RESPONSE: FAR 52.225-1 is not incorporated into this solicitation. DFARS 252.225-7001 has been incorporated instead and contains a list of qualifying countries. See also, DFARS 252.225-7002 and 252.225-7021.

41) QUESTION: Confirm that “transportation by seas” clause is only applicable to the end product (i.e.

“supplies”) shipped to the FOB Destination point and that (complete) subassemblies shipped to the crane supplier’s assembly location is not required to comply with this requirement. It is our understanding that US Case Law agrees with our interpretation: U.S. Court of Appeals for the Federal Circuit - 926 F.2d 1110 (Fed. Cir. 1991) Feb. 13, 1991

Reference:

https://law.justia.com/cases/federal/appellate-courts/F2/926/1110/258337/

RESPONSE: We cannot provide the requested confirmation. The cited case reviewed the language of a now-outdated version of FAR 52.247-64, rather than DFARS 252.247-7023, which is included in this contract. The Government cannot guarantee any particular interpretation of the terms of the DFARS clauses whose inclusion are set by regulation.

42) QUESTION: Confirm that two cranes will be purchased under any resulting contract and that items 1 and 2 are not options.

RESPONSE: CLINs 0001 and 0002 make up the base price and will be awarded under any resulting contract. CLIN 0003 is an option.

43) QUESTION: This procurement is for the purchase of a commercial item. As we have done in numerous other offers, can we submit our Commercial Small Business Plan to fulfill the requirements of Factor 3.a. Our plan has been accepted in other DOD solicitations for similar commercial equipment supplied under NAIC’s Code 333923.

Information specific to the projects listed in Corporate Experience is not available - as these projects did not have a small business subcontracting requirement or were supplied overseas.

RESPONSE: It is imperative that the contractor respond to the factor completely. The commercial subcontracting plan may be accepted in place of the individual subcontracting plan, but the contractor is still required to provide Attachment H for each contract that had subcontracting opportunities and will still be required to provide the small business participation and commitment strategy document. The contractor should note that just because a contract was worked overseas does not mean that Attachment H is not required. Attachment H is required regardless of whether a subcontracting plan was required. If a contract was awarded/performed entirely overseas AND there were no subcontracting opportunities, then the contractor should provide an explanation to that effect.

No ISRs would be required if a subcontracting plan was not required; in this case, the contractor should state that no subcontracting plan was required due to the overseas nature of the work. As noted in the solicitation, explanations as to why requested information is not available will be considered.

44) QUESTION: Confirm that that the government will not evaluate an offer to the Solicitation if the Offeror participated in creating specific language included in the specification and confirm that the specification was created independently from potential supplier participation of the Technical Specification.

RESPONSE: The Government intends to comply with all applicable requirements regarding Organizational Conflicts of Interest.

45) QUESTION: Is it required that the factory test include gantry traversing a short distance along a set of runway rails with a load? Or Without a load?

RESPONSE: Motor or wheel rotation are acceptable alternatives to gantry travel during factory testing.

Means and measurements to be taken during testing shall be documented in the submitted factory test plan.

46) QUESTION: If necessary for installation of the crane, please confirm that the Government will remove necessary obstructions. From the drawing, it appears necessary to remove at least one Bollard at each crane installation position.

RESPONSE: The contractor will be responsible to work around obstructions shown on the pier drawings as the pier is scheduled to be complete prior to crane delivery. The contractor shall return the pier to original condition if it is modified or damaged during crane installation.

47) QUESTION: Identify any security measures that the offeror shall employ for shipment to this Government Facility. Also, identify the amount of time that the government will require to inspect the shipment from time of readiness to ship to the FOB destination. Please elaborate on the process in order that we may best understand our responsibilities and any delays.

RESPONSE: 1. The offeror is responsible for providing appropriate security measures during shipment.

These measure would include, but not be limited to, physical security, access control to the equipment, and maintaining physical integrity. 2. The facility will be conducting security inspection of the cranes when the transport arrives at the pier. These inspections are not expected to take more than 4 hours per crane. The cranes also will be subject to normal Customs and Immigration inspections as required by the relevant agencies. The offeror is responsible to scheduling these inspections. 3. Shipping of the equipment is the responsibility of the offeror. The government is not imposing requirements beyond a pier side security inspection and those typical for shipping this type of equipment. The government does require a transportation plan be submitted to ensure the offeror has exercised due diligence and ensure risks to the equipment are minimized.

48) QUESTION: Can the time of delivery / completion date be increased to 1095 days?

Reason: There are a significant number of contract / specification requirements and submittals in this solicitation requiring additional time over a typical commercial, industrial STS Crane. When factoring in the time for government response to submittals, a delivery time of 3 years is very realistic.

