instructions in Part II of the PPIS) provided in the template are still present.

Offerors shall not remove the instructions “To be completed by the POC Reference indicated in Part I” located in Part II of the PPIS.

11. Will NAMRU-3 consider a Program Manager located at NAMRU-3 Headquarters (HQ) and/or Washington DC to oversee the entire NAMRU-3 Portfolio so that the related research can be effectively managed from an enterprise perspective?

Response: The services under Section C.2.5.Y of the Solicitation shall not be located in Washington, DC and/or NAMRU-3 HQ in Sigonella, Italy. In accordance with the PWS, these services are anticipated to be located at the NAMRU-3 Detachment in Cairo, Egypt.

Additional Revisions

12. FAR 52.229-8 has been revised to be full text instead of Incorporated by Reference. FAR 52.229- 11 has been moved from Section I to Section K and made full text instead of Incorporated by Reference. FAR 52.229-12 has also been added to Section I; however, this may be removed from the resulting award depending on the awardee’s completion of FAR 52.229-11. FAR 52.229-8 and 52.229-11 have been added to the list of identified provisions to be completed by Offerors in Section L.7.4.2.5.

SECTION K - REPRESENTATIONS, CERTIFICATIONS AND OTHER STATEMENTS OF OFFERORS

The following have been added by full text:

52.229-11 TAX ON CERTAIN FOREIGN PROCUREMENTS--NOTICE AND REPRESENTATION (JUN

2020)

(a) Definitions. As used in this provision--

Foreign person means any person other than a United States person.

Specified Federal procurement payment means any payment made pursuant to a contract with a foreign contracting party that is for goods, manufactured or produced, or services provided in a foreign country that is not a party to an international procurement agreement with the United States. For purposes of the prior sentence, a foreign country does not include an outlying area.

United States person as defined in 26 U.S.C. 7701(a)(30) means--

(1) A citizen or resident of the United States;

(2) A domestic partnership;

(3) A domestic corporation;

(4) Any estate (other than a foreign estate, within the meaning of 26 U.S.C. 701(a)(31)); and

(5) Any trust if--

(i) A court within the United States is able to exercise primary supervision over the administration of the trust; and

(ii) One or more United States persons have the authority to control all substantial decisions of the trust.

(b) Unless exempted, there is a 2 percent tax of the amount of a specified Federal procurement payment on any foreign person receiving such payment. See 26 U.S.C. 5000C and its implementing regulations at 26 CFR 1.5000C- 1 through 1.5000C-7.

(c) Exemptions from withholding under this provision are described at 26 CFR 1.5000C-1(d)(5) through (7). The Offeror would claim an exemption from the withholding by using the Department of the Treasury Internal Revenue Service Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, available via the internet at www.irs.gov/w14. Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the IRS.

(d) For purposes of withholding under 26 U.S.C. 5000C, the Offeror represents that--

(1) It [_]is [_]is not a foreign person; and

(2) If the Offeror indicates ``is'' in paragraph (d)(1) of this provision, then the Offeror represents that--I am claiming on the IRS Form W-14 [__] a full exemption, or [__] partial or no exemption [Offeror shall select one] from the excise tax.

(e) If the Offeror represents it is a foreign person in paragraph (d)(1) of this provision, then--

(1) The clause at FAR 52.229-12, Tax on Certain Foreign Procurements, will be included in any resulting contract;

and

(2) The Offeror shall submit with its offer the IRS Form W-14. If the IRS Form W-14 is not submitted with the offer, exemptions will not be applied to any resulting contract and the Government will withhold a full 2 percent of each payment.

(f) If the Offeror selects ``is'' in paragraph (d)(1) and ``partial or no exemption'' in paragraph (d)(2) of this provision, the Offeror will be subject to withholding in accordance with the clause at FAR 52.229-12, Tax on Certain Foreign Procurements, in any resulting contract.

(g) A taxpayer may, for a fee, seek advice from the Internal Revenue Service (IRS) as to the proper tax treatment of a transaction. This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. For questions relating to the interpretation of the IRS regulations go to https://www.irs.gov/help/tax-law-questions.

(End of provision)

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

INSTRUCTIONS TO OFFERORS

L.1. PERIOD FOR ACCEPTANCE OF OFFERS

L.4. AWARD

The Government intends to evaluate (complete and timely) proposals and award a contract without discussions.

