About this file

This document is a Justification & Approval (J&A) for a sole source Architect-Engineer (A-E) contract for a reroofing project at Joint Base Pearl Harbor Hickam, Hawaii. Naval Facilities Engineering Command Hawaii (NAVFAC HI) is seeking to award a contract to Consulting Structural Hawaii, Inc. for Post Construction Award Services (PCAS) for Special Project RM16-1467, which involves reroofing Buildings 67, 67A, 67B, and 67C at Pearl Harbor Naval Shipyard.

The contract is being awarded sole source under Title 10 USC § 3204(a)(1) because Consulting Structural Hawaii, Inc. was a sub-consultant on the original design and possesses unique knowledge of the project. The reroofing work includes structural repairs, replacing roof decking, gutters, vents, ceiling-mounted lighting, removing non-functional exhaust fans, restoring exterior facades, repairing windows, updating fire alarm and sprinkler systems, and replacing air handling units and roof sections. The original design firm has retired, making Consulting Structural Hawaii, Inc. the most qualified vendor to provide continuity and technical expertise for the ongoing construction project.

J&A No. 25-18

JUSTIFICATION & APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

SPECIAL PROJECT RM16-1467 REROOF MACHINE SHOP BLDG 67/67A, SIOP,

JOINT BASE PEARL HARBOR HICKAM, HAWAII

1. Contracting Activity.

Naval Facilities Engineering Command, Hawaii (NAVFAC HI), Pearl Harbor, Hawaii.

2. Description of the Action Being Approved.

The purpose of this action is to request approval to use other than full and open competition to award a sole source Architect- Engineering (A-E) contract for Special Project RM16-1467 Reroof Machine Shop Bldg 67/67A, Joint Base Pearl Harbor Hickam to the firm of Consulting Structural Hawaii, Inc.

The original Design was developed by Danilo D. Lopez Associates, Inc. under previous Contract number N62478-16-D-5025 Task Order (TO) N6247819F4082 dated 7 Mar 2019, Modification P00001 dated 14 Jan 2020, Modification P00002 dated 4 Aug 2020 and Modification P00003 dated 3 Nov 2022 where Consulting Structural Hawaii, Inc.

structural sub consultant. The Design was completed on 21 Jun 2023 and included Post Award Construction Services (PCAS) support consisting of technical consultation during construction, including, but not limited to, review of construction submittals, site visits, operations and maintenance support information, record drawings, and other miscellaneous services. The Construction TO was awarded on 8 Sep 2023.

The A-E declined performing the PCAS support services because they were retiring from their profession. Thus, the Government cannot obtain PCAS services from Danilo D. Lopez Associates, Inc. and their Sub-consultants via contract N62478-16-D-5025. It was determined that for the Government to obtain the PCAS support contemplated in TO N6247819F4082, a sole source award to Consulting Structural Hawaii, Inc. is in the best interest of the Government.

3. Description of Supplies/Services.

A-E services for PCAS support during construction will require the use of previously acquired knowledge and experience obtained from the development and preparation of the design documents and any supplemental information associated with the preparation of the Request for Proposal (RFP) and the pre-award construction solicitation amendments. These services will include, but are not limited to, office consultation; field consultation and submittal reviews, changes due to unanticipated field conditions; and post award construction contract changes, along with reviewing of post-award contract modifications.

The estimated cost of the A-E services for this PCAS action is

This project will reroof Buildings 67, 67A, 67B, and 67C at Pearl Harbor Naval Shipyard and Intermediate Maintenance Facility. The Repair work includes structural; replacing roof decking, gutters, vents and downspouts; reroofing; replacing ceiling-mounted light fixtures and high bay lighting; removing non-functional exhaust fans and penthouse sheds; restoring portion of the exterior facade and replacing windows where sheds are removed; repairing windows;

repairing fire alarm and fire sprinkler systems; replacing two air handling units at Building 67A; replacing roof at small office room attached to the side of Building 67B; and replacing roof and translucent panels at Building 67C.

4. Statutory Authority Permitting Other Than Full and Open Competition.

This request is submitted pursuant to the authority of Title 10 USC § 3204(a)(1) Only one responsible source and no other supplies or services will satisfy agency requirements

5. Rationale Justifying Use of Cited Statutory Authority

NAVFAC Hawaii (HI) must award the follow-on services to Consulting Structural Hawaii, Inc since they have the technical expertise and historical design knowledge gained in the previous development of the final plans and specifications of the reroofing project. They have performed field and site investigations, conducted meetings and conferences with end-users and Government entities, performed environmental assessments, historic preservation compliance, and reviews of previous studies. The Construction work is already in process, so timeliness is a critical element. No other source has the ability to meet this time constraint.

An award to any other source would result in substantial duplication of effort and cost. The start-up cost for another source to familiarize themselves with the project is prohibitive and cannot be recouped through competition. The start-up costs include site field investigations, environmental and historic preservation reviews, and a complete revalidation of the design specifications, drawings, calculations and basis of design.

As a Sub-consultant to the Designer of Record (DOR) for this project, Consulting Structural Hawaii, Inc substantially contributed to the Final Design and has full knowledge and understanding of the work scope, cost constraints and existing site conditions along with an established working relationship with the end-users.

It best serves the Government in cost savings and efficiency that Consulting Structural Hawaii, Inc. is contracted to administer construction and assist the contractor who is awarded to construct. Contract terms in the preceding design TO prior to award specifically states and requires that the A-E DOR be required to perform PCAS services. As the lead Architectural DOR has retired and cannot perform PCAS services, it best serves the Government to retain the relevant and necessary sub-consultants who were part of the design team to possess the necessary historical references and maintain continuity in design in order to eliminate re-work and potential project delay.

6. Description of Efforts Made to Solicit Offers from as Many Offerers as Practicable.

No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Consulting Structural Hawaii, Inc.

to provide the required PCAS services.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the services covered by this Justification & Approval will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVFAC HI has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, NAVFAC HI will assess whether competition for future requirements is feasible.
