J&A Number: N69450-13-0163

Source Selection Information – FAR 2.101 and 3.104

DEPARTMENT OF THE NAVY

NAVAL FACILITIES ENGINEERING COMMAND SOUTHEAST

JACKSONVILLE, FL 32212-0030

Contract Number: N62467-06-D-0076

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity. The contracting activity is the Naval Facilities Engineering Command Southeast

(NAVFAC SE).

2. Description of the Action Being Approved. A modification to extend contract N62467-06-D-0076 for a period of two months, in accordance with FAR 52.217-8 (Option to Extend Services). This is a combination firm-fixed-price/indefinite-delivery type contract for Base Operations Support (BOS) Services at the Naval Air Station (NAS) Whiting Field, Milton, FL, supported Navy Outlying Fields, and other specified Sites, and Ranges or Facilities (Other Outlying Fields), located in Florida and Alabama.

The contractor is PRI-DELJEN, NAS WHITING FIELD, FL (JV), 6385 S. Rainbow Blvd Ste 420, Las Vegas, NV 89118-3203.

3. Description of Supplies/Services. The BOS services to be performed includes but not limited to;

family housing, facilities management, facilities investment, pest control, safety, grounds maintenance, other (swimming pools), pavement clearance, electrical, gas, wastewater, water, environmental, and base support vehicles and equipment.

The bridge contract period of performance is two months (from 1 October 2013 to 30 November 2013).

This allows time to award the competitive follow-on procurement. The estimated dollar values for the proposed period of performance are shown in the table below:

Period of Performance FFP IDIQ Total 01 Oct 2013-30 Nov 2013

The estimated cost for this action was derived from the value of the current period of performance escalated by 1.02%, in accordance with the Unified Facilities Criteria (UFC) 3-701-01 DoD Facilities Pricing Guide for FY2013 and 2014 Operation and Maintenance Escalation Rates. The Government anticipates adjustments in the prevailing labor wages due to revisions provided by the Secretary of Labor, which were not reflected in the estimated dollar values.

The contract is funded by the following types of funds:

-Operations & Maintenance, Navy -Navy Working Capital Fund -Defense Health Program Fund -Family Housing Operations & Maintenance, Navy and Marine Corps -Military Construction, Navy and Marine Corps

4. Statutory Authority Permitting Other Than Full and Open Competition. This acquisition will be negotiated pursuant to 10 USC 2304(c)(1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by Federal Acquisition Regulation (FAR) 6.302-1.

5. Rationale Justifying Use of Cited Statutory Authority. The basic contract was competitively procured as a Small Business set-aside, with five offers received. Award was made to PRI-DELJEN (JV) on 25 September 2006. PRI-DELJEN (JV) was a small business at time of award.

he contract with PRI-DELJEN (JV) will expire on 30 September 2013 . The contract also includes FAR 52.217-8, Option to Extend Services. The Agency started the reprocurement process in October 2011.

The proposed bridge contract extension to contract N62467-06-D-0076 is required due to a timely pre-award protest received on the competitive follow-on procurement. The protest is related to the small business status of the apparent successful offeror. The protest was referred to the U.S. Small Business Administration on 28 August 2013. The SBA notified the apparent successful offeror of the protest on 4 September 2013. Based on current projections, the planned award date is prior to the end of October 2013, which will allow the successful offeror time to complete a 30 day mobilization and phase-in transition period.

The estimated contractual cost to the Government that would be duplicated is . This estimate was derived based on estimated initial set-up costs including mobilization, employee badge issuance and security clearances, uniforms, hiring key personnel and subcontractors, inventory accounting and all other required start-up actions and associated costs. The estimated cost will not be recouped through any other means.

The estimated length of the delay is 61 calendar days. This estimate was derived based on the time required to address the pre-award protest, receive revised funding for contract award based on the change to the period of performance, make award and allow time for proper contractor transition/phase-in. This delay is unacceptable because it represents a gap in contractual coverage and mission essential services.

All required base operations support services to be performed under the authority requested by this J&A are critical requirements which the Navy needs in order to continue its mission.

The incumbent contractor, PRI-DELJEN, NAS Whiting Field, FL (JV), is presently the only known company that can perform these services without interruption until the follow-on acquisition can be awarded. PRI-DELJEN, NAS Whiting Field, FL (JV), possesses the manpower and skill levels to continue performance without a learning curve, a break in service, or any additional phase-in/mobilization requirements. Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency’s requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. Upon approval of this J&A, the proposed action will be synopsized on the Governmentwide Point of Entry (GPE) as a sole source extension of contract N62467-06-D-0076 to PRI-DELJEN, NAS Whiting Field, FL (JV). No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than PRI-DELJEN, NAS Whiting Field, FL (JV), to provide the required services.

7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition. The follow-on competitive acquisition is currently planned with proposed award on or before first quarter of Fiscal Year 2014. The contract start date is 1 December 2013. There are currently no additional actions required to remove barriers to future competition.