Clarifications may be conducted as described in FAR 15.306(a)(2). Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a Cost and Non-Cost standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary (FAR 52.215-1(f)(4)).

If discussions are to be conducted, the PCO shall establish a competitive range based on the ratings of each proposal against all evaluation criteria. Prior to the establishment of the competitive range, and after the decision to conduct discussions has been made, the PCO may enter into limited communications with Offerors whose inclusion or exclusion from the competitive range is uncertain. These communications are limited in accordance with FAR 15.306(b)(l). The establishment of the competitive range is formally documented by the PCO in a competitive range determination. The PCO will only enter into discussions with those Offerors determined to be in the competitive range.

If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

L.7. EVALUATION APPROACH.

L.7.1. VOLUME I, SUBPART I: MANDATORY DOCUMENTATION: PASS/FAIL CRITERIA. The Offeror shall make a clear statement that the proposal is valid for not less than 180 calendar days from the proposal due date.

The offeror shall be in compliance with the documentation requested as Attachments, A, B, and C (listed below).

Failure to provide clear or inadequate documentation shall result in being removed from the competitive evaluation.

These requirements apply to the prime vendor as well as the subcontractor. Unless specified, Attachments in this Section do not have a page limit.

Attachment A: Human Subject Research Documentation: The Offeror shall include in their proposal proof of an active (i.e., not expired) Federalwide Assurance (FWA). The prime contractor is required to have an active FWA. If a subcontractor may perform human subject research, they shall have their own active (i.e., not expired) FWA. The subcontractor’s FWA shall be possessed by the subcontractor, and the subcontractor is not allowed to work under the prime contractor’s FWA. If the subcontractor does not possess its own FWA, the proposal shall state clearly that subcontractor personnel will not be performing human subject research and that this is why proof of an active FWA is absent.

Proof of each active FWA shall include: Entity name as it appears on FWA, full FWA number, and FWA expiration date.

Attachment B: Indemnification and Medical Liability Insurance (in accordance with (IAW) with Section H.31. and FAR 52.237-7): The supporting documentation shall prove that the offeror possesses current insurance and shall show the expiration date of the policies as well as including individual and aggregate limits for each of the required area of coverage. If the subcontractor(s) will also be performing health care services, the offeror shall indicate if the proposed subcontractor(s) are covered under the prime contractor’s Indemnification and Medical Liability Insurance or if the subcontractor(s) possess(es) their own coverage. If the subcontractor(s) will be performing health care services and is (are) not covered under the Offeror’s Indemnification and Medical Liability Insurance, the proposal shall include supporting documentation proving that the subcontractor possesses their own current insurance with the expiration date of the policies as well as including individual and aggregate limits for each of the required areas of coverage. If the subcontractor is not covered under any Indemnification and Medical Liability Insurance or will not be performing health care services, the proposal shall state clearly that subcontractor personnel will not be performing health care services and that this is why proof of the Indemnification and Medical Liability Insurance for subcontractor personnel is absent.

Attachment C: Standard Liability Insurance (IAW Section H.16. and FAR 52.228-7): The supporting documentation shall prove that the offeror possesses current insurance and shall show the expiration date of the policies as well as including individual and aggregate limits for each of the required areas of coverage. The Offeror shall state clearly if the proposed subcontractor(s) are covered under the prime contractor’s Standard Liability Insurance or if the subcontractor(s) possess their own coverage. If the subcontractor(s) is not covered under the Offeror’s Standard Liability Insurance, the proposal shall include supporting documentation proving that the subcontractor possesses their own current insurance with the expiration date of the policies as well as including individual and aggregate limits for each of the required areas of coverage.

L.7.2. VOLUME I, SUBPART II: MANAGEMENT APPROACH/RISK:

L.7.2.1. The Offeror’s management approach shall address the following:

Resumes shall include the individual’s name (additional identifiable information shall be removed or redacted), descriptions of past/current responsibilities, relevant work experience, and any relevant certification in the main program areas. The resumes for the proposed personnel shall demonstrate sufficiently to the Government evaluators that the proposed individual possesses the knowledge, education requirements, and experience relevant to accomplish the required tasks. DO NOT include a Social Security Number (SSN), date of birth, home address, or personal telephone number of the person on the resume. Resume(s) are limited to two pages per individual and are excluded from the overall page limit of Volume I. If a resume contains more than two pages for an individual, the excess pages will be excluded from review.

