About this file
This is an amendment (Amendment 0003) to Sources Sought Notice N62470-25-RFI0001 providing answers to 13 questions regarding a Multiple Award Construction Contract (MACC) for the Naval Facilities Engineering Command Atlantic.
The amendment clarifies several key requirements: the FAR 52.219-14 limitation on subcontracting will be 85% for general construction; firms must demonstrate capability to self-perform mechanical/electrical work either inside or outside the 5-ft line; only design-bid-build projects will be considered; hazardous material abatement may be subcontracted while the prime must self-perform at least 15% of demolition work; and joint venture experience will be accepted if the offeror demonstrates their self-performed work meets thresholds. The amendment revises the employee list requirement to focus on construction capabilities rather than environmental remediation. Responses are due by 2:00 PM Norfolk time on December 4, 2024. Project customer (DoD/Federal) status is for information only and not an evaluation criterion.

Amendment 0003 is issued to provide the following responses:
QUESTION 1 – Sources Sought Capabilities Questionnaire, Section 2, Item 5 – states “If awarded the firm will/will not pay more than 50% of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Prime contractor should describe how they will comply with FAR clause 52.219-14, Limitations on Subcontracting.”
Referencing FAR 52.219-14 – Limitations on Subcontracting, the 50% limitation applies to “Services (except construction)”, the limitation that applies to general construction is 85% per paragraph (e)(3). Please clarify this requirement as stated in the questionnaire.
ANSWER 1 –That is correct, the requirements of FAR 52.219-14 will apply.
QUESTION 2 – Sources Sought Capabilities Questionnaire, Section 2, Item 6 requires submission of an employee list that includes “…biologists, health and safety specialists, etc., that demonstrates the firm’s ability to perform environmental remedial actions and management of a large IDIQ cost reimbursement contract.” Few, if any, small business prime contractor’s employee personnel capable of performing environmental remediation services, this service is traditionally one of a specialty subcontractor that primarily focuses on that type of work. This Sources Sought is focusing on the demonstration of self-performance services that small business prime contractors will not be able to demonstrate.
ANSWER 2 – Questionnaire is hereby amended to: “Provide the total number of Full Time Equivalents (FTEs) currently employed by the firm. For a joint venture entity, provide total number of FTEs for each joint venture member. By separate attachment, provide a list of the number of employees by major categories, such as project managers, construction managers, quality control managers, architects, engineers, contract administration, craft/laborers, equipment operators, skilled trades, health and safety specialists, etc., that demonstrates the firm’s ability to perform construction activities and the management of industrial, utilities, production, storage, training, administration and general-type facilities including buildings, structures and civil site construction projects.”
QUESTION 3 – The Sources Sought Notice description and the Experience Information Form asks that the respondent provide past project experience that demonstrates “…experience with at least one (1) project that required self-performing complete or selective demolition, including material abatement.”
Is it the intent of this element of past experience that the “material abatement’ component of the demolition be by self-performance? Few, if any, small business prime contractors self-perform hazardous material abatement; this service is traditionally one of a specialty subcontractor that primarily focuses on that type of work. This Sources Sought is focusing on the demonstration of self-performance services that small business prime contractors will not be able to demonstrate.
ANSWER 3 – Solicitation is hereby amended to require “Experience self-performing complete or selective facility demolition that included hazardous material abatement (at least one (1) project). The prime must have self-performed at least 15% of the demolition work, and the hazardous-material abatement may have been performed by a subcontractor.”
QUESTION 4 – The Sources Sought Notice description and the Experience Information Form asks that the respondent provide past project experience that demonstrates “…experience with at least one (1) project that required self-performing mechanical, electrical or other utility construction, renovation or repair.”
Please clarify “mechanical, electrical or other utility construction, renovation or repair.”. Is the intent to demonstrate site utility work that involves mechanical and electrical or does this past experience also include interior facility mechanical and electrical work? Few, if any, small business prime contractors self-perform mechanical, electrical work , these services are traditionally one of a specialty mechanical/electrical subcontractor that primarily focuses on that type of work. This Sources Sought is focusing on the demonstration of self-performance services that small business prime contractors will not be able to demonstrate.
ANSWER 4 – The submitting Firm must be able to demonstrate the capability to self-perform mechanical, electrical or other utility construction, renovation or repair. At least one project must demonstrate this capability, whether it is considered a site utility project (outside the 5-ft line), or vertical facility project (inside the 5-ft line), or a combination of both.
QUESTION 5 - The Experience Information Form contains a column “DB or DBB”, will design-build (DB) projects be rated di erently than design-bid-build (DBB) as the Sources Sought Notice does not contain any evaluation criteria related to DB or DBB projects.
