Subject: SOLICITATION N62473-18-R-1002, FIRM-FIXED PRICE DESIGN BUILD CONSTRUCTION
PROJECT, P-192 POTABLE WATER TREATMENT / BLENDING FACILITY MARINE CORPS AIR
GROUND COMBAT CENTER TWENTYNINE PALMS, CA
AMENDMENT 0004 – RESPONSES TO REQUESTS FOR INFORMATION (RFIs) AND OTHER CHANGES
A. The Solicitation is hereby revised as shown below.
RFI # 1: Current construction experience requirements severely limit competition. Please consider project experience with Potable Water treatment processes comparable to reverse osmosis filtration. Construction of successful membrane filtration systems, specifically microfiltration and electro-dialysis reversal technologies, provide comparable processes, equipment, materials, and operation, and use the same construction techniques as reverse osmosis. Adoption of this change would improve competition and would meet the fundamental technical requirements of the project. 00210 - FACTOR 2: EXPERIENCE
RESPONSE RFI #1: Requirement of submitting project experience with reverse osmosis filtration remains unchanged. No alternative or comparable potable water treatment process is acceptable.
RFI # 2. Current construction experience requirements severely limit competition regarding the operations requirement. Please consider changing the operations requirement to 1 year of operation as demonstrable experience, since one-year of operations typically extends through the warranty period providing proof of successful operations. 00210 - FACTOR 2: EXPERIENCE
RESPONSE RFI #2: Period of operation requirement has been revised to 1 year vice 2 years.
RFI # 3. Certain construction projects require the designer to provide additional client (owner) requested design during construction, following the initial completion of 100% plans and specifications. Please consider extending the definition of design completion to include owner requested final design modifications that occur after the start of construction. DEFINITIONS
RESPONSE RFI #3: For design projects: 100% plans and specifications signed off by an Architect-Engineer and ready for construction with final cost estimate, including owner requested final design modifications that occur after the start of construction. Does not include any Post Construction Award Support (PCAS).
RFI # 4. Phase Two indicates a bid bond will be required for “PTO #0001.” Please confirm this was included by mistake as this is a standalone project. Section 00100 – Instruction to Offerors
RESPONSE RFI #4: The solicitation is amended to read a bid bond will be required for the project.
RFI # 5. Phase Two section indicates “A total of one (1) original and three (3) hard copies of the complete Phase One proposal” however, the SF1442 Block 13 says to provide 1 original and five (5) copies. Please confirm which is correct. Section 00100 – Instruction to Offerors
RESPONSE RFI #5:
Please provide one (1) Original and five (5) Copies of the proposal.
RFI # 6. Paragraph 2 refers to “The Government anticipates three or more multiple award construction contracts.”
Please confirm this paragraph was included by mistake. Section 00210 – Basis of Award
RESPONSE RFI #6:
“The Government anticipates three or more multiple award construction contracts” is deleted in its entirety.
RFI # 7. Does each project submitted need to be a water treatment plant utilizing RO technology? Due to the lack of $25 million RO projects built in the country in the last 5 years and the additional requirements listed in Factor 2, this becomes a very high hurdle. Additionally, is each project submitted required to meet all of the criteria listed in Factor 2? Namely:
Ground water production wells Water tanks Pump station Filtration system Reverse Osmosis system Post-treatment (stabilization and disinfection) Evaporation ponds Pipelines
Or can a project be submitted that is $25 million and meets at least one of these criteria (RO water treatment plant, water tanks, filtration system, post treatment, evaporation ponds, or pipelines), as long as one of the projects submitted is a $25 million RO treatment plant?
Example: Would a $25 million water transmission pipeline with a water storage tanks and ground water production wells be considered relevant experience?
Thank you. Section 00210, Factor 2 : Experience, a. Proposal Submission Requirements, pages 11-12
RESPONSE RFI #7: Every submitted project in order to be considered relevant has to be a potable water treatment plant with a reverse osmosis filtration system with a net filtrate equal or greater than 2mgd, completed within 5 years, and in successful operation for at least two years, with construction of at least $25,000,000;
however not every submitted project needs to include the following elements as listed on Factor 2:
Ground water production wells Water tanks Pump station Filtration system Post-treatment (stabilization and disinfection) Evaporation ponds Pipelines
As stated on Factor 2, a project that includes all the listed elements above may be considered more favorably. The submitted example in this RFI would not be considered as relevant experience.