L.7.2.2. Management proposals will demonstrate that the offeror's proposed labor mix and level of effort are adequate to complete the tasks listed in the PWS. The offeror shall demonstrate the ability to provide any products or reports as part of the task.

L.7.2.3. Government Furnished Property (GFP): Offerors shall specify any GFP necessary to perform these tasks.

This shall include any Contractor purchased or acquired/Government-owned items. Offerors shall include the following information: item description, quantity, and current location. Detailed Bills of Materials shall be submitted along with the proposal, noting part numbers, costs, and need dates for all required GFP. Any GFP past what is typically available for contractors in an office environment, which the contractor needs to complete the work listed in the PWS, needs to be listed. If the offeror does not require GFP past other than what is typically available for contractors in an office environment, the offeror shall provide a statement affirming this fact in their proposal.

L.7.2.5. Volume I, Subpart II: Management Approach/Risk is limited to thirty (30) pages. Pages should be numbered consecutively throughout the document and not by sections. For any sections of a proposal with a defined page limit, pages exceeding the specified limit will be removed and not forwarded for evaluation. The following sections are not subject to the overall thirty (30) page limit listed above:

Table of Contents;

Title page;

Contractor Cover Page;

Organizational Conflict of Interest Mitigation Plan (limited to 10 pages) Government Furnished Equipment/Information/Property; and Resumes

L.7.3. VOLUME I, SUBPART III: PAST PERFORMANCE:

The Offeror shall submit with its proposal the first tier subcontractor’s letter(s) of consent allowing the Government to disclose the subcontractors' past performance to the Offeror during negotiations. Failure to provide the letter of consent will render the PPIS not relevant, regardless if negotiations are conducted or not conducted. Letters of consent do not count against the overall page limit.

2. Past Performance Information Sheet (PPIS) (Section J, Attachment II: Past Performance Information Sheet). The

PPIS consists of Part I: Past Performance Reference Information & Part II: Point of Contact Reference. In order for a PPIS to be considered for evaluation, the PPIS shall contain the Offeror’s completed Part I AND the Point of Contact (POC) Reference’s completed Part II. The Offeror shall provide no more than four (4) pages (Parts I & II) for each PPIS reference. The Offeror shall complete the PPIS, Part I: Past Performance Reference Information. The Offeror shall provide to the POC listed on the PPIS, the completed Part I along with Part II:

POC Reference for completion by the POC. The completed PPIS shall be converted to a pdf, digitally signed by the POC reference, returned to the Offeror, and submitted as a separate attachment by the Offeror with their Volume I, Subpart III proposal.

3. The first twelve pages of Volume I, Subpart III shall be for submission of a maximum of three PPIS. If more than three PPISs are provided, only the first three will be considered. Each PPIS reference consists of up to four pages. Part I is not to contain more than two pages, and Part II is not to contain more than two pages. If Part I or Part II contains more than two pages, only the first two pages of the specific Part of the PPIS reference will be considered.

4. The remaining three pages are reserved for the Offeror to cover the items highlighted under the paragraph below titled “Remaining Three Pages” (Paragraph 12).

5. The Offeror shall submit up to three (3) PPIS references. Contracts cited shall be current, or have ended not more than three years prior to the closing date of the solicitation, and considered to be relevant (as defined in Section M.4.2.) of this requirement. If the contract performance ended more than three years prior to the closing date of the Solicitation, the PPIS will be determined to be not recent and will receive no further evaluation.

6. A maximum of one contract/PPIS may be held by the prime Offeror’s proposed subcontractor.

7. The offeror may submit Past Performance Information Sheets that demonstrate prior experience of key personnel. The Past Performance submission shall identify, by name, the key personnel and clearly identify their previous roles and responsibilities under the referenced contract and their proposed roles and responsibilities under the resultant contract. If the submission does not clearly describe the roles and responsibilities of the key personnel and how the key personnel will contribute to the performance under the resultant contract, it may be determined not relevant.

