About this file

This document is a Sole Source Justification Memorandum to acquire fire damage clean-up services. The Naval Sea Systems Command Naval Surface Warfare Center Panama City Division (NSWC PCD) has a requirement to repair fire damage to one of its buildings. CARTER RESTORATION BAY COUNTY FLORIDA LLC is identified as the sole source capable of meeting the requirement within the necessary timeframe. The services to be provided include contents evaluation, packing, moving, storage, cleaning, and restoration of the building. The total estimated value of the requirement is not provided. NSWC PCD is justifying the sole source award to CARTER RESTORATION BAY COUNTY FLORIDA LLC under the unusual and compelling urgency exception, as it is the only local company with the necessary CAGE code to do business with the government. The contracting officer has determined this order represents the best value to meet the government's needs.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 3204(a)(2) – Unusual and compelling urgency, FAR 6.302-2.

NSWC PCD has a requirement to repair after a fire damaged it. This purchase is not suitable for full and open competition for the following reason. Market research has revealed that there are no fire restoration companies within 50 miles of the base that hold a current cage code except CARTER RESTORATION BAY COUNTY FLORIDA LLC. It is estimated that it takes approximately 2 months for a company to acquire a cage code, which is necessary to do business with the Federal Government. Timely response is necessary for the Government to continue the mission and has unique building needs. Privacy is of tantamount importance to the Department and is one of the few buildings on the base with that amenity. The building must be brought back into operation as quickly as possible to carry on the mission. CARTER RESTORATION BAY COUNTY FLORIDA LLC is a local company that has already assessed the damage and is currently on standby to execute the damage remediation after award. NSWC PCD command is in dire need of returning the space to occupancy.

As such, the government does not expect significant savings through competition, does expect unacceptable delays, and it is more advantageous to the Government to award on a sole source basis to CARTER RESTORATION BAY COUNTY FLORIDA LLC for the items listed in paragraph 3 above.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, CARTER RESTORATION BAY COUNTY FLORIDA LLC is the only source that can meet the Government’s needs.

This requirement will be synopsized in the government point of entry SAM.gov.

7. Any other facts supporting the justification. None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, CARTER RESTORATION BAY COUNTY FLORIDA LLC is the only source that can meet the requirement.