In addition as part of this amendment the following criteria has been revised:
completed within 5 years has been revised to completed within 10 years successful operation for at least two years has been revised to successful operation for at least one year construction of at least $25,000,000 has been revised to construction of at least $10,000,000
RFI # 8. Reference clause: Page 11 of 77, Factor 2 EXPERIENCE currently states:
“…. A relevant project is further defined as a potable water treatment plant with a reverse osmosis filtration system with a net filtration rate equal or greater than 2 million gallons per day (MGD) that have been in successful operation for at least 2 years, with construction cost of at least $25,000,000 ….”
We respectfully request amending the qualifying criteria as follows:
“…. A relevant project is further defined as a potable water treatment plant or a recycle water treatment plant with a reverse osmosis filtration system with a net filtration rate equal or greater than 2 million gallons per day (MGD) that have been in successful operation for at least 2 years, with construction cost of at least $20,000,000
Rationale for the requested change:
The reverse osmosis filtration system, whether applied to potable water treatment or to recycle water treatment plant are fundamentally the same. The design, construction, and operation of the RO filtration system is identical regardless of source water.
Additionally, with regard to our request the amendment of the construction value to $20,000,000 – we have constructed a 7 million gallons/day ground water plant using reverse osmosis filtration system at a construction cost of $21,000,000, less than the $25,000,000 minimum value you have proposed. We suggest that your specification of minimum 2-million gallons/day criteria already sufficiently defines the qualifying requirement, perhaps the minimum construction criteria is not warranted at all. Alternatively, if a minimum construction value is required, we respectfully request lowering the minimum construction value to $20,000,000.
RESPONSE RFI #8: Minimum construction cost has been revised with this amendment to a minimum of $10,000,000.
RFI # 9. The construction contract values are subject to inflation; so, the minimum construction value proposed should include a mechanism to adjust the costs taking into account the year of construction. Due to inflation, a project was completed in year 2010 and one completed 2016 are not in parity. We respectfully request that you allow a mechanism to adjust the contract values using appropriate cost index, such a ENR construction cost index. Costs would be adjusted using the index to a base year, perhaps date of issuance of the RFP.
RESPONSE RFI #9:
See response to RFI#8.
RFI # 10. Please confirm it is the Government’s intent for EACH construction project submitted in Factor 2 to meet ALL of the following criteria as listed on Page 11, SPECIFICALLY: potable water treatment plant with a reverse osmosis filtration system with a net filtrate equal or greater than 2mgd, completed within 5 years, and in successful operation for at least two years, with construction of at least $25,000,000. 00210 - FACTOR 2:
EXPERIENCE, page 11.
RESPONSE RFI #10: See response to RFI#7.
RFI # 11. The construction project experience requirements are extremely restrictive and may limit competition.
Our research indicates that fewer than 15 projects have been constructed in the United States within the past 5 years meet the construction experience requirements as currently written (i.e., potable water, reverse osmosis, greater than 2mgd, constructed value greater than $25M, completed within 5 years, and operational for 2 years within the last 5 years). Of those 15, only four are in California and two were design-build. Would the government consider changing the requirement to say “a minimum of one (1) construction project must include a reverse osmosis filtration system”? 00210 - FACTOR 2: EXPERIENCE, page 11.
RESPONSE RFI #11: See response to RFI #7
RFI # 12. can you send me the specifications or scope of work that would be involved so we may bid it properly.
Thanks.
RESPONSE RFI #12: Specifications or scope of work are not available at this moment. An RFP will be released to successful offerors that are selected for phase 2 of this solicitation.
RFI # 13. Are plans and specs available for the above project – if yes, could you please let me know how to obtain them?
RESPONSE RFI #13: See response to RFI#12
RFI # 14. I have been following the project at various plan rooms, unable to locate it on Fedbiz opps. Please provide a plan holder list. Thank you.

RFI # 15. Clarification regarding a project posting on DODGE Global Network. The post states the “action stage” is “Bidding” for the Design-Build Potable Water Treatment/Blending Facility N6247318R1002 but we are unable to find the actual RFP posted anywhere.
Could you please let me know if this RFP is actually out for solicitation and if it’s not, could you provide me with an estimated date that it will come out?
