The Administrator of the Department of Labor's Wage and Hour Division (the Administrator) will publish annual determinations in the Federal Register no later than 90 days before the effective date of the new E.O. minimum wage rate. The Administrator will also publish the applicable E.O. minimum wage on www.wdol.gov (or any successor Web site) and on all wage determinations issued under the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute.
The applicable published E.O. minimum wage is incorporated by reference into this contract.
(3)

minimum wage, and for associated labor costs and relevant subcontract costs. Associated labor costs shall include increases or decreases that result from changes in social security and unemployment taxes and workers' compensation insurance, but will not otherwise include any amount for general and administrative costs, overhead, or profit.
(ii) Subcontractors may be entitled to adjustments due to the new minimum wage, pursuant to paragraph (b)(2).
Contractors shall consider any subcontractor requests for such price adjustment.

(6) The Contractor shall pay, unconditionally to each worker, all wages due free and clear without subsequent rebate or kickback. The Contractor may make deductions that reduce a worker's wages below the E.O. minimum wage rate only if done in accordance with 29 CFR 10.23, Deductions.
(7) The Contractor shall not discharge any part of its minimum wage obligation under this clause by furnishing fringe benefits or, with respect to workers whose wages are governed by the Service Contract Labor Standards statute, the cash equivalent thereof.
(8) Nothing in this clause shall excuse the Contractor from compliance with any applicable Federal or State prevailing wage law or any applicable law or municipal ordinance establishing a minimum wage higher than the E.O. minimum wage. However, wage increases under such other laws or municipal ordinances are not subject to price adjustment under this subpart.
(9) The Contractor shall pay the E.O. minimum wage rate whenever it is higher than any applicable collective bargaining agreement(s) wage rate.

Such disputes shall be resolved in accordance with those procedures and not the Disputes clause of this contract. These disputes include disputes between the Contractor (or any of its subcontractors) and the contracting agency, the Department of Labor, or the workers or their representatives.
(i) Antiretaliation. The Contractor shall not discharge or in any other manner discriminate against any worker because such worker has filed any complaint or instituted or caused to be instituted any proceeding under or related to compliance with the E.O. or this clause, or has testified or is about to testify in any such proceeding.
(j) Subcontractor compliance. The Contractor is responsible for subcontractor compliance with the requirements of this clause and may be held liable for unpaid wages due subcontractor workers.

EVALUATION
A. BASIS FOR AWARD
1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range. The non-price factors (technical proposals) of the three (3) lowest priced proposals will be evaluated by the Source Selection Evaluation Board (SSEB) in accordance with the criteria of acceptability set forth in the solicitation. However, at the Contracting Officer’s sole discretion, the right is reserved to increase the number of proposals it will review under this methodology. If at least one (1) of those proposals is found to be technically acceptable, the Government will make an award to the Offeror with the lowest price, if the price is found to be fair and reasonable in the price evaluation. If none of these proposals are found technically acceptable, groups of three (3) proposals will continue to be evaluated in the order of lowest price to highest price until an offer is found to be technically acceptable.
Accordingly, under this methodology, the non-price factors of some proposals may not be evaluated. If discussions are deemed necessary by the Contracting Officer, all proposals will be evaluated (both non-price and price) for the purpose of establishing a competitive range. Proposals shall be provided to the evaluators without any identification of prices or any rank order of prices.
2. The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
3. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.
4. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award.
An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.
B. EVALUATION FACTORS FOR AWARD
1. The solicitation requires the evaluation of price and the following non-price factors.
Factor 1 – Corporate Experience Factor 2 – Safety Factor 3 – Project Approach Narrative Factor 4 – Past Performance
The distinction between corporate experience and past performance is corporate experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.
2. Basis of Evaluation and Submittal Requirements for Each Factor.
(a) Price:
(1) Solicitation Submittal Requirements:
The offeror shall submit one original, using the Contract Pricing Schedule provided with the Request for Proposal in a sealed envelope separate from the Technical Proposal.
- Standard Form (SF) 1442 (Solicitation, Offer and Award)
- Offer Schedule
- Bid Bond
Failure to submit a Bid Bond conforming to the requirements of the solicitation may result in an Offeror's proposal being rejected as unacceptable.
(2) Basis of Evaluation:
The Government will evaluate price based on the total price. Total price consists of the basic requirements and all option items. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in the solicitation. In accordance with FAR 52.217-5, Evaluation of Options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
(i) Comparison of proposed prices received in response to the RFP.
(ii) Comparison of proposed prices with the IGCE.
(iii) Comparison of proposed prices with available historical information.
(iv) Comparison of market survey results.
Note 1: A price that is found to be unreasonably high in relation to the proposed work may be indicative of an inherent lack of understanding of the solicitation requirements and may result in the overall proposal being considered unacceptable.
Note 2: The estimated total contract price range, in accordance with DFARS 236.204 is between $25,000,000 and $100,000,000. Price proposals greater than the estimated range may be rejected.
(b) Technical Factors:
(1) Factor 1, Corporate Experience:
(i) Solicitation Submittal Requirements:
Submit Exhibit “A” (Construction Experience Project Data Sheet) under Tab “1.”
Submit a minimum of two (2) and a maximum of five (5) relevant construction projects for the Offeror that best demonstrate your experience as a prime contractor on projects that are similar in size, scope, and complexity to the RFP. Each project does not have to contain all elements identified below, however all elements identified below must be represented in the experience factor or the proposal will be determined unacceptable.
For purposes of this evaluation, relevant projects are further defined as:
Similar in size: Construction project with construction cost of $25 million or more.
Similar in scope: New construction of pipelines with similar sizes and pressure ratings of the requested work, pump stations and work in environmentally sensitive areas including archeological sites.
Similar in complexity: Pipelines replacement projects where the system must stay operational, stringent NEPA requirements and high volume pump stations.
In addition, the Offeror shall meet the following requirements:
Experience in construction of potable water pipe transmission mains with a minimum 18” diameter and a minimum length of one (1) mile.
Experience in construction of Water pump stations with a minimum flow of three (3) Million Gallons Per Day
(MGD).
At least one (1) project shall demonstrate experience in successfully managing multiple work sites under a single project.
Exhibit “A” must clearly address how the project meets the above requirements.
Projects submitted for the Offeror shall be 100% complete (see definition) within the past five (5) years of the date of issuance of this RFP.
100% COMPLETE: For construction projects: The facility is completely constructed and ready for…
