About this file

This document is a justification and approval for a sole source award of a professional services contract by the Naval Facilities Engineering Command. The contract provides technical, analytical, and investigative services to assess infrastructure and facility-related control systems at Navy and Marine Corps installations, including conducting all-hazard threat assessments, mission analyses, utility security assessments, cybersecurity reviews, and critical infrastructure protection analyses. The contractor must have DoD secret and top secret facility and personnel clearances. The sole source award to an incumbent contractor was justified based on an unusual and compelling urgency under the statutory exception, as a modification to an existing competitively awarded contract, with rates for option periods determined fair and reasonable. The follow-on requirement will likely be competed.

3. Description of Supplies/Services.

NAVFAC LANT procured a professional services IDIQ to support the requirements for the Navy and Marines Corps Mission Assurance Program. (2) Technical, professional, fieldwork, and administrative support required to perform assessments and reporting in the following fields: Antiterrorism/Risk Management, Physical Security, Law Enforcement, DoD Communications, FRCS, Cybersecurity, Critical Infrastructure Program Analysis, Mission Analysis, Supporting Infrastructure, Critical Asset Security, and Program Support and site visits;

(3) Technical, professional, fieldwork, and administrative support required to perform Utility Security Assessments (USA), Utilities Strategic Planning, Energy Security Analysis, Privatization Studies, and associated reporting in the following fields for facilities and utility systems:

The contractor also maintains a TOP SECRET facility clearance from Defense Security Services.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(2), as implemented by Federal Acquisition Regulation (FAR) 6.302-2, Unusual and Compelling Urgency. The agency’s need for these services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals and waive synopsis requirements pursuant to FAR 5.202(a)(2).

5. Rationale Justifying Use of Cited Statutory Authority.

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(a)(2), as implemented by FAR 6.302-2, which provides that full and open competition need not be provided for when the required services are of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits proposals. Not modifying the contract would result in serious injury, financial or other, to the Government (FAR 6.302-2 (b)(2)). The nature and urgency of this support is necessary to ensure OPNAV N4I, HQUSMC PP&O, and MCICOM mission requirements are met and executed.

The below cases are examples of different threats the All Hazard Threat Assessments, have and are in the process of, identifying and mitigating.

account for unforeseeable circumstances. Additionally, in accordance with FAR 6.305(b), the J&A will be posted within 30 days after the execution of the modification.

7. Determination of Fair and Reasonable Price.

The basic contract was procured competitively. Rates for option periods were determined fair and reasonable in accordance with FAR 17.207 criteria for exercising options. The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable

8. Actions to Remove Barriers to Future Competition.

The follow-on contract will most likely be competed as full and open competition as this contract was. The long-term requirement is being competed, and future requirements are also planned to be competed. As such, there are currently no additional actions needed to remove barriers for future competition.