RESPONSE: The Contract Completion Date is based on prior delivery of similar equipment and data requirements.

49) QUESTION: Can minimum clearance inside legs be reduced to 55’- 6”?

Reason: Requested clearance will provide adequate clearance for container through the legs and is what is typical for an industrial STS crane. Is our standard design acceptable?

RESPONSE: Requirement will not be changed.

50) QUESTION: Can machinery house roof be sloped to drain in one direction to allow for a more standardized design?

RESPONSE: Section 2.2.12: change "The roof shall be sloped to drain in two directions at not less than 1/2-inch fall per 12 inches of horizontal distance." to read "The roof shall be sloped to drain at not less than 1/2-inch fall per 12 inches of horizontal distance."

51) QUESTION: Our boom hoist reeving has two separate ropes with turnbuckles for length adjustment to equalize the loading. Is our standard design acceptable?

RESPONSE: Specified requirement for load equalization within the boom hoist reeving shall be provided.

Use of manually adjusted turnbuckles does not meet this requirement.

52) QUESTION: Please allow for the elimination of the catenary rope support system.

Reason: Total trolley traversing distance is so short that main hoist ropes do not need additional supports to prevent sagging. Is our standard design acceptable?

RESPONSE: Requirement will not be changed.

53) QUESTION: Please allow for alternate trim, list and skew designs such as an electro mechanical screw jack system that would be located in the boom tip area. Is our standard design acceptable?

RESPONSE: Section 2.3.13: Change last sentence from "The trim, list, and skew mechanisms shall be located in the backreach and may be integrated with the snag protection system." to "Trim, list, and skew mechanisms located in the backreach may be integrated with the snag protection system."

54) QUESTION: Please allow for the machinery house and the electrical room to be separate rooms from each other.

RESPONSE: The electrical room is required to be a separate room within the machinery house.

PART 1.0 GENERAL

Definitions

Contractor – the Contractor supplying the Cranes and the Contractor’s representatives, subcontractors, and independent engineers retained by the Contractor.

Contractor’s Engineer of Record (Contractor’s EOR) – the Contractor’s professional engineers, for the design of the structure, ancillary structures, mechanical systems, and electrical systems, who shall be responsible for ensuring that the technical requirements of these Specifications are met. See Section 1.3.8 for other requirements, including for signing and sealing design drawings and calculations.

Cranes, or STS Cranes – the ship-to-shore, rail mounted, container handling gantry Cranes as described in these Specifications, including the structure, trolley, headblock, spreader, all attached and ancillary components, all control systems and components, all monitoring and maintenance systems and components, special tools, spare parts, and all other items defined in these

Specifications.

Global Axis – Crane orientation and analysis axis system referenced in the Specification: X axis parallel to trolley travel, Y axis vertical, Z axis parallel to gantry travel.

MOTCO Facility – to be located at Military Ocean Terminal, Concord (MOTCO), Concord, California, USA. See Appendix A for site plan. See Section 0 for restrictions at the MOTCO

Facility after delivery.

Point of Common Coupling (PCC) – The location where the Crane electrical system is connected to the wharf electrical system, defined as the end of the reeling cable where it terminates on the wharf furthest from the gantry cable reel on the Crane.

Specifications – This Specification, including appendices, and any clarifications, deviations, or other addenda agreed upon between the Government and the Contractor and incorporated into the

Contract. The intent of these Specifications is to provide structural, mechanical, electrical, and functional criteria, dimensions, operating speeds and accelerations, and pertinent details for the design, construction, and installation of reliable and efficiently functioning Cranes with accessories. Unless specifically stated otherwise, the Specification requirements apply to all

Cranes and all components, even if the requirement is stated in the singular. One gender means both genders.

Will and Shall – These Specifications are written to the Contractor. When a provision of this

Specification requires action by the Contractor, the verb “shall” is used. If the Contractor is allowed to exercise an option when limited alternatives are available, the phrasing “either … or

…” is used. However, where the words “or approved equivalent” are used, the Government reserves the option of rejecting the proposed equivalent. Statements provided in the Specification as information to the Contractor use the verbs “may” or “will.” Informational statements typically identify activities or options that “will be taken” or “may be taken” by the Government.

Specifications and Standards

General

The documents below form a part of this Specification to the extent specified herein. In case of difference between the following documents and this Specification, this Specification shall govern to the extent of such difference. In case of material specifications (ASTM), the design shall be based on the issue in effect at the time of bid, but material may be procured in accordance with the issue in effect at the date of manufacture.

Where reference is made to a standard specification, e.g., AWS D1.1, the latest edition in effect on the date of invitation for bids or request for proposal shall apply. If, however, the edition is stated, e.g., ISO 4628/3-1982(E), the stated edition shall apply.