8. For the purposes of Past Performance/Past Performance Evaluation Section(s)/PPISs, a “contract” is defined as

(1) a single contract*; (2) a single task order awarded under a Multiple Award contract (as defined below); (3) a single task order awarded under a master Single-Award Indefinite Delivery task order contract (Definite Quantity, Requirements, or Indefinite Quantity) (FAR 16.5); (4) a single task order placed under a Federal Supply Schedule contract (FAR 8.405-2); or (5) a single call order placed under a Blanket Purchase Agreement

(BPA)(FAR 8.405-3).

*A single “contract” does not include an Indefinite Delivery task order contract (Definite Quantity, Requirements, or Indefinite Quantity) (FAR 16.5) or a BPA (FAR 8.405-3); an Indefinite Delivery task order contract and/or BPA that is identified by itself and does not have a corresponding task/call order listed will be determined to be Not Relevant.

9. Each PPIS shall include only one contract per sheet. Each PPIS shall identify no more than one Point of Contact

(POC). If more than one POC or more than one contract is provided for any PPIS, only the first POC and contract number will be considered. The Government may contact the POC listed on the PPIS. The POC must be either Government personnel (civil service or military) or personnel within the private sector** for whom the Offeror provided services.

**Information provided by or for a POC who works directly for the Offeror, or indirectly (i.e., in a prime/ subcontractor or mentor/protégé relationship, etc.), will be determined to be not relevant. The POC must have firsthand knowledge of the Offeror’s performance under the contract provided on the PPIS.

10. The past performance information listed on each PPIS shall be for services relevant to the services required under this Solicitation. The Offeror shall describe the objectives achieved and detail how the effort is similar to the requirements of this solicitation (referencing the PWS in Section C). The offeror shall provide specific labor categories (or position descriptions), level of effort per labor category (number of FTEs), the dollar value of services provided, and a detailed description of the services and efforts provided. The Offeror may include contracts that demonstrate the prior experience of key personnel who will be performing in support of the contract resulting from this solicitation; such contracts shall be clearly identified to show the relationship of the past performance entry to the Offeror.

11. The PPIS shall be clear as to the company that is the awardee, the company that performed the services (if different than the awardee) and the relationship of both to the Offeror or their proposed subcontractor. The name and Cage Code shall be provided for all parties. Offerors that are proposing past performance where the awardee or performer does not match their name and Cage Code (or the name and Cage Code of a proposed subcontractor) because the awardee or performer is a subsidiary/separate division within their company or “Doing Business As” (DBA), shall clearly describe the connection of all listed parties (along with Cage Codes).

If the submission does not clearly detail the specific relationship under a contract, it will be determined not relevant.

12. Remaining Three Pages: If necessary, the remaining three pages afford the Offeror a venue to include any contract(s) terminated for cause or default (in whole or in part) during the past three (3) years (to include those currently in the process of such termination). These pages shall provide a brief background, issues with contract performance, any cure notices or show cause letters received and description of any corrective action taken. If the additional pages are not necessary or applicable, such pages shall not be utilized for a different purpose.

13. The Government reserves the right to use alternative resources to gather past performance information.

L.7.3.2. Subcontracting Concerns

1. If Past Performance is submitted for a contract under which the Offeror (or proposed subcontractor, partner, mentor, protégé, parent company, sister company, etc.) provided services as a subcontractor, partner, mentor, protégé, parent company, sister company, etc., the PPIS shall clearly describe the corporate relationships among those who provided the services. If applicable, this description shall cite key responsibilities and corporate relationship for each entity, to include identifying the specific services provided (in terms of numbers and types of personnel, locations, etc.) and nature of services provided (e.g., consulting services, subject matter expertise).

If the submission does not clearly detail the specific responsibilities and relationship under a contract, it will be determined not relevant.

2. If a subcontracting, teaming, partnering, mentoring or other relationship is proposed, the Offeror shall submit written consent from the subcontractor, partner, etc. to disclose their Past Performance information to the contractor. If such consent is not provided as part of the submission, the Past Performance of the subcontractor, partner, etc., will be determined “Not Relevant”.

3. If neither the Offeror nor its subcontractor(s), teaming partner(s), etc. possess relevant past performance, the

Offeror shall submit a statement affirming that they possess no relevant Past Performance.

L.7.4. VOLUME II: SUBPART I: COST NARRATIVE AND REQUIRED DOCUMENTATION.