RESPONSE RFI #15: See response to RFI#12
RFI # 16. I was wondering if it would be possible to have the following changes add to the Construction Experience requirements for the above referenced project.
· Can you reduce the project value from $25,000,000 to $15,000,000.
· Can you change the completion timeframe from 100% completed within the last 5 years to last 10 years.
· Can you allow all water treatment plants, not just potable.
· Can you extend the solicitation offer date by weeks, as it is difficult to get signed verification sheets that quickly.
RESPONSE RFI #16
Project value has been reduce with this amendment from $25,000,000 to $10,000,000
Completion timeframe has been extended with this amendment from 5 years to 10 years
No other water treatment plants area acceptable. Follow criteria for relevant project as indicated in the solicitation.
The proposal due date has been extended to December 1, 2017 2:00 PM local time (San Diego, CA).
RFI # 17. The combination of requirements for a project to be both reverse osmosis potable water and greater than $25M is unnecessarily restrictive because there are so few projects constructed nationally that meet both criteria.
To meet the government’s intent to identify qualified contractors and also increase the pool of qualified Offerors, would the government consider revising Factor 2 - Construction Experience to the following minimum requirements:
Minimum of one (1) project that is potable water using reverse osmosis Minimum of one (1) project that is potable water with a constructed value greater than $25M
Minimum of one (1) project that is potable water greater than 2MGD
RESPONSE RFI #17:
See response to RFI #7
RFI # 18. We have reviewed the 1391 for this project FY 2018 Military Construction Program it included a description of the treatment process. The 1391 description states the process is necessary to meet the lowered MCL for naturally occurring chromium, however chromium is not included in the current solicitation.
We have the following questions regarding the treatment process:
1. Is the current solicitation for removal of naturally occurring chromium?
2. What are the levels of chromium III & VI in the ground water?
Do you currently have a brine discharge disposal location?
RESPONSE RFI #18: Requested information is part of the phase 2 RFP and therefore not available at the present time.
RFI # 19. I came across the subject project and noticed that there is a 3 MG tank to be installed. The bid date appears to be November 17, 2017 at 2:00. Is the tank to be installed a welded steel tank? Any project information that you can provide would be appreciated. We look forward to hearing from you.
RESPONSE RFI #19:
Requested information is part of the phase 2 RFP and therefore not available at the present time.
The proposal due date has been extended to December 1, 2017 2:00 PM local time (San Diego, CA).
RFI # 20. Could I get the drawing and civil specifications for the project below? Thank you for your help.

Requested information is part of the phase 2 RFP and therefore not available at the present time.
RFI # 21. The combination of requirements for a project to be both reverse osmosis potable water and greater than $25M is unnecessarily restrictive because there are so few projects constructed nationally that meet both criteria. RFI # 22. Paragraph (1) states "On a separate sheet, include a simple organizational chart” however, the second paragraph states “The technical approach narrative shall be limited to one (1) double-sided page (or two (2) single-sided pages), including the organizational chart.”
Please clarify if the org chart is to be on a separate page or included in the 2-page narrative.
RESPONSE RFI #22: Org chart is included in the 2 page narrative.
RFI # 23. Page 5 of the solicitation states: “a total of one (1) original and three (3) hard copies of the complete Phase One proposal in response to this RFP must be received by this office no later than the date and time stated in Block 13 of the SF1442.” Block 13 of the SF1442 states that an original and five (5) copies are required.
Can you confirm the number of required copies required for the Phase 1 proposal submittal?
RESPONSE RFI #23: One (1) Original and five (5) Copies
RFI # 24. Please consider modifying the second sentence of this paragraph regarding the definition of a relevant project. We believe the criteria as written in the RFP may unnecessarily exclude projects with specific relevance.
We propose the following criteria as an alternative: “For purposes of this evaluation, a relevant project is further defined as a currently operating potable or potable water quality treatment plant having a membrane filtration system with a net filtrate equal to or greater than 2 MGD.”
Given the very specific experience requirements, please consider projects that have been completed within the past ten (10) years of the date of issuance of the RFP to allow respondents to submit their most applicable projects.
