SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
PROPOSAL PREPARATION INSTRUCTIONS
1.0 General. If you want to compete for the contract described in Sections A through J of this Request for Proposals (RFP), you must submit a proposal that includes the following: (1) an offer and (2) information about your past performance. When evaluating your proposal, the Government will consider how well you complied with these instructions. The Government will consider any significant failure to comply with these instructions to be indicative of what could be expected from you during contract performance. Please contact the contract specialist listed on the cover page of this RFP if you do not understand any part of these instructions.
2.0 Offer. Your offer must consist of the following:
a. Standard Form 33, ―Solicitation, Offer, and Award with blocks 12 through 18 completed by offeror.
b. RFP Section B, ―Supplies or Services and Prices/Costs, with your proposed prices inserted in the appropriate blank spaces. You must provide a firm-fixed price for Contract Line Item Number (CLIN) 0001and Option Items 0003, 0004, 0005 and 0006. For CLIN 0002—Over and Above Work—you must provide your fully burdened labor hour rate (which shall include wages, indirect costs, general and administrative expense, and profit) and your material handling rate (if you choose to propose such a rate).
c. RFP Section K, ―Representations, Certifications, and Other Statements of Offerors, completed by you.
The completion and submission to the Government of the above items of information will constitute your offer to perform in accordance with the terms and conditions in Sections A through J of this RFP, including attachments and documents incorporated by reference. Your offer must communicate to the Government your unconditional assent to the terms and conditions of this RFP, its attachments, and documents incorporated by reference. The Government’s acceptance of your offer will create a binding contract between us.
The Government will not entertain alternate proposals. If you (1) fail or refuse to assent to any of the terms and conditions of this RFP, (2) propose additional terms or conditions, (3) fail to submit any of the information required by this paragraph 2.0, or (4) fail to provide written acknowledgement of all amendments issued, then the Government will consider your offer to be unacceptable, which will make you ineligible for contract award. The only way that an unacceptable offer could be made acceptable would be through discussions (see FAR 15.306(d)).
However, the Government intends to award a contract without discussions, as permitted by FAR 15.306(a) and 52.215-1. Therefore, we warn you to consult with the contracting officer before submitting an alternate proposal, submitting an offer that takes exception to any term or condition of this RFP, proposing any additional term or condition, or omitting any of the information requested. The Government reserves the right to conduct discussions and to permit offerors to revise their proposals if it is in the Government’s best interests to do so.
3.0 Required Information.
a. Past Performance Information. Prepare and submit one Reference Information Sheet for each of the contracts that you would like the Government to consider when evaluating your past performance in the format of (RFP Attachment 2). On the Reference Information Sheet, include the names of references who can verify that you have done the type of work that is required under the contract contemplated by this RFP and who will provide information about the quality of your past performance. You may submit a total maximum of ten (10) reference information sheets. However, we may not contact all of your references. The contracts that you reference must be ongoing or have been completed within the last three (3) years. Make sure that your reference information is up to date and that each reference will cooperate with us. Do not give us the names of a reference unless you have made sure that we can reach that reference at the telephone number, e-mail address, and postal address that you have provided, and that they will give us the information that we want. In addition, you must prepare and submit one Small Business Subcontracting Data Sheet (RFP Attachment 3) for each contract that you reference on the Reference Information Sheets, unless one or more of the contracts that you reference contained a Small Business Subcontracting Plan pursuant to FAR 52.219-9, in which case you must submit the most recent Subcontracting Report for Individual Contracts, instead.
