Revised December 2010

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

SINGLE SOURCE DETERMINATION FOR ACQUISITIONS NOT EXCEEDING THE SIMPLIFIED ACQUISITION

THRESHOLD AS DEFINED IN FAR 2.101

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER (within its warrant authority) DETERMINES THAT ONLY ONE SOURCE IS AVAILABLE IAW FAR 13.106-1(b). THIS DETERMINATION SHALL BE SUPPORTED WITH FULL JUSTIFICATION FOR SINGLE SOURCE FROM THE CUSTOMER. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:

QUOTE/SOLICITATION NUMBER:

N62473-19-Q-0803

ESTIMATED AMOUNT (Not exceeding $250,000): Estimate Cost

DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: The services required are to provide all labor, management, supervision, tools, material, and equipment required to perform refuse collection and disposal services for Camp SERE; Camp Michael Monsoor; and Camp Morena of San Diego County, California. The contractor shall provide all labor, transportation, equipment, parts/material quality control and assurances, and supervision necessary to complete the work described herein.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: This is a follow-on contract to N62473-14-P-1601, which is held by EDCO (Cage Code: 01YP1; DUNS 042927152). A full and open solicitation for this requirement was posted on the Government Point of Entry (GPE), Navy Electronic Commerce Online (NECO) on September 12, 2018. The solicitation closed on September 28, 2018 with no bids. The Acquisition Team reached out to a number of businesses (including, but not limited to, Allied Waste Services, Waste Management Services, Chugach, EDCO, and Daily Disposal Services) to gauge interest in this project.

EDCO was the only business able to perform the required services, due to the location of the project. EDCO did not agree with all of the requirements in the Performance Work Statement (PWS) and would not provide a quote for the project, despite being the incumbent. Since the close of the solicitation, the PWS has been revised in a way that should elicit a quote from EDCO.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES:

There are no other sources that can provide the services required to provide refuse collection and disposal services to Camp SERE, Camp Michael Monsoor, and Camp Morena. There is no reasonable expectation that a competitive solicitation would result in the receipt of a responsive, responsible offer from a source other than EDCO. The previous solicitation did not result in any quotes and extensive market research determined that no other businesses are able to provide quotes for these services. Furthermore, attempting a competitive solicitation while knowing only one business is able to do the work would cause undue delay to the Government. The previous contract for these services expired September 30, 2018.

The Government requires refuse collection services to resume under a new contract as soon as possible. These services are critical to base operations.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR IS NOT AVAILABLE: The requiring activity conducted market research and determined that there is only one source capable of performing the required services. Furthermore, the need for this service is urgent. An estimate of thirty (30) additional days would be required if full and open competitive procedures were used to fulfill the requirement and it is unlikely that a responsive offer from other than EDCO would be received. For the reasons stated above, the use of competitive procedures for this procurement is not in the best interest of the Government.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED: The Government will evaluate any future procurement concerning refuse collection services for the remote sites on a case by case basis and will make a determination at that time on the competitive nature of the instant procurement.

I certify that the statements above are complete and correct to the best of my knowledge.
