The closing date and time of the solicitation remain unchanged.

Combined Synopsis/Solicitation for Non-Personal Services to Support Commander, Naval Surface Force Atlantic (CNSL) Force Resiliency/Toughness Program This is a combined synopsis/solicitation for commercial items prepared in accordance with FAR 12.6, Streamlined Procedures for Evaluation and Solicitation of Commercial Items, as supplemented with additional information included in this notice. This requirement is competed as a total small business set-aside under North American Industry Classification System (NAICS) 621330, Offices of Mental Health Practitioners (except Physicians). The NAICS code is 621330, with a business size standard of $8 million.

Proposal Submission Proposals shall be submitted in accordance with the Solicitation (Addendum to 52.212-1 – Instructions to Offerors – Commercial Items) to usn.detrick.navmedlogcomftdmd.mbx.matrix@mail.mil by 12:00 pm local time on 28 May 2021.

Amendment 0001 - Questions and Responses

1. PWS 1.2.1. Will credentials approval by through the office of the CNSL Force Surgeon or the local MTF’s medical staff services office? If the former, what is the anticipated time that review and approval routinely takes?

Response: Credentials will be approved through the Medical Readiness Division (MRD) at which services are to be performed. The timeframe for approval is typically 2-4 weeks.

2. PWS 12.3.2.2/13.3.2.8. May personnel report for duty before they receive an interim clearance but after the T3 investigation has been initiated?

Response: Personnel may report for duty without a Secret clearance or interim clearance as Section 12.3.2.8 of the PWS states, “The Commander may authorize the contract worker to perform other tasks within the scope of the contract worker’s performance of work that precludes Secret clearance status.” Also, Section 12.3.2.7 of the PWS states “Trustworthiness or whole person determinations are the sole prerogative of the Commander of the sponsoring activity. If the Commander or designated government representative determines, upon review of the contract worker’s security clearance information, that allowing a contract worker to perform certain tasks or to access certain areas would pose an unacceptable risk, that decision is final.”

3. Under the new SBA regulations at 13 C.F.R. § 121.103(h)(4), joint ventures are considered to have a facility clearance when all venturers performing the contract have their own facility clearances. Would the Government please add to Addendum to 52.212-1(2.2), “If the offeror is a joint venture, the offeror must submit Facility Clearance Verification documentation for all venturers, and the venturers’ respective SAM records each must state that they possess a Secret facility clearance or higher.” Similarly would it update the matrix in Addendum to 52.212-2(7.3)?

Response: 13 C.F.R. § 121.103(h)(4)(ii) states “Where the security portion of the contract requiring a facility security clearance is ancillary to the principal purpose of the procurement, the partner to the joint venture that will perform that work must possess the required facility security clearance.” Section 7.3 of ADDENDUM TO 52.212-2 has been revised to state that the facility clearance is considered to be ancillary to the principal purpose of the procurement

4. Is an incumbent contract or contractor associated to the requirement?

Response: This will be a new contract and there is no incumbent contractor.

5. Is the subject RFP a new requirement or is there an incumbent? If there is an incumbent can you provide the name of the contractor and the contract number?

Response: See response to question 4.

6. Is this a new opportunity or a recompete of an existing contract? If this is a recompete, can you please provide the contract number and incumbent's name?

Response: See response to question 4.

7. Are all positions currently filled?

Response: See response to question 4.

8. Will the government consider accepting a CPARS in lieu of the Past Performance Information Sheet?

Response: The government will not accept CPARS in lieu of Past Performance Information Sheets. In accordance with Section 7.4.2 of ADDENDUM TO 52.212-2, the government may obtain Past Performance information from any other sources available to the government, such as CPARS.

9. What occupation code from the WD must be used for each of the labor category?

Response: The expected occupation codes are listed in Section 4 on the Instructions tab of Attachment 4 – Pricing Workbook for N62645-21-R-0007.

10. Is it possible to bid on all positions except for those that are physician related?

Response: In accordance with Section 2.5 of ADDENDUM TO 52.212-1 “Pricing shall be submitted for all CLINs; otherwise, the pricing proposal will be considered incomplete and may result in the rejection of the offeror’s entire proposal.”

