Combined Synopsis/Solicitation for Teleradiology Services Single Award Task Order Contract
AMENDMENT 0002
The purpose of this amendment is to answer questions #3 through #8 from offerors. Paragraph 2.7 of the PWS has been revised.
The closing date and time of the solicitation remain unchanged. (See Paragraph 2.1.2. of Addendum to 52.212-1 of the solicitation).
AMENDMENT 0001
The purpose of this amendment is to revise the combined synopsis/solicitation and answer questions from offerors. The following revisions were made to Attachment 8 – Pricing Workbook for N62645-19-Q-0016: The Requirement B Worksheet has been updated to add Plain Film studies for Naval Hospital Camp Pendleton; and the Requirement C worksheet has been updated to add the number of studies for U.S. Naval Hospital Rota and to add U.S. Naval Hospital Guantanamo Bay. The following revisions have been made to Attachment 10 – Initial Requirement PWSs: The Requirement B PWS has been revised to add Plain Film studies for Naval Hospital Camp Pendleton; and the Requirement C PWS has been revised to add U.S. Naval Hospital Guantanamo Bay.
The closing date and time of the solicitation remain unchanged. (See Paragraph 2.1.2. of Addendum to 52.212-1 of the solicitation).
QUESTIONS AND ANSWERS
1. Is there an incumbent in place?
RESPONSE: Yes. Services are currently provided under contract N00189-14-P-Z400.
2. Will the providers have VPN access or need their own PACS?
RESPONSE: The Contractor is required to provide their own PACS (See Section 8.2.2. of the PWS). The Government will provide VPN access for the exchange of data associated with the radiology images (See Section 8.1.2. of the PWS).
3. Could you amend to set aside for SDVOSB?
RESPONSE: The solicitation remains a 100% small business set-aside.
4. Most of our teleradiology contracts do not have a restriction for one state of the medical licenses of the Radiologists. In a paperless environment and Radiologists who will be working under virtual contract(s) from your facilities, I’m hoping it does not matter which US State for their medical license on your Orders that will be in 6 different states. Could you please reconsider since that would be a great help logistically and ultimately with pricing?
RESPONSE: The Navy requires physicians interpreting images in other states to be licensed in both the state where the image was generated as well as the state where the interpretation takes place. Therefore, there is no change to the licensure requirements within Section 6 of the PWS.
5. Is this still solely for small business set aside?
RESPONSE: Yes. This requirement is a 100% small business set-aside.
6. In accordance with Paragraph 2.7 where “The contractor shall conduct internal peer review on each Radiologist and send peer review results to the MTF Head of Radiology each Month. A minimum of 10 cases will be reviewed per Radiologist per month…” It is current practice among all the MTF’s that a review of five (5) reviews per/provider is done on a monthly basis. In order to maintain consistency in the OPPE process - would the Contracting Officer consider modifying this requirement to meet the current Navy standards?
RESPONSE: Paragraph 2.7 of the PWS has been revised to require a review of a minimum of five (5) cases per Radiologist per month.
7. Section 7 – Credentials. Would the Contracting Officer consider designating one MTF as a central location as the Privileging Authority for this contract? This will ensure that all the Tele-Radiologist credentials files are maintained correctly and in one location. It will also facilitate the issuance of the ICTB’s out to the other commands and track the process at each command.
RESPONSE: The Contracting Officer will take the request into consideration; however, this results in no changes to the solicitation.
8. Section 9 - Quality Control. In accordance with Paragraph 9.2.3 - the contractor shall submit a Quality Control Plan to the COR and the Commanding Officer for review. Would the Contractor be required to submit the Quality Control Plan to each MTF, or to the Contracting Officer?
RESPONSE: The contractor shall submit the Quality Control Plan to the Contracting Officer and each COR appointed under the contract.

Performance Work Statement Teleradiology Services
SECTION 1 – SCOPE
1.1. BACKGROUND. This is a non-personal services contract covering a professional discipline which provides healthcare services to eligible beneficiaries of the Department of Defense (DoD) direct care system. The system comprises service-owned, staffed and operated hospitals and clinics throughout the world. Contracting has been chosen as a strategy to permit expansion of the healthcare capacity of DoD facilities by overcoming shortfalls in the numbers of uniformed practitioners and support personnel.
1.2. The contractor shall provide off-site diagnostic radiological interpretations and reports via teleradiology and transcribe all finalized exam reports into the Composite Health Care System (CHCS) in support of Navy Medicine Military Treatment Facilities (hereafter referred to as MTFs) and associated Branch Clinics in the Continental United States (CONUS) and Outside Continental United States (OCONUS). The location of the contractor’s facility shall be within the continental United States (CONUS).
SECTION 2 - DUTIES
2.1. The types and volume of radiographic interpretations for each MTF will be defined in site specific Task Orders.
2.2. In the event of active duty deployments or short-term absences of active duty Radiology Physicians, the contractor may be required to provide services that are outside of the defined service hours specified in the Task Order. In these cases the Government will provide a minimum of two weeks’ notice of the requirement unless otherwise specified in the Task Order. Additionally, other contingency services may be required and the contractor will receive same day notification of these requirements. The Government has no data on which to base an estimated need for these services, but anticipates infrequent occurrences of this type.
