MEMORANDUM TO THE RECORD

Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN

ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

I. BACKGROUND:

1. JML # 91833000 Procurement is Urgent Sole Source, delivery is required by 09/30/2019.

The estimated cost of the repair is $189,000.

2. The Hankook R80 Propulsion Shaft Lathe is generating hydrostatic CNC faults and rupturing hydrostatic lines due to the system being out of adjustment. Repair of shafts are on the critical path to completing carrier availabilities on time. The Hankook shaft lathe is needed for carrier shaft repairs. Issue with the hydrostatic system has been on-going since the machine first put into use. The maintenance team has been continuously adjusting and repairing it for about four years. In April of 2019 the manufacturer identified that the hydrostatic faults are being caused by the bed of the machine being out of level. We have been working on getting a quote for this work and the SOW since then.

II. DESCRIPTION OF ITEM OR SERVICE:

Alignment, leveling, axis compensation, and hydraulic/hydrostatic repairs on a Hankook R80 shaft lathe. This service shall include leveling and aligning both the carriage and tailstock beds, axis compensation for positioning accuracy and repeatability, carriage hydrostatic gage replacement, hydraulic and hydrostatic filter and oil change, and component tuning, steady rest alignment, manufacturing of steady rest alignment keys, removal of one manual turning steady rest, and testing of all requirements.

1. _X__ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

Hankook owns the tooling needed to align and level the machine bed and the drawings and schematics available to execute the work. The tools allow reach and access to the adjustment mechanisms located under the machine bed.

Hankook America owns the hydraulic and hydrostatic drawings and schematics

2. _X__ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. ___ OTHER REASONS. Other reason not identified above. Provide details on mission impact if requirement is not solicited from only one source.

B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer. Discuss why you are precluding consideration of a product manufactured by another company. Describe how the particular brand name, product, or feature is essential to the Government’s requirements and why a “brand name or equal” purchase description cannot be used (see FAR 11.104). Describe how market research indicates other companies’ similar products or products lacking the particular feature do not meet, or cannot be modified to meet, the agency’s needs.

The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3.