11. As a point of clarification, we are asking if insurance coverage in the amounts listed in the solicitation are required for work on Federal installations regardless if the installations (Norfolk/Mayport) reside in the states of Virginia and Florida. If not, how much insurance does USG require for on-site federal medical work?

Response: There are no services to be performed in states other than Virginia and Florida for this requirement. The contractor is not required to hold malpractice insurance for other states.

12. Are offerors expected to fill in any portion of the attached DD-254 or is it for informational purposes?

Response: Attachment 7 - DD From 254 will be completed after contract award.

13. For AIT-owned companies, will the Government accept a medical malpractice declaration for a sister subsidiary as proof of insurability, if the bidding subsidiary certifies in Attachment 6 that it will have medical malpractice insurance immediately upon award? If the Government will accept a sister subsidiary declaration, will it waive the need for an agent’s signature at the bottom of Attachment 6?

Response: If the sister subsidiary of an American Indian Tribal owned offeror is going to directly support contract operations, a Malpractice Insurance Certification Form with the sister subsidiary as the insuree is acceptable. The government will not wave the need for an agent’s signature on Attachment 6. Section 8 has been added to Attachment 6. If the Insuree is an entity other than the Offeror, Section 8 shall be used to demonstrate that the insurance covers the Offeror.

14. Is there a current contract to meet these same requirements for the Navy? Would the Government disclose who the incumbent contractor is?

Response: See the response to question 4.

15. Will the Government consider allowing contractors to submit Part 1 of X emails to ensure no emails go above the 10 MB limit?

Response: The government has determined that an email size limit of 10 megabytes is sufficient for offerors to provide all volumes of the proposal.

16. Some of our program Contracting Officers are not comfortable submitting questionnaire-style proposal documents back to us directly. Will the Government accept Past Performance Information Sheets sent directly to it from program Contracting Officers?

Response: In accordance with Section 2.3.1 of ADDENDUM TO 52.212-1, the customer POC shall return the entire completed Past Performance Information Sheet to the offeror. Each completed Past Performance Information Sheet shall be included as part of the offeror’s Past Performance Volume. This ensures that all Past Performance Information Sheets are included in the offeror’s Past Performance Volume, which reduces the risk of information being lost and avoids confusion of numerous Past Performance Information Sheets being received from numerous offerors at various times.

17. We have customers who traditionally will not complete past performance questionnaires. Will the Government consider CPARS in lieu of having Contracting Officers fill out the Past Performance Information Sheets?

Response: See the response to question 8.

18. In accordance with 13 CFR 121.103, American Indian Tribal (AIT) owned companies are exempt from affiliation issues. If AIT-owned companies can prove shared services will support a resultant contract, will the Government consider AIT sister subsidiary past performance as being from the prime contractor if the sister subsidiaries are not subcontractors?

Response: If the conditions of Section 2.3.3 of ADDENDUM TO 52.212-1 are met, the Past Performance of a sister subsidiary to an American Indian Tribal owned offeror will receive the same consideration as if the services were directly provided by the offeror.

19. Volume I is the Facility Clearance Volume, is the five page limit meant to apply to the Facility Clearance Volume or the Technical Volume? If the five-page limit is meant to apply to Volume III Technical, would the Government consider removing the Plan for Managing Contractor Workers Throughout Locations of Service and Plan for Contract Startup requirements outside of the page limit so offerors can adequately cover the PWS requirements?

Response: Section 2.4.2 of ADDENDUM TO 52.212-1 has been revised to state that the five-page limit is for Volume III – Technical. The government has considered the page limitation for the Technical Volume and has determined that five pages are sufficient to provide all information requested in Section 2.4 and subparagraphs of ADDENDUM TO 52.212-1.

20. Will the Government be basing its relevancy rating solely off the information provided in the Past Performance Information Sheet and from POCs, or will it consider write ups provided by offerors to detail relevancy?

Response: Write ups provided by offerors detailing relevancy outside of the Past Performance Information Sheet will not be considered.