2.3. Contract Radiologists shall perform services consistent with clinical privileges approved by the Commanding Officer and consistent with the MTF's operating capacity and equipment as determined by the Commanding Officer.
2.4. The contractor shall interpret, dictate, and transcribe each received study. The contractor shall provide preliminary and final readings. Preliminary findings shall be transcribed by the contractor’s transcriptionist and provided to the MTF Emergency Department by facsimile within the timeframe specified in the Task Order. Final readings shall be completed and entered into the MTF’s Composite Health Care System (CHCS) by the contractor’s transcriptionist within the timeframe specified in the Task Order. The contractor’s transcriptionist must possess a Common Access Card (CAC) to access the MTF’s CHCS.
2.5. The contractor shall notify the MTF Radiology Department immediately upon recognition that technical difficulties prevent the contractor from receiving or reading images.
2.6. The contract Radiologists shall be available for telephonic consultation with physicians working at the MTFs for whom they are interpreting studies during all hours of service. The contractor shall provide current contact phone numbers for after-hours contract Radiologists.
2.7. The contractor shall conduct internal peer review on each Radiologist and send peer review results to the MTF’s Head of Radiology each month. A minimum of five (5) cases will be reviewed per Radiologist per month. If the Radiologists read less than five (5) cases in any given month then 100% of the cases read during that month will be peer reviewed and a comment will be included in the peer review results that are sent to the MTF. The contractor shall complete Focused Professional Practice Evaluations (FPPEs) and Ongoing Professional Practice Evaluations (OPPEs) on each Radiologist as required by the U. S. Navy’s Credentialing Privileging Program (BUMED Instruction 6010.30 or latest version) and Navy Medical Staff Bylaws (BUMEDINST 6010.17C or latest version). The contractor shall forward copies of completed FPPEs and OPPEs to the Head of Radiology at each MTF as defined in the site specific task orders.
2.8. The contractor shall provide the MTF a standard Discrepancy Report Form template. The MTF will submit completed Discrepancy Report Forms to the contractor when errors are discovered in the final radiology reports received from the contractor. The contractor shall review all Discrepancy Report Forms received from the MTF and take appropriate action.
2.9. The contractor shall submit a monthly invoice, accompanied by a detailed listing of hours of service provided and studies interpreted, to the COR specified in each task order.
SECTION 3 – HOURS OF OPERATION
3.1. The contract Radiologists shall be available during all hours of service for telephonic consultation with MTF physicians for whom they are interpreting studies, for the purpose of problem solving through direct communication. Two-way communication between the MTF and the contract Radiologists shall be established and maintained throughout the term of the contract. 6.3.2. At a minimum each Radiologist must submit two (2) references from peers who have had experience with the applicant’s practice within the past two (2) years that attest to the Radiologist’s competence to perform the requested privileges. BUMED Instruction 6010.30 (or latest version) provides the policy and procedures for reference letters.
SECTION 7 - CREDENTIALING REQUIREMENTS
7.1. Credentialed HCWs. The privileging authority per BUMEDINST 6010.30 will grant clinical privileges to Radiologists requiring privileges to perform services. 7.1.1 Following contract award, the contractor shall submit to the respective MTF Services Coordinator, via the COR, a completed Credentials Record (CR) for each Radiologist who will perform services under this contract. The CR is used as the basis of a clinical competency determination. The CR, maintained at the MTF, contains specific information with regard to qualifying degrees, licenses, national and/or board certifications, past professional experience and performance, education and training, health status, and clinical competency as compared to specialty-specific criteria regarding eligibility for defined scopes of health care services.
7.1.1.1. The contractor shall submit a complete CR (to include documentation of current clinical competency) to the COR no fewer than thirty (30) days prior to performance of duties. For those HCWs who currently have a CR on file, an updated Personal and Professional Information Sheet (PPIS) for Privileged Providers, with notation that a complete up-to-date CR is on file, shall be submitted no fewer than fifteen (15) days prior to commencement of services, in accordance with local policies. For verifications obtained via phone or written correspondence, the contractor shall provide written documentation from the verifying agency that includes the agency POC, position and contact information, the agency name, and the date of verification. For verifications obtained from a website that complies with The Joint Commission's accreditation standards for primary source verification, the contractor will provide a legible portable document format (.pdf) version of the web-based primary source verification and include the inquiry date and the website Uniform Resource Location (URL) address.
7.1.3. Upon receipt of a complete CR, the COR will forward the CR to the MTF’s Medical Staff Services Office (MSSO) for credentials review of the individual HCW. The MSSO shall ensure the CR is complete in accordance with (IAW) BUMEDINST 6010.30 (and subsequent revisions). The contractor shall not assign an individual to work at the MTF until the HCW’s CR has been approved by the designated Privileging Authority or other designated authority and shall discontinue the service of an individual who fails to maintain compliance with qualification and credentialing requirements.
7.1.4. . If the contractor submits an incomplete CR, the COR will notify the contractor. An incomplete CR will not be processed, and may be returned to the contractor if a prepaid means of return was provided when the original package was submitted; an incomplete CR package will not be retained by the COR. Presentation of incomplete packages by the contractor may be evaluated as part of the performance evaluation on future awards.
