ADDENDA to FAR 52.212-4
The following information concerning prospective contractor responsibility is incorporated into the solicitation:
In accordance with Federal Acquisition Regulation (FAR) Part 9.1, the Contracting Officer shall award contracts only to responsible vendors. No purchase or award shall be made unless the contracting officer makes an affirmative determination of responsibility.
To be determined responsible, a prospective contractor must have adequate financial resources to perform the contract, or the ability to obtain them. The contracting officer shall require acceptable evidence of the prospective contractor's current sound financial status, as well as the ability to obtain required resources if the need arises. In regard to resources, the contractor must be prepared to present acceptable evidence of subcontracts, commitments or explicit arrangement that will be in existence at the time of contract award, to rent, purchase, or otherwise acquire the needed facilities, equipment, services, materials, other resources, or personnel. Consideration of a prime contractor's compliance with limitations on subcontracting shall be taken into account for the time period covered by the contract base period or quantities, plus option periods or quantities, if such options are considered when evaluating offers for award.
Pursuant to FAR 9.104-4, the Contracting Officer reserves the right to request adequate evidence of responsibility on the part of any prospective subcontractor(s).
In the absence of information clearly indicating that the prospective contractor is responsible, the contracting officer shall make a determination of non-responsibility.
As a minimum requirement, all vendors are requested to submit, as part of the original quote, the following:
(1) Company's Financial Statement which includes Balance Sheet and Income Statement; and
(2) Point of Contact from their Bank or any financial institution with which they transact business
The Contracting officer reserves the right to request additional information if needed.
EVALUATION OF PROPOSALS
A. The following FAR provision is applicable to this procurement and is incorporated by full text:
52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Factor 1 – Technical Capability Factor 2 – Past Performance Price
The relative order of importance of the non-price evaluation factors is the technical factor (Factor 1-Technical Capability) is of equal importance to the performance confidence assessment factor (Factor 2-Past Performance). When the proposal is evaluated as a whole, the technical factor and past performance (performance confidence assessment) combined (i.e., the non-price evaluation factors) are approximately equal to price.
The importance of price will increase if the Offerors’ non-price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-price proposal’s superiority to the Government. Award will be made to the responsible Offeror whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
B. BASIS OF AWARD:
1. The Government will utilize Source Selection procedures in accordance with FAR Part 15 to evaluate proposals. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the proposal determined to represent the best value—the proposal most advantageous to the Government, price and other factors considered.
2. The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
3. The tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced offeror or other than the highest technically rated offeror.
4. As stated in the solicitation, all technical factors when combined are of equal importance to the performance confidence assessment (past performance) rating; and all technical factors and the performance confidence assessment (past performance) rating, when combined are approximately equal to price.
5. Any proposal found to have a deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. Proposals may be found to have a weakness, significant weakness, multiple weaknesses, or multiple significant weaknesses that impact either the individual factor rating or the overall rating for the proposal. The evaluation report must document the evaluation board’s assessment of the identified weakness(s) and the associated risk to successful contract performance resulting from the weakness(s). This assessment must provide the rationale for proceeding to award without discussions.
C. Basis of Evaluation and Submittal Requirements for Each Factor
(a) Price:
(1) Solicitation Submittal Requirements:
The Offeror shall submit one (1) printed original hard copy, marked “Price Proposal”, and one
(1) electronic copy on separate CD. Price proposals shall be submitted on 8½ x 11 size page with a font size no smaller than 10 point. Electronic pricing information should be provided in both Microsoft Excel and PDF format and shall be Microsoft Office 2016 and fully editable to allow
Government evaluators to make price adjustments. All required documents provided in a format other than Microsoft Excel must be provided as PDFs. Offerors are advised that in the event of a discrepancy between pricing information contained on the Excel version and the PDF version, the PDF shall govern. Pricing information shall not encompass any elements of the non-price proposal. A separate PDF shall be provided for each item specified below.
The price proposal shall include the following:
Identify the Company profile, to include the Offeror’s name, address, names of two (2) points of contact (including title, phone number and email address), Unique Entity Identifier (UEI) and CAGE code;
Acknowledgement of all issued solicitation amendment(s) (SF-30’s) related to this solicitation;
Include a total price for Attachment C-Pricing Exhibit and include a detailed breakdown of prices by SDO collection for base and four option years for each period of performance.
These detailed breakouts will be used for price evaluation, ability to provide standards, negotiation, and invoicing purposes. Schedule of Prices is provided in Appendix D.
Include complete copy of Representations and Certifications from System for Award Management (SAM);
Include the company’s last three years financial statements which include balance sheet and income statement and point of contact for their bank or financial institution with which you transact business.
(2) Basis of Evaluation:
The Government will evaluate price based on the total price. The Government will also evaluate whether or not unbalanced pricing exists. Total price consists of the basic requirements and all option items. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in the solicitation. In accordance with FAR 52.217-5, evaluation of options will not obligate the Government to exercise the option(s).
Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
(i) Comparison of proposed prices received in response to the RFP.
(ii) Comparison of proposed prices with the IGCE.
(iii) Comparison of proposed prices with available historical information.
(iv) Comparison of market survey results.
