DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING COMMAND SOUTHWEST
1220 PACIFIC HIGHWAY
SAN DIEGO CA 92132-5190
IN REPLY REFER TO:
J&A No. 18-0202
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Facilities Engineering Command Southwest
2. Description of the Action Being Approved.
Award a sole source contract to Schmidt Construction Company to acquire two (2) existing modular Interim Relocatable Facility (IRF) buildings (210742T and 210743T) for the Marine Corps Training and Education Command (TECOM) sponsored MAGTF Integrated Systems Training Center – West (MISTC West). MISTC West’s parent unit is the Command and Control Training and Education Center of Excellence (C2 TECOE) Branch, MAGTF Staff Training Program (MSTP) Division.
3. Description of Supplies/Services.
This sole source requirement includes the purchase of two existing modular IRF buildings from the current lessor of the buildings in order to provide continued support of critical Marine Corps Program of Record (POR) command and control (C2) systems training and Battle Staff training provided by MISTC West Instructor Staff for I MEF Operating Force Marines stationed aboard Camp Pendleton and throughout the Southern California region. The estimated price to purchase the two modular buildings is $685,855.82 and will be funded with Program Marine Corps (PMC) funding.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is Title 10, U.S.C § 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Rationale Justifying Use of Cited Statutory Authority.
The existing modular IRF buildings are currently leased through 30 June 2018. MISTC West currently occupies IRF Buildings 210742T and 210743T located across from the I MEF Headquarters building area. The existing IRF buildings provides space for : (1) C2 systems classroom training; (2) MISTC West Instructor and Staff; (3) Combat Operations Center (COC) capability in support of Battle Staff Training; and (4) classroom and training network infrastructure operations. MISTC West is Marine Corps Training and Education Command’s (TECOM) training solution for providing standards based Command and Control (C2) systems and Combat Operations Center (COC) training to I MEF Operating Force Commanders and their staffs, and Marines stationed aboard MCB Camp Pendleton and the surrounding areas such as
Marine Corps Air Stations Miramar and Yuma; and Marine Force Reserve units stationed along the West Coast. MISTC West sponsored training also supports HQMC PP&O, I MEF, and TECOM training priorities addressed in the references (a) thru (c). This includes Marines deployed in support of Task Force Al Assad and Taqqadum as part of Operation Inherent Resolve (OIR), and I MEF units participating MAGTF TP training events such as the: (1) Integrated Training Exercise (ITX) at the MAGTF Training Command in 29 Palms, CA; (2) the Mountain Training Exercise (MTX) at the Marine Crops’ Mountain Training Warfare Training Center in Bridgeport, CA; and (3) MAGTF Staff Training Program (MSTP) sponsored MEF/MEB level exercises. The permanent facilities solution is to relocate the MISTC West functions to new facilities via Military Construction (MILCON) project P-1050, which is currently un-programmed. The Marine Requirements Oversite Council (MROC) ranked P-1050 as priority #58 during the Fiscal Year 2018 MILCON submission. Terminating the lease and purchase process could result in a potential training services gap for I MEF units until a suitable alternative is developed. Re-establishing the existing C2 systems training infrastructure that resides in 201742T and 210743T is problematic as well.
Marine Corps Installations (MCI) Command approved the purchase of the existing MISTC West IRF facility. Below is a lease versus purchase analysis:
Economic Analysis Production/Misc. Equipment Total Cost Purchase New $1,560,000 $250,000 $1,810,000 Lease (5-yrs.) $735,356 0 $735,356 Purchase Existing
IRF
$685,856 0 $685,856
Note: the above economic analysis is based on a previous Camp Pendleton Public Works analysis conducted in 4th Qtr, FY-16. An economic adjustment of 2.5% was applied across the five year leasing period. An 8% contract administration fee was included as well.
Competing this requirement involving specially modified facilities would involve substantial duplication of cost to the Government that is not expected to be recovered through competition.
The facilities cannot practically be located elsewhere and interruption of services enabled by the facilities for the time it would take for the current contractor to remove the existing facilities and a new contractor to install replacement facilities is not feasible due to the impact it would have on the I MEF Training Exercise Employment Plan (TEEP) for deploying units.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted in accordance with FAR Part 10. Several companies were contacted for the new IRF pricing only. The approved J&A will be posted on Federal Business Opportunity (FedBizOps) prior to the contract award per FAR 5.203.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government to purchase the MISTC West IRF buildings covered by this J&A to be fair and reasonable based upon the Economic Analysis and market research discussed above in paragraphs 5 and 6 by the Camp Pendleton Public Works Office.
8. Actions to Remove Barriers to Future Competition.
All efforts will be made to review the future requirements for space necessary to support the mission and an economic analysis will be utilized to determine the best procurement strategy for meeting the need if additional modular IRF buildings will be required.
