52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
i. Distributor Authorization
ii. Brand name item certification
iii. Price
All factors are equal. The Offer will be evaluated on an “ACCEPTABLE or UNACCEPTABLE” basis. Any offer that is found to be “UNACCEPTABLE” in any factor will result in the entire offer being deemed unacceptable.
In order to be considered awardable, there must be an “acceptable” rating in every non-price factor.
The following adjectival ratings/definitions shall be used for the evaluation of Factors 1 and 2.
TABLE 1: TECHNICAL ACCEPTABLE/UNACCEPTABLE RATINGS
RATING DESCRIPTION
ACCEPTABLE PROPOSAL CLEARLY MEETS THE MINIMUM
REQUIREMENTS OF THE SOLICITATION.
UNACCEPTABLE PROPOSAL DOES NOT CLEARLY MEET THE
MINIMUM REQUIREMENTS OF THE
SOLICITATION
Factor 1- Distributor Authorization will be determined to be technically acceptable if the offeror provides evidence (i.e. authorized letter) that they are an authorized small business Furuno distributor.
Factor 2- Brand name item certification will be determined to be technically acceptable if the offeror provides evidence (i.e. certified statement) that the items quoted are Furuno brand specific commercial off the shelf items (COTS) as specified in each line item.
Award will be made to the offeror who is deemed responsible in accordance with FAR 9.104 and whose proposal is determined to be technically acceptable with the lowest price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