(b) Non-Price Factor:
(1) Solicitation Submittal Requirements:
The offeror shall submit one printed original hard copy, marked “Non-Price Proposal”, and one
(1) electronic copy on separate CD. Non-price proposals shall be submitted on 8 ½ x 11 size page with a font size no smaller than 10 point. Each factor has a page limitation identified. Pages exceeding the page limitation for any factor shall not be evaluated. The non-price proposal shall not include any pricing information.
The non-price proposal shall include the following:
Identify the Company profile to include: the Offeror’s name, address, Unique Entity Identifier (UEI), CAGE code, and names of two (2) points of contact (including title, phone number and email address);
Factor 1, Technical Capability:
(i) Solicitation Submittal Requirements:
Provide a written narrative demonstrating the capability of the company and its’ systems to meet the minimum requirements listed in the Performance Work Statement. The written technical submission is limited to a total of twenty (20) single-sided pages, (i.e., one (2) double-sided page plus one (1) single-sided page; or twenty (20) single-sided pages), twelve (12-point font, Times New Roman, one inch borders on all sides).
• The Offeror must state each standard it will provide in a single software package to the Government.
• The Offeror must demonstrate their ability to deliver, in its entirety, any standard or group of standards listed in the Performance Work Statement for desktop Internet subscription access. The Offeror must demonstrate that they have the capability to deliver, in its entirety, any standards organizations listed in the attached performance work statement from the first day the contract is in effect. The Internet-based index and search engine must be complete and ready for immediate use on the first day the contract is in effect. No partial delivery of the specified standard or group of standards or substitutions in either data or delivery format will be acceptable as such could affect the use and licensing and potentially subject DoD to copyright liability otherwise covered by the Supplier.
• The Offeror must demonstrate experience in delivering standards or group of standards, for desktop Internet subscription access, prior to the award of this contract to either Government or Commercial entities.
• The Offeror must demonstrate that the needed documents are downloadable to hard-drive, printable and able to be viewed off-line.
• The Offeror must demonstrate that they have the capability to electronically deliver updates to the UMRL in accordance with Performance Work Statement.
(ii) Basis of Evaluation:
The Government will evaluate the extent to which the Offeror demonstrates capability and experience in providing access with similar scope and complexity to this requirement. The Government will evaluate the number of standards, meeting the requirements in the Performance Work Statement, each offeror will provide in a single software package. In addition, the assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the solicitation. For purposes of this evaluation, relevant experience is further defined as providing a subscription service to a Government or commercial entity. The minimum standard for Technical Capability has been met when the Offeror has successfully demonstrated experience in the following areas:
(1) As indicated in Appendix A in the SOW, the contract is to include all the Required Products listed in A.1 and the products that are available from the supplier listed in the Desired but Not Required in A.2 combined into a single software package;
(2) Can deliver, in its entirety, any standard or group of standards listed in the attached performance work statement for desktop Internet subscription access for which a proposal is being provided from the first day the contract is in effect;
(3) Users must be able to access the standards starting on the date the contract is awarded;
(4) Has the capability to deliver electronically the updated UMRL on a quarterly basis; and
(5) Has been determined to meet the minimum requirements listed in the Scope of Work.
Factor 2, Past Performance:
(i) Solicitation Submittal Requirements:
If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation for the Offeror is available, it shall be submitted with the proposal. If there is not a completed CPARS evaluation, the Past Performance Questionnaire (PPQ) included in the solicitation, (ATTACHMENT C) is provided for the Offeror or its team members to submit to the client for support of Offeror’s proposal. An Offeror shall not submit a PPQ when a completed CPARS is available.
The Offeror should provide completed PPQs in the proposal. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the Offeror is unable to obtain a completed PPQ from a client before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for the project(s) to obtain the PPQ information. However, such attempts will not relieve Offeror from the responsibility to ensure past performance information submitted in support of its offer is submitted by the proposal due date. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Kimberly King, via email at kimberly.y.king.civ@us.navy.mil prior to proposal closing date.
The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.
Past performance will be assigned a performance confidence assessment rating. The relative importance of the technical factors when combined is equal to the performance confidence assessment rating. All evaluation factors other than price, when combined are approximately equal to price.
Awards, letters of recommendation, certificates of appreciation, etc. shall not be submitted.
(2) Basis of Evaluation:
The degree to which past performance evaluations and all other past performance information reviewed by the Government (e.g., CPARS, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), performance recognition documents, and information obtained from any other source) reflect a trend of satisfactory performance considering:
- A pattern of successful completion of tasks;
- A pattern of deliverables that are timely and of good quality;
- A pattern of cooperativeness and teamwork with the Government at all levels (task managers, contracting officers, auditors, etc.); and
- Recency of tasks performed that are identical to, similar to, or related to the task at hand.
Responses are due no later than 13 April 2023, 2:00 p.m. Eastern Daylight Time (EDT).
Offerors that meet the requirements described in this announcement are invited to submit their proposal package via the DoD Secure Access File Exchange (SAFE) application. All responses to this announcement shall be submitted electronically via DoD SAFE. Hand carried delivery or postal/courier delivery of hard copies and/or CD-ROMs are not authorized. ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE
RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner.
There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory
Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
(N) Not Applicable
No information or did not apply to your contract
Rating will be neither positive nor negative.