21. Will the Government rely on quality and quantity information from Past Performance POCs or are contractors allowed to provide a write up that details their quality information in accordance with Section 7.4.3?

Response: Information provided by the POCs of Past Performance Information Sheets for Recent Relevant services will used in determining the quantity of services provided and for assessing the quality of performance. Section 7.4.2 of ADDENDUM TO 52.212-2 also states that Past Performance information may be obtained from any other sources available to the Government, such as the Contractor Performance Assessment Reporting System (CPARS) and interviews with Contracting Officer’s Representatives. The government will not consider information provided from offerors on the quality of performance.

22. Will the Government's confidence assessment be in aggregate or will each Past Performance Information Sheet be assigned a confidence score individually?

Response: A confidence rating will be assigned based on the offeror’s aggregate Past Performance.

23. Can the Government confirm that this is a new requirement? If this is not a new requirement, can the Government please provide the current contractor’s name, contract number, contract value and period of performance?

Response: See the response to question 4.

24. Does the Government have an anticipated or estimated amount of time a contract worker will be aboard a ship?

Response: It is anticipated that workers will to spend no more than 25% of their work time aboard a ship. This information has been added to Section 3.6.3 of the Performance Work Statement.

25. Will the Government reconsider and revise the requirement so customer POCs submit completed Attachment 1 directly to the Government or at a minimum let the customer determine to whom the completed Attachment 1 is sent to?

Response: See the response to question 16.

26. Can the Government please provide a completed DD 254 with the level of clearance listed?

Response: See the response to question 12.

27. Provided qualification and credential packages are approved, will the Government allow contractor employees to start if the Command's Security Manager authorizes issuance of a DoD CAC and interim access to a DoN or DoD unclassified computer/network upon a favorable review of the investigative questionnaire and advance favorable fingerprint results, since most of these labor categories will not have active clearances prior to start?

Response: See the response to question 2.

28. Is there a current incumbent or similar contract? If yes, please provide contract number and incumbent name?

Response: See the response to question 4.

29. Page 104, references Wage Determination requirements, will all position fall under SCA guidelines or only a few? Which CLINS will need to abide by SCA guidelines?

Response: See the response to question 9.

30. Section 6.7.3. States: “Possess a current, full, active, and unrestricted license to practice as a Licensed Clinical Social Worker.” The other licensed position (Psychologist and Registered Nurse) qualifications specify that the clinicians need to have a license to practice in their specialty “in any state”, is that the case also for Social worker or does the social worker need to be licensed in the state they are providing services (i.e., VA or FL)?

Response: Section 6.7.3 of the Performance Work Statement has been revised to “Possess a current, full, active, and unrestricted license to practice as a Licensed Clinical Social Worker in any State, the District of Columbia, Guam, Puerto Rico or US Virgin Islands, as required in the contract.”

31. Do the contracted workers need to have security clearance on day one of period of performance? Or will interim clearance be granted while the full clearance is approved?

Response: See the response to question 2.

32. Page 42, Section 1.2.4. States “Current CNSL medical and mental health resources are insufficient for the demand. It has been exacerbated by an expansion in the number of ships and number of Sailors over the last 5 years with continued expansion expected over the next 5 years. The purpose of this contract is to provide the additional contractor professional services required to adequately support the CNSL Force Resiliency/Toughness programs necessary for Sailor mental, physical and spiritual readiness for combat. “Can the Navy please advise if there is a current contract covering any or all of the services outlined in this rfp? If so, please advise the contract #s and FTE count/type affiliated with the contract(s).

Response: See the response to question 4.

33. Page 54, Section 6.1. states “Contract workers shall maintain current certification in American Heart Association Basic Life Support (BLS); American Heart Association Healthcare Provider Course; American Red Cross CPR (Cardio Pulmonary Resuscitation); or equivalent. Training shall be the responsibility of the contractor and is at no cost to the government. Contract workers, not in possession of current certification, must acquire certification prior to initiating contract performance. Web based classes do not meet these standards. A copy of the BLS instruction may be obtained from the World Wide Web at: Caution-https://www.med.navy.mil/directives/ExternalDirectives/1500.15F.pdf < Caution-https://www.med.navy.mil/directives/ExternalDirectives/1500.15F.pdf > ” Is this for all contract workers or only clinical personnel that carry licensure?