RESPONSE RFI #24: See response to RFI#7
RFI # 25. Section of the Request for Proposal: Sources Sought N6247317S3407 Potable Water Treatment / Blending Facility at Marine Corps Air Ground Combat Center Twentynine Palms, California; Dec 15 2016 Paragraph: (4) Experience (see below) Page number: N/A
4) Experience: Submit a minimum of three and maximum of five Government or commercial new construction contracts/projects your firm has substantially completed in the last five (5) years, as a prime contractor, that best demonstrate your experience on projects that are similar in size, scope, and complexity to this requirement.
Experience must be demonstrated in construction of new potable water treatment plants, drilling and construction of groundwater production wells, evaporation ponds, water reservoir tanks, and water transmission lines. All potable water treatment plant projects must have a minimum construction cost of $50,000,000. All projects must involve new construction of facilities; repair projects will not be considered. For each of the contracts/projects submitted for experience, provide the title, location, whether prime or subcontractor work, award and completion dates, contract or subcontract final cost, type of work, type of contract, a narrative description of the product/services provided by your firm, and customer information including point of contact, phone number and email address.
Recent is defined as having been completed within the five years prior to the Sources Sought Synopsis issuance date. Substantially complete projects are those that are at least 80 percent completed as of the Sources Sought issuance date. Be advised that although substantially complete projects will be considered for market research purposes, if an actual solicitation is announced, all projects submitted in response to the solicitation must be 100 percent complete.
QUESTION:
In the original sources sought notification for this project, the relevant experience was stated as follows:
Experience must be demonstrated in construction of new potable water treatment plants, drilling and construction of groundwater production wells, evaporation ponds, water reservoir tanks, and water transmission lines. All potable water treatment plant projects must have a minimum construction cost of $50,000,000. All projects must involve new construction of facilities.
The sources sought construction experience project data form included block 7, listed below, which required experience construction the three listed scopes.
7. Experience:
Potable Water Treatment Plant Water Storage Reservoir Reverse Osmosis (RO) Treatment System
The relative experience for the Phase 1 solicitation has removed the experience requirements for potable water treatment plant and water storage reservoir. The solicitation has retained RO treatment system requirement and added a two year operating condition. Given that the RO portion of this project will total less than 30% of the actual project and very few RO plants have been built in the last five years that have operated for two years, we request that projects demonstrating construction of new potable water treatment plants, drilling and construction of groundwater production wells, evaporation ponds, water reservoir tanks, and water transmission lines be considered relevant as long as at least one project submitted is an RO treatment system that has been operating for two years and all projects submitted have a value of at least $25 million. This would be consistent with what was requested in the original sources sought on December 15, 2016.
RESPONSE RFI #25: See response to RFI#7.
RFI # 26. The first paragraph instructs Offerors to present an organizational chart “on a separate sheet” and the second paragraph states that the technical approach narrative is limited to one (1) double-sided page (or two (2) single-sided pages, including the organizational chart. Please clarify that the written portion of the technical approach may extend onto the same page as the organizational chart. Alternatively, please consider allowing the written approach discussion to extend to one (1) double-sided page (or two (2) single-sided pages, with a third separate page for the organizational chart.
Section of the Request for Proposal: Factor 1: Technical Approach Paragraph: a. (1) Proposal Submission Requirements Page number: 11 of 77
RESPONSE RFI #26: See response to RFI#22.
Section 00210, DEFINITIONS, Page 10 of the Solicitation is revised as follows:
Add: First-Tier Subcontract : a subcontract awarded directly by the contractor for the purpose of acquiring supplies or services (including construction) for performance of a prime contract. It does not include the contractor’s supplier agreements with vendors, such as long-term arrangements for materials or supplies that benefit multiple contracts and/or the costs of which are normally applies to a contractor’s general and administrative expenses or indirect costs.
Revised:
FACTOR 2 – EXPERIENCE
(a) Solicitation Submittal Requirements:
The Offeror shall submit the following information:
(1) Construction Experience:
Submit a minimum of two (2) and a maximum of five (5) relevant construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as potable water treatment plant with a reverse osmosis filtration system with a net filtrate equal or greater than 2 million gallons per day (MGD) that have been in successful operation for at least one (1) year, with construction cost of at least $10,000,000. Construction experience may be considered more favorably for Offerors showing experience in all of the following under one single project:
- Ground water production wells
- Water tanks
- Pump station
- Filtration system
- Reverse Osmosis system
- Post-treatment (stabilization and disinfection)
- Evaporation ponds
- Pipelines
A minimum of one (1) construction project shall demonstrate the driller experience in ground water production wells. Driller shall be licensed in the State of California and have 10 years of experience drilling water supply wells to a depth of at least 1,000 feet using flooded reverse circulation techniques. Submitted project(s) shall include proof of license in the State of California and a summary of the driller’s experience for construction and testing of similar wells in California during the past 5 years. If the Offeror does not have relevant experience in drilling ground water production wells, the Offeror may submit relevant experience from a subcontractor that they plan to use for this contract. The Offeror MUST SHALLprovide a letter of commitment and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract. The subcontractor to be used must be hold a First- Tier One subcontractor to the Offeror. If the Offeror will be self- performing the work, no letter of commitment is required, however, the relevant experience demonstrated must be their own work and not that of a subcontractor.