ANSWER 5 - Only design-bid-build (DBB) projects are contemplated under this MACC.
Submitted projects will be evaluated based on their similarity to the types of relevant projects listed without regard to who is the Designer of Record.
QUESTION 6 – The Experience Information Form contains a column “DoD/Fed”, the Sources Sought Notice does not stipulate that the projects have to be DoD/Fed or otherwise. Please clarify the criteria related to DoD/Fed projects.
ANSWER 6 – Project customer is for information purposes and not an evaluation criterion.
QUESTION 7 – Sources Sought Capabilities Questionnaire, Section 2, Item 6 requires submission of an employee list to demonstrate “…the firm’s ability to perform environmental remedial actions and the management of a large IDIQ cost reimbursement contract.”
Few, if any, small business prime contractors have experience on a “large IDIQ cost reimbursement contract”. The Sources Sought description only describes task orders in the range of $500,000 to $20,000,000 which are assumed to be fixed price construction contracts and not cost reimbursement contracts. This Sources Sought is focusing on the demonstration of performance on contract types that from the description are not anticipated to be utilized, please clarify.
ANSWER 7 – Questionnaire will be amended to: “Provide the total number of Full Time Equivalents (FTEs) currently employed by the firm. For a joint venture entity, provide total number of FTEs for each joint venture member. By separate attachment, provide a list of the number of employees by major categories, such as project managers, construction manager, quality control managers, architects, engineers, contract administration, craft/laborers, equipment operators, skilled trades, health and safety specialists, etc., that demonstrates the firm’s ability to perform construction activities and the management of industrial, utilities, production, storage, training, administration and general-type facilities including buildings, structures and civil site construction projects.”
QUESTION 8 – One of the Complexity factors states: “Experience self-performing construction, renovation or repair of a vertical facility such as an industrial, production, storage, training or administrative building.”. What level of self-performance is required to be presented? Self-performance IAW FAR 52.219-14, for general construction?
ANSWER 8 – Please refer to FAR 52.219-14(e)(3) for guidance.
QUESTION 9 – The “Scope” description in the Sources Sought Notice document does not state that the relevant project has to be DBB, however the “Scope” description in the Experience Information Form indicates the relevant project is to be DBB. In actuality, a DB project is a more complex project to manage and construct, please consider removing the DBB requirement from the Experience Information Form.
ANSWER 9 – Only design-bid-build (DBB) projects are contemplated under this MACC.
QUESTION 10 – Section 2 allows proposing with listed subcontractors or teaming members, pertinent data on the listed subcontractors or teaming members is to be provided in Section 2. If our response includes named subcontractors or teaming members will their participation satisfy the self-performance requirement of the relevant project “Complexity” requirement?
ANSWER 10 – Sources Sought document at page 2 under Complexity, the Source Sought is revised to strike “as well as their proposed first-tier small business subcontractors” so that it reads “For purposes of evaluating capability, the “O eror” is defined as the prime contractor that demonstrates the required minimum amount of experience self-performing work on relevant projects that meet scope and complexity.” The Capabilities Questionnaire primarily seeks to evaluate the level of work self-performed by the prime.
QUESTION 11 – Section 2 allows proposing with listed subcontractors or teaming members, Section 4 includes a Specialized Experience Table with columns for “Small Business Firm” and “Small Business with Team Members”, should a 3rd column be added “Small Business with Subcontractors” to match the response in Section 2?
ANSWER 11 – No. Section 2 only asks how you will be proposing. Team members include subcontractors; therefore the two columns are su icient to determine. Section 4 paragraph 2 is hereby revised to “Indicate by an “X” in the applicable block for facility-types in which your firm on its own and your firm in combination with all proposed team members listed under Section 2, as applicable, has had specialized experience.
QUESTION 12 – Will the Government accept relevant projects in which the respondent participated as part of a Joint Venture if the respondent is planning to pursue this MACC as a single prime contractor and not pursuing the MACC as the Joint Venture?
ANSWER 12 – Yes, but the O eror must demonstrate the amount of work that was self-performed on the contract, provided the amount of work meets the threshold amount per question 8.
QUESTION 13 - I’m unsure if we’re correctly filling out the Capabilities Questionnaire Section 3. Is there another spreadsheet with 5 questions we’re missing? Or is the only spreadsheet the attachment labeled Construction Experience Information Form and are the 5 questions in columns C-G?
ANSWER 13 – Please refer to the Construction Experience Information Form for Section 3.