Response: The requirements of Section 6.1 of the Performance Work Statement apply to all workers.

34. Page 166, Section 2.2 states “In accordance with file submission requirements given in this section, the offeror shall provide Facility Clearance Verification documentation and the document shall state that an active Secret (or higher) level Facility Clearance is held by the offeror. The offeror’s SAM record shall also state that the offeror’s company security level is Secret level (or higher).” Will the government allow this to be submitted in a PDF format as there is no way to submit it in Office Format? Is the SAM record sufficient proof of our secret clearance, or is additional documentation required? If additionally documentation is required, please specify exactly what the NAVY needs to prove our secret clearance.

Response: Facility Clearance Verification documentation can be submitted in any format. The offeror may contact Defense Counterintelligence and Security Agency (DCSA) to request Facility Clearance Verification documentation.

35. Page 166, Section 2.3.1 – bottom of paragraph states “The Past Performance Information Sheets shall be in Microsoft Word on 8 ½ X 11 inch size page, with 1 inch margins all around, Times New Roman font of 10 point font size inclusive of tables. Text and tables that are not in compliance will not be considered by the Government in its evaluation. Cover letters are not required for Volume I; any information contained in a cover letter will not be evaluated” – Since this is to be filled out and signed by our customers, will the government allow this Volume to be submitted in PDF Format.

Response: The Past Performance Information Sheets shall be in Microsoft Word on 8 ½ X 11 inch size page, with 1 inch margins all around, Times New Roman font of 10 point font size inclusive of tables. Please note that digital signatures can be used in Microsoft Word, but completing the document in word format and converting it to PDF for signature will be acceptable. Section 2.3.1 of ADDENDUM TO 52.212-1 has been revised to state that cover letters are not required for Volume II.

36. Page 168, Section 2.4.2. States “The Technical Volume shall be in Microsoft Word format on 8 ½ X 11 inch size paper, with margins not less than 1 inch all around, and the font shall be Times New Roman not less than 10 point font size. Tables, charts, graphs, and graphics may be in fonts other than Times New Roman font, but shall be not less than 10 point font size. Text, tables, charts, graphs, graphics, etc. that are not in compliance will not be considered by the Government in its evaluation. Each page of each document shall have a footer indicating the name of the offeror and “page X of Y.” The total number of the pages submitted for Volume I (Technical) shall not exceed 5 (8 ½ X 11 inch) pages, excluding a title page, table of contents, and glossary. If Volume I contains more than 5 pages, only the first 5 pages will be evaluated. Cover letters are not required; any information contained in a cover letter will not be evaluated.” - Will the government allow this Volume to be submitted in PDF Format?

Response: The Technical Volume shall be in Microsoft Word format on 8 ½ X 11 inch size paper, with margins not less than 1 inch all around, and the font shall be Times New Roman not less than 10 point font size.

37. We were not able to locate a solicitation cover sheet (e.g., SF1449, SF30) in the solicitation package. Will the government please clarify if a cover sheet will be issued?

Response: There is no cover sheet for this combined synopsis/solicitation. The Offeror’s Information Form has includes a statement that is a substitute for signing the solicitation cover sheet and amendment cover sheets.

38. Is this new work or is there an incumbent contractor performing this work? If so, could the government please provide the name and contract number?

Response: See response to question 4.

39. As there does not appear to be a cover sheet in the solicitation package, would the government please provide the proposal validity requirement?

Response: See response to question 37.

40. The DD Form 254 appears to be blank. Will the government be issuing a DD254 with the required information?

Response: See response to question 12.

41. According to Section 2.4, the technical volume is Volume III. In section 2.4.2, the technical volume is referred to as Volume I. The page limitation for the volume is shown as 5 pages. Is the reference to technical being Volume I in error, and is the 5-page limitation correct for the Technical Volume?

Response: See response to question 19.

42. Are resumes (or sample resumes) required for each position with the proposal submittal?

Response: Resumes are not required as part of the offeror’s proposal.