Projects submitted for the Offeror shall be 100% complete within the past ten (10) years of the date of issuance of this RFP.
A project is defined as a construction project performed under a single task order or contract.
For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather Offerors shall submit the work performed under a task order as a project.
The attached Construction & Design Experience Project Data Sheet (Attachment F) is MANDATORY and SHALL be used to submit project information. If the same project is being used to demonstrate construction and design experience, submit separate Project Data Sheets for construction and design. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded;
however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).
For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e.: unique features, area, construction methods, date completed).
If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects may be submitted for the Joint Venture members. Offerors who fail to submit experience for all Joint Venture members may be rated lower. Offerors are still limited to a total of five (5) projects.
If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract. Regarding any such submitted project, if the offeror fails to demonstrate the affiliate/subsidiary/parent/LLC/LTD firm’s meaningful involvement in the performance of this project, the project will not be considered and may not be evaluated.
The offeror may not utilize experience of a subcontractor to demonstrate construction experience under this evaluation factor, except to show drilling experience as noted above.
(2) Design Experience
Submit a minimum of two (2) and a maximum of five (5) relevant design projects for the design team that best demonstrates design experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as potable water treatment plant with a reverse osmosis filtration system with a net filtrate equal or greater than 2 million gallons per day (MGD), with construction cost of at least $10,000,000. Experience may be considered more favorably for Offerors showing experience in all of the following under one single project:
- Ground water production wells
- Water tanks
- Pump station
- Filtration system
- Reverse Osmosis system
- Post-treatment (stabilization and disinfection)
- Evaporation ponds
- Pipelines
Projects submitted shall be 100% complete within the past ten (10) years of the date of issuance of this RFP. For design-build projects, the design portion of the contract shall have been completed within the past ten (10) years of the date of issuance of this RFP.
A project is defined as a complete design effort performed under a single task order or contract/subcontract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project; rather Offerors shall submit the work performed under a task order as a project.
The attached Construction & Design Experience Project Data Sheet (Attachment C) is MANDATORY and SHALL be used to submit project information. If the same project is being used to demonstrate construction and design experience, submit separate Project Data Sheets for construction and design. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded;
however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).
For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e.: unique features, area, construction methods, date completed).
The Offeror may utilize experience of a design subcontractor to demonstrate design experience under this evaluation factor. The Offer must provide a supporting joint venture agreement, partnership agreement, teaming agreement, or letter of commitment and an explanation of the meaningful involvement for the design subcontractor. Regarding any such submitted project, if the offeror fails to demonstrate the affiliate/subsidiary/parent/LLC/LTD firm’s meaningful involvement in the performance of this project, the project will not be considered and may not be evaluated.
(ii) Basis of Evaluation:
The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction and design projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review five projects for construction and five for design. Any projects submitted in excess of the five (5) for Construction Experience and five (5) for Design Experience will not be considered.
Relevant projects where the Offeror and the proposed design firm(s) have previously worked together may be considered more favorably than those that have not worked together.
Relevant projects that demonstrate design-build experience may be considered more favorably than those that do not have design-build experience.
Add Clause:
5252.236-9309 KEY PERSONNEL (JUN 1994)
The Contractor shall employ the following professional personnel to perform the services required under this contract. No substitution will be made without the advance written approval of the Contracting Officer, after he has reviewed the proposed replacement's experience and qualifications record submitted by the contracting firm with explanation of the necessity for the change. No increase in salary rates will be allowed when personnel substitution is authorized.
Subcontractor used to show Drilling Experience in Factor 2 Subcontractor used to show Design Experience in Factor 2.
