About this file

This document is a Brand Name Memorandum for a Limited Source Justification issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division. The procurement is for spare and repair parts for the Clandestine Delivered Mine (CDM) project, with a total of 22,805 parts across 68 line items from specific manufacturers including Molex, Mill-Max Manufacturing, Bel Fuse, Amphenol, and others. The acquisition will be conducted as a firm fixed-price purchase order, set aside for small businesses, with the lowest-price authorized reseller being selected.

The justification emphasizes that these specific brand-name parts are exclusively required for CDM maintenance and repair, with alternative parts potentially compromising system performance or requiring additional costly modifications. The parts will be acquired using simplified acquisition procedures, with a delivery timeline of four weeks after order award. The total procurement represents the government's effort to maintain an extensive inventory to ensure consistent CDM system readiness, with the contracting officer determining this approach represents the best value considering price, administrative costs, and potential engineering redesign expenses.

Subj: BRAND NAME MEMORANDUM TO ACQUIRE SPARE AND REPAIR PARTS FOR CLANDESTINE DELIVERED MINE (CDM) (ERP No: 1301243924)

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department).

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order on a brand name specific basis to the lowest price offeror that is an authorized reseller of the following brands of products: Molex, Mill-Max Manufacturing, Bel Fuse, Amphenol, E-Switch, Broadcom, Panasonic Electric Works, Diodes Incorporated, Omron Electronics, Nexperia USA, Abracon, ITT Cannon, Analog Devices, Future Technology Devices International, Samtec, STMicroelectronics, Texas Instruments, Harwin, Analog Devices, onsemi, Microchip Technology, NXP USA, TE Connectivity Potter and Brumfield Relays.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The contract effort is to acquire the parts listed in attachment #1 of this justification for the Clandestine Delivered Mine (CDM) project.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold. All equipment will be delivered no later than four (4) weeks after award of the order.

4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

The Clandestine Delivered Mine (CDM) project requires the parts and items in attachment #1 of this justification to conduct maintenance and repair of the system. The parts being acquired are exclusively made only by the vendors listed in paragraph 2 of this justification and when combine with parts to produce the required accurate components and subsystems of the CDM. Use of alternative parts would be more costly as it would require additional tools and labor to fit the measurement needed. T h e v e n d o r s l i s t e d already provides parts with precise measurements needed for this project. Additionally, use of alternate equipment may introduce new or changing existing parameters that could damage or effect the proper operation of the CDM. In summary, the parts being acquired from the specified manufactured listed above have been used exclusively in the Clandestine Delivered Mine to the point that an extensive inventory of these parts are required to properly maintain and ensure the consistent operation of the mine system. In summary, t h e s e parts are being acquired to maintain that inventory to ensure the readiness of the Clandestine Delivered Mines in the fleet.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, reoccurring cost, administrative costs, engineering and redesign costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

FAR 8.404(a) does not require a synopsis for an order against a GSA or GWAC schedule. Use of a non-DoD contract will facilitate contract award through the use of Simplified Acquisition Procedures (SAP) to meet stringent U.S. Navy scheduling requirements.

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As explained in paragraph 4 above, the brands specified in paragraph 2 of this document are the only brands that can meet this requirements.