1. Any deviations in proposed staffing (based on information from the Offeror’s management approach, including labor categories, FTEs, and hours (if applicable)),

2. The calculation of proposed annual FTE hours (for reference, the Government’s estimate in Technical Exhibit 6 utilizes 1840 annual hours (2,080 minus 240) for one FTE with 40 hours estimated for U.S. holidays, 40 hours for personal leave, and 80 hours for local holidays),

3. Application of indirect rates, which includes the cost base applicable to each cost element,

4. The methodology and calculations used to determine proposed indirect rates. Indirect rates shall be easily identifiable.

3. Section B. Offeror(s) shall complete and submit a copy of Section B of the Solicitation indicating the proposed cost, fixed fee, and total for the Contract Line Item Number (CLIN. Note: these totals shall be consistent with the Excel cost breakdown provided in Volume II, SUBPART II).

4. SAM Certification Sheet. Offeror(s) shall complete, sign, and submit the Section K, SAM Certification Sheet.

8. Rate Agreements. Offeror(s) shall provide a copy of the current rate agreement or forward pricing rate agreement that supports the proposed contract rates. “Copy” in this context is defined as a direct and full copy of the actual applicable pages from the Offeror’s FPRA/FPRR (to include cover sheet) and not Offeror created tables or excerpts. These agreements may be with the Defense Contract Management Agency (DCMA), Department of Health and Human Services (DHHS), or other cognizant Federal Government contracting offices. If applicable, provide a copy of any DCAA audit that supports the proposed contract rates or costs.

This Subpart applies to the requirements of the base contract, Section C, Performance Work Statement.

The Offeror’s cost proposal shall include the entire 60-month PoP.

1. Offerors cost proposal shall include the estimated level of effort for the entire 60-month period of performance for each labor category outlined in Technical Exhibit 6 and/or staffing based on the Offeror’s management approach.

2. Offerors shall divide their Excel cost proposal into five 12-month “cost periods” and Total All Periods for ease of conducting the cost evaluation (example: Year 1, Year 2, Year 3, Year 4, Year 5, and Total All Years).

3. Offerors are cautioned that proposed costs shall be consistent with the proposed management approach and reflective of the effort required by the Solicitation. Unrealistically low proposed costs may be grounds for eliminating a proposal from the competition on the basis that the Offeror does not understand the requirement.

4. The proposed cost elements shall be adequately supported in order for the Contracting Officer to make the determination that the proposed costs are fair and reasonable. Therefore, Offerors are required to provide a breakdown for each cost element, such as labor categories, direct labor hours, direct labor rates, overhead and other indirect cost rates, subcontract costs, other direct costs, and fixed fee. The Offeror shall prepare and submit the cost support in a format similar to Section J, Attachment III: Pricing Sheet P00001 (External Attachment). Certification of the cost support is not required at the time of proposal submission.

5. If subcontractors are unwilling to submit their direct labor rates and/or indirect rates to the prime contractor, they shall submit only the direct labor rates and/or indirect rates to the Government utilizing the same proposal submission instructions and due date and time located in this section. In this situation, subcontractors shall clearly indicate who their prime contractor will be in order for the Government to evaluate their rates with the appropriate proposal. Subcontractors shall revise cost elements as applicable.

6. All cells in the Excel spreadsheet shall allow the Government to view calculations and formulas or shall link to cells in the same spreadsheet that allow the Government to view the values. Spreadsheets shall not link to external sources and shall not include updates to external sources. Offerors shall not lock out spreadsheets; all formulas shall be visible. Links to other spreadsheets where the Government cannot access the underlying value are not acceptable.

7. Offerors shall utilize the estimated unburdened Travel and ODCs for each year as listed in the PWS and

Attachment III – Pricing Sheet P00001 in Section J.

Note: Clauses and/or provisions concerning certified cost or pricing data included in this Solicitation are applicable only if one eligible proposal is received or fully evaluated. In the event that only one proposal is received, one proposal receives a “Pass” rating for the Mandatory Documentation, or one proposal receives the minimum ratings for Non-Cost Evaluation Factors, the sole eligible Offeror will be notified to provide certification of cost or pricing data in accordance with FAR 52.215-12 and DFARS 252.215-7010.