7.1.5. If, during the Government's evaluation of the CR, a negative current clinical competency assessment is determined, it will bring the MTF’s consideration of the Radiologist’s application for credentials review and privileging to an immediate close. Since meeting credentialing requirements and, as applicable, being granted privileges is required as a condition of employment under this contract, a negative current clinical assessment may result in the issuance of a task order termination notice by the Contracting Officer in accordance with Federal Acquisition Regulation (FAR) 52.249-12.
7.1.6. Throughout the task order, the contractor shall ensure that all documentation necessary to maintain a current CR is submitted to the MSSO via the COR, for inclusion in each file. The contractor shall maintain its own complete credential file for each Radiologist, which will be made available for Government inspection upon request if needed for further credential review.
7.1.7. If clinical privileges are suspended or held in abeyance pending an investigation into questions of professional ethics or conduct, performance under this contract may be suspended until clinical privileges are reinstated. No reimbursement shall be made and no other compensation shall accrue to the contractor so long as performance is suspended or clinical privileges are held in abeyance. The denial, suspension, limitation, or revocation of clinical privileges based upon practitioner impairment or misconduct may be reported to the appropriate licensing authorities of the state in which the license is held IAW DoD Manual 6025.13.
7.1.8. Permanent revocation of clinical privileges and permanent adverse administrative actions due to professional misconduct against licensed or certified practitioners may be reported to the appropriate professional licensure clearinghouse, and/or the National Practitioner Data Bank, and/or to the licensing authorities of the state in which the license is held in compliance with SECNAVINST 6401.2. The Department of Defense participates in the national reporting system established under Part B of the Health Care Quality Improvement Act of 1986, Public Law 99-660. SPECIAL CONTRACT REQUIREMENTS
NOTE 1: Before submitting an offer in response to the solicitation, prospective offerors are encouraged to investigate the potential tax consequences should they elect to perform on the resulting contract by using individuals who are not carried on their payrolls as employees. Under this RFQ, resulting contracts or its task orders, the Navy does not dictate whether the individual contract workers be classified by the successful offeror as an "independent contractor" or an "employee” for federal tax purposes. This determination shall be made solely by the offeror. If subsequent to award the successful offeror's determination is challenged, this shall be a matter to be resolved between the offeror and the Internal Revenue Service. The Navy will not consider favorably any request for the equitable adjustment to the contract upon the successful offeror's receipt of an adverse action by the IRS.
NOTE 2: For those offerors planning to engage in a teaming arrangement or to use subcontractors, a conflict of interest may be created if a company is identified as a prime contractor, teaming partner/subcontractor, or as a member of a Joint Venture on more than one offer. A conflict of interest may also be created if corporate personnel from a prime contractor, teaming partner/subcontractor, or a Joint Venture are identified on more than one offer. The Government's strong preference is that each company and its corporate personnel participate in only one offer. If the Contracting Officer concludes during offer evaluation that a potential conflict of interest exists the contracting officer reserves the right to require a conflict of interest mitigation plan from the prime contractors (offerors) of those offers. If an offeror fails to submit a plan, or submits an inadequate plan, the offer may not be considered.
NOTE 3: It is the contractor’s responsibility to be aware of applicable federal, state and local laws and regulations concerning wage compensation (e.g. overtime) to contract workers. The Navy will not consider favorably any request for an equitable adjustment to the contract upon the contractor’s receipt of adverse action by a federal, state or local agency.
1. AWARDS OF INITIAL REQUIREMENTS / MINIMUM GUARANTEE
Initial requirements will be awarded under task orders after the basic contract has been awarded. Only the offeror that is selected for a SATO IDIQ contract award will be awarded the initial requirements (Minimum Guarantee). Initial requirements represent all known requirements at the time the Combined Synopsis/Solicitation was released. Initial Requirements are outlined in Attachment 10 –Initial Requirement PWSs and Attachment 8 – Pricing Workbook for N62645-19-Q-0016. The Government reserves the right to adjust the requirements based on need and/or available funding. An offeror shall not receive award of the SATO contract if all prices for initial requirements are not determined to be fair and reasonable.
2. TASK ORDER CONTRACT

5. RESTRICTION ON THE USE OF GOVERNMENT-AFFILIATED PERSONNEL
5.1. Except in very limited cases, the federal criminal statutes at 18 USC 203 and 18 USC 205 bar Government personnel, both active duty and civil service, from working as a contractor employee in a Government workplace, including a medical treatment facility, either as a second job ("moonlighting") or while on terminal leave. The contractor agrees that, before making an employment offer to an active duty member or a civil servant, it shall inform the individual of the potential applicability of these statutes and further agrees to encourage that individual to seek an advisory opinion from his/her local ethics counsel before accepting an employment offer. In addition, without the prior written approval of the contracting officer, the contractor shall not use in the performance of this contract any persons currently performing medical or dental services under other Navy contracts.
6. NOTICE REGARDING THE DISSEMINATION OF EXPORT-CONTROLLED TECHNICAL DATA
