INSTRUCTIONS TO QUOTERS

**ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS**

This section specifies the format and content that quoters shall use in response to this RFQ. The intent is not to restrict the quoters in the manner in which they will perform their work but rather to ensure a certain degree of uniformity in the format of the responses for evaluation purposes. Quoters shall submit a quote that is legible and comprehensive enough to provide the basis for a sound evaluation by the Government. Information provided shall be precise, factual and complete. Legibility, clarity, completeness and responsiveness are important. Quotes shall be in the form prescribed by, and shall contain a response to, each of the areas identified below and FAR 52.212-1. Any quote which does not meet the requirements of the solicitation may be determined to be substantially incomplete and may result in rejection of the quoter’s entire quote. The Government will award a contract to the responsible quoter whose offer is determined to be most advantageous to the Government, price and other factors considered.

The quote shall be submitted in two separate volumes:

Volume I* - Technical

Volume II – Price (to include additional requirements below)

*No pricing information shall be included in Volume I.

A complete Volume I – Technical and Volume II – Price shall be submitted by the closing date specified in this solicitation. If any, one volume is received past the stated closing date specified in the solicitation, the entire quote may be considered late.

1. Volume I: Technical. In accordance with file submission requirements given in this section, the quoter shall provide sufficient technical documentation (including, but not limited to, product literature and specifications) demonstrating the following:

· The quoter is capable of meeting the delivery/shipping requirements listed in this solicitation.

· The quoter is capable of providing a Dust Collection System meeting the Essential Characteristics specified in this solicitation.

Volume I – Technical shall not exceed 10 pages (excluding a Cover Sheet and Table of Contents). Quotes exceeding the page limitations will have those excess pages unread and not evaluated.

2. Volume II: Price. In accordance with file submission requirements given in this section, the quoter shall submit the following:

· Title Page containing complete company name and address; company POC including phone number and email address; and, quoter’s CAGE code and DUNS number.

· Statement (from an official having the authority to bind the firm contractually) acknowledging the combined synopsis/solicitation, all amendments (if applicable), and include a statement that the offer is valid for 90 days.

· Completed FAR 52.212-3 ALT I. Quoters shall only complete Paragraph b if they have completed the annual representations and certifications in SAM.

· Completed Pricing section in this solicitation to include the following:

· Unit price (inclusive of shipping and installation)

· Total price (inclusive of shipping and installation)

· Manufacturer, Part Number and Place of Manufacture

Quoters are responsible for ensuring the calculations submitted with their quote are accurate.

Quotes will be evaluated for Completeness and Reasonableness. Adequate competition is anticipated for this acquisition. The government anticipates award of a Firm Fixed Price contract. Offerors shall submit firm-fixed pricing for the above requirement. Include commercial price lists and if applicable, any FSS schedule numbers and pricing; any applicable discounts to the Government; and, any additional components necessary to fulfill the Essential Characteristics of this requirement.

3. Quote Submission.

Two (2) files (one file for technical and one file for Pricing) shall be submitted via email to Andrew Hampton at andrew.a.hampton3.civ@mail.mil SUBJECT: N6264519Q0006. Quotes shall be submitted, via email only, as Microsoft Word, Microsoft Excel or Adobe PDF attachments.

Quotes shall be due no later than 1500 Eastern Time, on Monday, 05 Nov 18.

Any questions shall be addressed to andrew.a.hampton3.civ@mail.mil by email only no later than 1500 Eastern Time, on Thursday, 25 Oct 18. No phone calls accepted.

EVALUATION FACTORS FOR AWARD

The Government intends to award a contract resulting from this solicitation to the responsible offeror whose offer is the lowest price technically acceptable (LPTA) offer, which shall represent best value to the Government. Award shall be made on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for non-cost factors (i.e. technical conformance to the requirements of the solicitation). Evaluation of price will be based on the offeror’s total price for all line items as delivered to the specified destination. Past Performance is not an evaluation factor for this acquisition.

The quotes will be evaluated under the following factors:

Factor I: Technical

Factor II: Price

Factor I will be evaluated individually on a pass/fail basis. If an offeror’s technical quote is determined to have failed under Factor I, the offeror’s quote will receive no further consideration for award unless there are no other technically acceptable quotes.

If an offeror is determined to have passed under Factor I, then the offeror’s quote will be further evaluated on Factor II – Price. In doing so, Factors I and II are all equally important. If more than one offeror is determined to be passed on Factor I – Technical, Factor II – Price will be the deciding factor as the Lowest Price Technically Acceptable (LPTA) offeror.

Factor I - Technical

Quotes will be evaluated to determine if the quote meets the requirements of the Essential Characteristics and Delivery sections of this solicitation.

This will be rated as either Pass or Fail.

Conformance to Essential Characteristics - Evaluation shall include the ability to meet the essential characteristics of Factor II - Price

Price will be evaluated on completeness and reasonableness.

Reasonableness: The degree to which the Quoter’s total quoted price represents a fair and reasonable price, including any additional components that must be purchased to make the system fully functional. The quoter’s total quoted price will be used to evaluate price reasonableness on a competitive basis.

Completeness:

· The Quoter included pricing for all line items (as stated in the INSTRUCTIONS TO OFFERORS – ADDENDUM TO 52.212-1).

· The Quoter’s title page on Volume II – Price contained the information requested in INSTRUCTIONS TO OFFERORS – ADDENDUM TO 52.212-1.

· The Quoter included a statement acknowledging the combined synopsis/solicitation, all amendments (if applicable) and offer is valid for 90 days.

· The Quoter completed FAR 52.212-3 ALT I.

A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time of acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quoter’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

CONTRACTOR SUPPORT

NOTICE: NAVY USE OF SUPPORT CONTRACTOR FOR CONTRACT CLOSEOUT FUNCTIONS

Naval Medical Logistics Command uses two private contractors in support of the contract closeout process. Those companies are Contracting Resources Group (CRG) of Federal Hill, MD, doing business under the authority of the Small Business Administration’s 8(a) program, and the Ability One Program, doing business under the authority of the Javits-Wagner O’Day Act(41 U.S.C. § 47).

Performing these functions require the contractor employees to have access to the contract file. Therefore, information you provide to the Government or information already in the possession of the Government may be viewed by these support contractors in the course of performing contract close-out functions. The information that may be made available to the contractor may include pricing and technical qutoes and performance information.

(h) Certification Regarding Responsibility Matters (Executive Order 12689). (Applies only if the contract value is expected to exceed the simplified acquisition threshold.) The offeror certifies, to the best of its knowledge and belief, that the offeror and/or any of its principals--

(1) [ ___ ] Are, [ ___ ] are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(2) [ ___ ] Have, [ ___ ] have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property; and

(3) [ ___ ] Are, [ ___ ] are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and

(4) [ ___ ] Have, [ ___ ] have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