43. RFP 2.4.2, Pg. 167 states, “The total number of the pages submitted for Volume I (Technical) shall not exceed 5 (8 ½ X 11 inch) pages, excluding a title page, table of contents, and glossary. If Volume I contains more than 5 pages, only the first 5 pages will be evaluated. Cover letters are not required; any information contained in a cover letter will not be evaluated.” Can the government please clarify if it is correct that Volume III (not II as stated) Technical is limited to 5 pages? It seems that the required information cannot be provided in such a low page count

Response: See the response to question 19.

44. Is this a new or existing requirement?

Response: See the response to question 4.

45. 12.1.1. None of the services required by this contract shall be subcontracted to or performed by persons other than the contractor or the contractor's workers without the prior written consent of the Contracting Officer. Question. What type of request document is required to gain consent of the Contracting Officer to present subcontractors as part of Offerors contract solution? If a subcontractor is presented as part of the offer and it is accepted by the Government, no further action should be required. However, if a subcontractor is determined necessary after award, the request should be presented as a letter of notification to the Government and accepted, subject to Limitations on Subcontracting.

Response: After contract award, the contractor shall submit a written request to the contracting officer to request use of any subcontractor that is not included in the offeror’s Technical Volume. There is no particular document/form required. The contracting officer may approve or deny use of a proposed subcontractor not included in the offeror’s Technical Volume after contract award.

46. If Offeror, plans to use subcontractors Past Performance Information Sheets (PPIS), then the Offeror must clearly identify the subcontractors relationship to the Prime Offeror and what the subcontractor will contribute to the resultant contract. How does the Government want the Offeror to define the subcontractor’s contribution to the resultant contract? FTE’s, specialties, percentage of total labor contract costs, etc., to be in compliance with Limitations on Subcontracting? To comply with Limitations on Subcontracting (if like situated socio-economic class businesses are not being proposed), the Prime contractor must perform at least 51% of the total labor contract costs. To reduce the burden of assessing this requirement, recommend it be measured over the life of the contract.

Response: Instructions for outlining a subcontractor’s contribution to the resultant contract are provided in Section 2.3 of ADDENDUM TO 52.212-1 of the combined synopsis/solicitation and shall be provided in Section I.C of the Past Performance Information Sheet. Additionally, Section 2.4.1.3 of ADDENDUM TO 52.212-1 states that if a subcontractor has been proposed, the contractor shall specifically address FAR 52.219-14, Limitations on Subcontracting (Deviation 2020-O0008) (MAR 2020); the contractor’s Technical volume shall clearly detail the nature of the relationship between the parties, (i.e. subcontractor, partner, etc.) and shall list the responsibilities of both the offeror and proposed subcontractor. The list shall demonstrate the offeror has the majority of duties and is responsible for overall contract management. The government will not specifically dictate how the offeror shall address FAR 52.219-14, Limitations on Subcontracting (Deviation 2020-O0008) (MAR 2020). 52.219-14 LIMITATIONS ON SUBCONTRACTING (DEVIATION 2020-O0008) (MAR 2020) is included in the solicitation. As stated in the clause, the limitations apply by the end of the base term of the contract and then by the end of each subsequent option period.

47. The Offeror agrees that Professional Liability (Malpractice) Insurance is required for Contractor's professionals who use their medical judgment, diagnosis, or recommend and referral for specific medical treatments such as Psychiatric Technicians, Psychologist, Licensed Clinical Social Workers, and Nurse Clinic Manager. According to 52.237-7 (a) Workers excluded from the Professional Liability Insurance requirements are listed as Medical Administrative Assistant, Data Analyst, and Clinical Staff Support Specialist. Does the Biomedical Repair Technician require Professional Liability Malpractice Insurance? The Biomedical Repair Technician assesses and evaluates the condition of in-use medical equipment for maintenance, upgrade, or replacement, therefore should not require Professional Liability Malpractice Insurance.

Response: The Government researched Professional Liability Insurance for Biomedical Repair Technicians and analyzed the costs and benefits. It has been determined that the best interest of the Government is to require Professional Liability Insurance for Biomedical Repair Technicians to reduce risk.
