About this file
This document contains a government response to requests for clarification regarding a solicitation for maintenance, repair, and preservation services on two Yard Craft vessels, YC 1476 and YC 1489.
The Regional Maintenance Center at Puget Sound Naval Shipyard and Intermediate Maintenance Facility intends to award a firm-fixed-price contract to transport the vessels to the contractor's facility, dock and clean the exteriors, blast and preserve all exterior surfaces, shift the vessels to preserve underwater hulls, remove and install zinc anodes, inspect and repair hull plating, apply non-skid deck coating, open and test tanks, preserve six tanks, undock the vessels, provide redline vessel drawings, and return the vessels to PSNS. The period of performance is February 2 to April 28, 2022. This small business set-aside is under NAICS code 336611 with a size standard of 1,250 employees. The government will award on a lowest-price technically acceptable basis in accordance with FAR 15.101-2 in January 2022.

Government Responses to RFCs – Rev.1
1) Question: In paragraph 3.5.1.2 the specification states “Brush-off blast the entire Weather and Cargo Deck……” a Brush-off blast is otherwise referred to as a SSPC-SP-7 and is intended to remove loose coatings, retaining tightly adhered coatings. Later in the paragraph the specification states “Accomplish the requirements of Surface Preparation SSPC-SP-6 of Systems and Specifications….”. Is it the Navy’s intent to have the contractor Brush-off Blast (SP-7) the entire deck or Commercial Sandblast (SP-6) the entire deck surface?
Reponse: Paragraph 3.5.1.2 should reflect the surface preparation listed in 3.5.1. SSPC-SP-10.
See Statement of Work (SOW) Errata 1.
2) Question: YC-1476: Upon comparison of Attachment J-2 Price Proposal Worksheet to the SOW, there are 11 Paragraph numbers on the Price proposal that do not match up with the SOW paragraph numbers. In addition, the price proposal seems to be missing the work item for Preliminary Air Test. Are you able to provide an updated Price Proposal Worksheet? YC-1489: Upon comparison of Attachment J- 2 Price Proposal Worksheet to the SOW, there are 8 Paragraph numbers on the Price proposal that do not match up with the SOW paragraph numbers. Are you able to provide an updated Price Proposal Worksheet?
Response: Errors corrected on J-2 Price Proposal Worksheets. See Errata 1.
3) Question: Paragraph 3.5.1 states: Accomplish Near white blast SSPC-SP-10 and new preservation. However, Paragraph 3.5.1.2 states: Brush-off blast clean the entire Weather Deck and Cargo Deck… Accomplish the requirements of Surface Preparation Specification SSPC-SP-6…Can the government clarify if two different Surface Prep methods (SP-10 & SP-6) are to be used? If so, can you clarify what areas of the deck each surface prep method are to be used?
Response: Paragraph 3.5.1.2 should reflect the surface preparation listed in 3.5.1. SSPC-SP-10.
See Statement of Work (SOW) Errata 1.
4) Question:
In past formulas, the G&A rate was calculated for Prime Contractor Labor costs only. This now appears to also include markup on Materials (and other items).
In past formulas, the Profit rate was calculated for Materials & Subcontractor costs only. This now appears to also include markup on Contractor Labor costs (and other items).
By adding markup on Prime Contractor Labor, Materials, & Subcontractor costs to *both* G&A & Profits for all totals, this adds a significant cost to the bid; however, we recognize this may have been intentional.
Can the government confirm if this is an oversight, or whether the Navy will adopt these new markup policies going forward?
Response: The formulas in the new J-2 Price Proposal Worksheets are not oversights and can be expected to be used moving forward. The Contracting Officer determined that additional information is required to determine fair and reasonable pricing. Formulas are based on Cost Accounting Standards and Generally Accepted Accounting Principles. See the following FAR references related to pricing policy.
Per FAR 15.402 Pricing Policy (a)(2)“When certified cost or pricing data are not required by 15.403-4, shall obtain data other than certified cost or pricing data as necessary to establish a fair and reasonable price, generally using the following order of preference in determining the type of data required:
(ii) Data other than certified cost or pricing data such as-
(B) Cost data to the extent necessary for the contracting officer to determine a fair and reasonable price.”
Per FAR 15.402(a)(3) “…if a fair and reasonable price cannot be established by the contracting officer from the analyses of the data obtained or submitted to date, the contracting officer shall require the submission of additional data sufficient for the contracting officer to support the determination of the fair and reasonable price.”
